Commercial Water-Based Charter Boat and Tour Operator Permit Program

This document comprises the procedures and guidelines for Sarasota County's Commercial Water-Based Charter Boat and Tour Operator Permit Pilot Program, established through Board adoption of Ordinance No. 2024-065 and approved for implementation on January 27, 2026. The program permits qualified businesses to provide recreational fishing trips, sightseeing tours, and dive trips from designated Sarasota County-owned or operated parks, beaches, and water access properties across two geographic zones: North County Zone (Nora Patterson Bay Island Park and Turtle Beach Park) and South County Zone (Indian Mound Park, Marina Park and Boat Ramp in Venice, and Nokomis Beach Public Boat Ramp). The program establishes a total of 60 permits across both zones, with North County limited to 30 permits and South County limited to 30 permits. Individual companies may hold a maximum of two permits per zone. The initial contract term is one year, with the County authorizing annual reviews of procedures and guidelines by the Parks, Recreation and Natural Resources Business Operations Division. Permit holders are required to maintain current employee lists, provide customer safety briefings, display appropriate identification and signage, log all participant numbers prior to vessel departure, maintain accident records for two years, and comply with all local, state, and federal regulations governing vessel operations and environmental stewardship.

Permits will be awarded by location within each zone based on highest bid, with specific allocation limits per park location as detailed in the appendices. Permit holders must maintain appropriate U.S. Coast Guard-approved safety equipment, obtain medallions for vessel identification, and conduct primary commercial operations only during designated park hours from their assigned park location. The program incorporates a progressive enforcement structure for violations, beginning with notification and correction requirements for curable violations, escalating to three-day and seven-day suspensions for repeated offenses within a permit program year, and potential permit termination for the fifth violation. Permit holders are prohibited from fish processing at park facilities, canvassing with promotional materials, monopolizing shared amenities, and conducting unauthorized commercial activities. The County reserves the right to conduct inspections with or without notice and to temporarily close facilities for emergency repairs, storm debris removal, or public safety assessments, particularly upon issuance of hurricane watches or severe weather warnings by the National Weather Service.

COMMERCIAL WATER-BASED CHARTER

BOAT AND TOUR OPERATOR PERMIT PILOT

PROGRAM PROCEDURES AND GUIDELINES

A. PURPOSE/OBJECTIVE:

To define the procedures and guidelines for the Commercial Water-based Charter Boat and Tour Operator Permit Program which permits businesses to provide recreational fishing trips, sightseeing tours, and dive trips from designated Sarasota County owned or operated park, beach or other property. The County desires these permitted services which enhance the Vision and Mission of Parks, Recreation and Natural Resources (PRNR).

MISSION: To provide clean, safe and inclusive parks with diverse opportunities for all.

VISION: A dynamic parks system that is essential to quality of life and enriches our community through participation, connection, and diverse recreational opportunities.

VALUES: Stewardship, Innovation, Respect, Teamwork, Quality of Life

Additionally, the County desires to accomplish the following program goals with the delivery of permitted services:

Manage and balance access for public and Commercial Water-based Charter Boat and Tour Operators alike.

Provide clear guidelines.

Protect, respect, and preserve our outstanding natural resources.

Support natural resource-based recreational opportunities through environmental stewardship.

Promote visitors’ reconnections with nature and eco-tour water-based experiences.

B. BACKGROUND:

Parks, Recreation and Natural Resources (PRNR) staff track unpermitted activity when received from citizens or when directly observed. There has been an increase in unpermitted businesses, including fishing charters and tours, that provide a variety of services for remuneration on or within County Parks and Beaches. Not only do staff observe unpermitted activity, but patrons and permitted vendors also bring it to staff’s attention. When staff encounter activities in violation of County Code and park rules, staff communicate, educate and seek voluntary compliance in the

Page | 2 management of unpermitted activity. If unpermitted activity continues to occur, then staff will take appropriate action to enforce the Sarasota County Code (Sec 90- 33).

In August 2022, Parks, Recreation and Natural Resources (PRNR) staff completed Board Assignment No. 22-015, which requested staff to research the development of a permit program for fishing charter and/or tour boats within the County water access parks that would legally allow this type of activity.

This was in response to an increase in unauthorized commercial watercraft using parks and amenities as the pick-up and drop-off location for guests of private charters. In the Board Assignment, staff reported several considerations and possible challenges associated with starting a permit program for fishing charter and/or tour boats within the County water access parks.

On October 24, 2023, at the Board of County Commissioners (Board) meeting, the Board requested that the County Administrator bring back to the Board guidance on the potential composition of a task force to investigate unauthorized commercial activity. On January 30, 2024, at the Board meeting, PRNR staff presented a draft proposal for the task force concerning commercial water-based charter boat and tour operators.

On January 30, 2024, the Board provided direction to bring back a resolution to establish a task force for Commercial Water-based Charter Boat and Tour Operators.

On February 21, 2024, the Board adopted Resolution No. 2024-026 establishing the Task Force for Commercial Water-based Charter Boat and Tour Operators.

On April 23, 2024, the Board appointed five individuals to serve on the Task Force for Commercial Water-based Charter Boat and Tour Operators with two individuals as Charter Tour Operator representatives, two individuals as Water Access/Marina Property Owners or Charter Boat Operators with a Lease of Land Abutting the Marine Park District and one individual as a Community Member At-Large Representative (multiple actions).

On September 11, 2024, the Board accepted the Task Force Report as presented with the exception to allow two permits, per company, per zone. The Board directed the County Administrator and County Attorney to bring back the new updated language in the Chapter 90 Ordinance.

On October 22, 2024, the Board adopted Ordinance No. 2024-065 amending Chapter 90, Article II. of the County Code, relating to managing unauthorized commercial activity, updating delegation of authority for approval of fees for use of County parks and making additional policy updates.

On June 3, 2025, the Board voted to delay the implementation of the Commercial Water-based Charter Boat and Tour Operators Permit Program for six months for a report from County staff at that time.

On January 27, 2026, the Board voted and approved the proposed Pilot Commercial Water-based Charter Boat and Tour Operators Permit Program and associated Scope of Services.

Sarasota County Code of Ordinances, Chapter 90 - PARKS, RECREATION AND PUBLIC LANDS: Sec. 90-33. - Prohibited conditions, activities or uses: (a)(12) “The sale of food or drink of any kind, the sale or rental of kites, athletic equipment, sports equipment, or any other items or the provision of services for remuneration. Provided, however, that the County

Page | 3 may issue a Permit, or enter into license agreements, leases or other agreements for the sale or rental of any of the above on such terms and conditions as the County shall deem proper and in the best interest of the citizens of the County.”
