About this file

This is a Commercial Item Determination Checklist used by offerors to assert that items or services qualify as "Commercial Items" under Federal Acquisition Regulation (FAR) Subpart 2.1. The checklist is a template designed to support commerciality claims through a structured question-and-answer format that requires offerors to provide supporting documentation.

The checklist addresses both supplies and services through six primary assessment areas. For supplies, it evaluates whether items are customarily used by the general public or non-government entities, have been sold or offered in commercial markets, represent evolved commercial items with anticipated commercial availability, or involve minor modifications to commercial items. For services, the checklist distinguishes between services supporting commercial items—which must be provided by the company to the general public under similar terms and conditions—and standalone commercial services, which must be offered and sold competitively in substantial quantities based on established catalog or market prices. For services claimed under catalog pricing, offerors must provide copies of catalogs, price lists, or published information showing current or recent sales to the general public. For market-priced services, offerors must document the source, date, and basis of market pricing through independent sources or demonstrated competition. The checklist concludes with a certification statement in which the offeror attests that the items or services meet the current FAR definition of commercial items. This template applies to the H-1 Tool Groupings solicitation (N6833526Q0431) issued by Naval Air Warfare Center – Aircraft Division, Lakehurst, which is procuring tools on a firm-fixed-price basis under FAR Parts 12 and 13 procedures.
