Combined Synopsis/Solicitation
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.
The Request for Quotation (RFQ) number FA481423TF062 shall be used to reference any written quote provided under this RFQ.
The RFQ document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2023-02; Effective 16 March 2023.
This is a set-aside for 100% Small Business.
The North American Industry Classification System (NAICS) code for this project is 238220 with a size standard of $19M.
The purpose of this combined synopsis solicitation is for the purchase, delivery and installation of a Heating, Ventilation and Air Conditioning (HVAC) system. The bid schedule and contract CLIN structure are below:

A site visit will be held at 9:30 A.M. EST, on 14 June 2023. Contractors will meet at 6 FSS/FSVL Supply Warehouse, building 4000, located 7060 West Boundary Street Tampa, FL.
33621. Contractors shall be allowed one official site visit to view the site in order to better understand the requirement. Any questions arising at the site visit shall be submitted to the Contracting Officer in writing by the date and time specified below (please use the Q&A spread sheet provided (Attachment 5)). Contractors interested in attending the site visit shall provide the following for base access: Full Name, DOB, Driver’s License state and number no later than 08 June 2023, 12:00 A.M. EST. Offerors are urged to inspect the site where the requirement is to be performed. In no event shall failure to inspect the site constitute grounds for a claim after contract award.
All questions regarding this RFQ must be email to lovelyne.pascal@us.af.mil by 20 June 2023 at 10:00 A.M. EST. Please use the Q&A spread sheet provided (Attachment 5).
All companies must be registered in the System for Award Management at https://www.sam.gov/portal/public/SAM/ to be considered for award. The Government will not provide contract financing for this acquisition. Invoice instruction shall be provided at time of award.
FAR Provision *52.212-2, Evaluation -- Commercial Items (Nov 2021), applies to this acquisition and the following evaluation is applicable:
(a) The Government will award a contract resulting from this RFQ to the responsible vendor whose quote conforming to the RFQ will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:
(i) Price
(ii) Technical capability of the item offered to meet the Government requirement.
(b) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful vendor within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

BASIS FOR AWARD:
(1) Technical: quote must be rated as technically acceptable to be eligible for award. In order to be deemed technically acceptable, the following evaluation criteria must be met in the Statement of Work (SOW) dated 18 April 2023.
(2) Price: Award will be made to the lowest priced technically acceptable vendor.
First, the government will rank all responsive offers by price. Then the Government will evaluate lowest priced Offeror for technical acceptability. The Government shall evaluate the offer on an acceptable/unacceptable basis IAW Table A-1 (as provided below). Should the lowest priced Offeror be rated “Technically Unacceptable”, evaluation of the next lowest priced Offeror will continue, until technical acceptability can be determined, at that point evaluations will cease without consideration of any other offers.

Discussions: The government intends to award a purchase order without discussions with respective vendors/quoters. The government however, reserves the right to conduct discussions if deemed in its best interest.
Include descriptive literature such as illustrations and drawings.
FAR Provision *52.212-3, Offeror Representations and Certifications -- Commercial Items (Dec 2022), with its Alternate I (Oct 14), applies to this acquisition. All vendors must be registered in System for Award Management at https://www.sam.gov/portal/public/SAM/ at the time of Quote submittal.
FAR clause at 52.212-4, Contract Terms and Conditions -- Commercial Items (Dec 2022), applies to this acquisition with the following Addendum: Paragraph (c) of this clause is tailored as follows: Changes in the terms and conditions of this contract may be made only by written agreement of the parties with the exception of administrative changes, such as changes in the paying office, appropriations data, etc., which may be changed unilaterally by the Government.
Note: The vendor acknowledges that should the quote terms and conditions and/or agreement conflict with mandatory provisions of the Federal Acquisition Regulation (FAR) and other Federal law applicable to commercial acquisitions, to the extent of such conflict the FAR and Federal law govern and conflicting vendor terms and conditions and/or agreement are unenforceable and are not considered incorporated into any resultant contract.

AFFARS Clauses:
5352.201-9101 Ombudsman
As prescribed in 5301.9103, insert the following clause:
OMBUDSMAN (OCT 2019)
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution.
Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
(c) If resolution cannot be made by the contracting officer, the interested party may contact the ombudsmen, Mrs. Susan Madison, AFICC OL AMC, 510 POW/MIA, Scott AFB, IL 62225- 5022, 618-229-0267, fax 618-256-5724, email: susan.madison@us.af.mil. (d) The ombudsman has no authority to render a decision that binds the agency.
(e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the contracting officer.

5352.223-9001 Health and Safety on Government Installations
As prescribed in AFFARS 5323.9001, insert the following clause in solicitations and contracts:
HEALTH AND SAFETY ON GOVERNMENT INSTALLATIONS (OCT 2019)
(a) In performing work under this contract on a Government installation, the contractor shall:

(1) Take all reasonable steps and precautions to prevent accidents and preserve the health and safety of contractor and Government personnel performing or in any way coming in contact with the performance of this contract; and
(2) Take such additional immediate precautions as the contracting officer may reasonably require for health and safety purposes.
(b) The contracting officer may, by written order, direct Air Force Occupational Safety and Health (AFOSH) Standards and/or health/safety standards as may be required in the performance of this contract and any adjustments resulting from such direction will be in accordance with the Changes clause of this contract.
(c) Any violation of these health and safety rules and requirements, unless promptly corrected as directed by the contracting officer, shall be grounds for termination of this contract in accordance with the Default clause of this contract.
