About this file
This is a procedures and guidelines document for Sarasota County, Florida, establishing a Commercial Water-Based Charter Boat and Tour Operator Permit Pilot Program. The program permits qualified commercial operators to provide charter fishing and guided tour services from designated County parks. Permits are awarded by location within designated zones based on highest bid, with established limits on the total number of permits per location and zone, as well as per-company allocations. The initial contract term is three years, with the County using an Invitation for Bids process to select qualified operators. The document outlines the minimum qualifications, scope of specifications, and insurance requirements that prospective bidders must meet to participate in the program.
The permit program establishes pricing terms based on competitive bidding, with awards made to the highest qualified bidders within each zone and location. Applicants must demonstrate minimum qualifications and maintain specified insurance coverage to operate under the permit. The program serves as a pilot initiative to test the feasibility and management of commercial water-based activities within County parks while generating revenue through the competitive bidding process. Sarasota County has structured the program with defined geographic zones and location-based allocation caps to ensure equitable distribution of permit opportunities and prevent market concentration by individual operators.

COMMERCIAL WATER-BASED CHARTER BOAT AND TOUR OPERATOR PERMIT
PILOT PROGRAM PROCEDURES AND GUIDELINES
Rev. October 5, 2026 Page 1 of 7
A. PURPOSE/OBJECTIVE
The purpose of these Procedures and Guidelines is to establish the requirements for the Commercial Water-based Charter Boat and Tour Operator Permit Program which permits businesses to provide recreational fishing trips, sightseeing tours, and dive trips from designated Sarasota County-owned or operated parks, beaches or other properties. The Program supports the Mission, Vision, and Values of Parks, Recreation and Natural Resources (PRNR).
MISSION: To provide clean, safe and inclusive parks with diverse opportunities for all.
VISION: A dynamic parks system that is essential to quality of life and enriches our community through participation, connection, and diverse recreational opportunities.
VALUES: Stewardship, Innovation, Respect, Teamwork, Quality of Life
In support of the above, the Program is intended to:
Manage and balance access for the public and Commercial Water-based Charter Boat and Tour Operators.
Provide clear guidelines.
Protect, respect, and preserve our outstanding natural resources.
Support natural resource-based recreational opportunities through environmental stewardship.
Promote visitors’ reconnection with nature and eco-tour water-based experiences.
B. BACKGROUND
The Commercial Water-based Charter Boat and Tour Operator Permit Program was developed in response to unauthorized commercial charter and tour activity occurring at County water access parks. Following evaluation by County staff, a Board-appointed task force, and subsequent Board direction, the Pilot Program was approved by the Board of County Commissioners on January 27, 2026.
The program is administered pursuant to Sarasota County Code Section 90-33 and other applicable County requirements.

D. DEFINITIONS
Commercial Water-based Charter Boat and Tour Operator. Any properly permitted business that provides recreational charter fishing trips or excursion tours from a designated Sarasota County-owned or operated park, water access location, or other property and accepts compensation for such activity. The term “Commercial Water-based Charter Boat and Tour Operator” is further defined to include the United States Coast Guard (USCG) Operator of Uninspected Passenger Vessel (OUPV 6-pack) license, which allows up to six (6) paying passengers for hire. This definition explicitly excludes “bareboat charter” rentals, jet ski or personal watercraft rentals.
Commercial Activity. Directly or indirectly promoting or selling commercial services through giveaways, sales, rentals, or any other exchange of value.
Water-based. Activities conducted in or on the water that encompass both marine and inland waterway activities that rely on water for their appeal.
Charter Boat. A vessel rented to individuals or groups for recreational charter fishing that includes a captain and/or crew to navigate and operate the vessel.
Tour Operator. A business that provides a planned excursion or tour for a group of people as a type of charter.
Bareboat Charter. The U.S. Coast Guard (USCG) defines a bareboat charter (or demise charter) as a contractual agreement where the vessel owner completely surrenders possession, command, and navigation of the vessel to the charterer.
Permit Holder. Any properly permitted business or commercial water-based entity that has been awarded a formal operating permit to legally conduct commercial activities for compensation from designated park locations.
Company Vehicle. A vehicle, with or without a trailer affixed, used by a Permit Holder or its employees to transact business or support operations.
