12.0 EVALUATION & BASIS FOR AWARD

This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.

When evaluating non-price factors, the Government may consider the Contracting Officer or Contract Specialist’s knowledge of and previous experience with the services being acquired, information obtained from relevant Government databases such as the Federal Procurement Database System (FPDS) or the Contractor Performance Assessment Reporting System (CPARS), or any information obtained on a reasonable basis in accordance with FAR 13.106-2. However, the Government is not responsible for

National Cancer Institute 75N91022Q00127 Page 18 of 24 locating or securing any information which the Quoter does not include or identify in their quotation.

12.1 COMPARATIVE EVALUATION

The Government may conduct comparative evaluations of offers in accordance with FAR 13.106-2(b)(3).

The Government may perform a comparative evaluation (comparing offers to each other) to select the contractor that is best suited and provides the best value, considering the evaluation factors in this solicitation.

12.2 AWARD ON INITIAL RESPONSES

The Government anticipates selecting the best-value Contractor from initial responses, without engaging in exchanges with offerors. Contractors are strongly encouraged to submit their best technical solutions and price in response to this RFQ. The Government will not be conducting “discussions” as defined in FAR Part 15.

12.3 EXCHANGES WITH BEST-SUITED CONTRACTOR

Once the Government determines the Quoter that is the best-suited (i.e., the apparent successful contractor), the Government reserves the right to communicate only with that contractor to address any remaining issues, if necessary, and finalize the purchase order with the contractor. These issues may include technical performance or price.

If the parties cannot successfully address any remaining issues, as determined pertinent at the sole discretion of the Government, the Government reserves the right to communicate with the next best-suited contractor based on the original analysis and address any remaining issues. The Government may also communicate with a small number of Quoters or invite Quoters to submit quote revisions.

12.4 FAR 52.212-2 EVALUATION – COMMERCIAL PRODUCTS AND COMMERCIAL

SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

i) Technical Capability

ii) Prior Experience

iii) Past Performance

iv) Price

Non-price factors, when combined, are more important compared to price.

(b) Options. The Government will evaluate quotations for award purposes by adding the total price for all options to the total price for the basic requirement. To account for the option period(s) possible under 52.217-8 (maximum of six months), Option to Extend Services, the Government will evaluate the option to extend services (FAR Clause 52.217-8) by adding 6 months of the Quoter’s final option period price to the Quoter’s total price. This amount will be the total evaluated price. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

National Cancer Institute 75N91022Q00127 Page 19 of 24

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
