About this file

This is a Commercially Useful Function (CUF) Certification form used by state and local government agencies to verify that Small Businesses (SB) and Disadvantaged Veteran Business Enterprises (DVBE) identified in contract bids will perform meaningful work on the project. The certification requires proposers to complete a separate form for each certified SB or DVBE subcontractor that will execute a distinct element of the contract work. Qualifying work includes project management, public outreach, IT hardware or software programming, product installation, or provision of supplies and goods directly associated with the scope of work, such as construction, janitorial, or laboratory supplies.

The certification process requires documentation that the subcontractor will complete a distinct, delineated element of work; that the work is normal for the supplier's business function; that the supplier is committed to performing, managing, or supervising the work as indicated on the Bidder Declaration form (GSPD-05-105 or GSPD-05-106); and that the supplier retains responsibility for products, inventories, materials, and supplies, including negotiating prices, determining quality and quantity, ordering, installing if applicable, and making payment. Additionally, proposers must verify that any further subcontracting by the SB or DVBE supplier does not exceed normal industry practice. The certification ensures meaningful participation of small and disadvantaged veteran-owned businesses in state and local contracts consistent with Government Code Section 14837 and Military and Veterans Code Section 999.

Text version

Commercially Useful Function Certification Proposer must complete a separate certification for each certified SB and/or DVBE identified on the Bidder Declaration (GSPD-05-105) that will be performing a portion of the contract.

CUF statute (Government Code 14837 and Military and Veterans Code 999) requires that the contractor and subcontractor be responsible for the execution of a distinct element of the work. Examples include but are not limited to some aspect of project management, public outreach, IT hardware/software programming or product installation, or providing supplies/goods needed to carry out the contract work such as construction, janitorial or laboratory supplies. In any case, the services or goods need to be directly associated with the scope of work.
