SECTION III – RFO 52.212-2 ADDENDUM

Evaluation—Commercial Products and Commercial Services

The Government will award a single Indefinite Delivery, Indefinite Quantity (IDIQ) contract to the responsible offeror whose proposal conforms to the solicitation and is determined to be the most advantageous to the Government. The Government will use a phased evaluation process.

To be considered for award, an offeror must first be rated "Acceptable" under the Technical Capability factor. For all technically acceptable offerors, the award decision will be based on evaluation of Past Performance and Price.

(a) Evaluation Process

Phase 1: Technical Capability Evaluation (Acceptable / Unacceptable)

The Government will first evaluate Factor 1, Technical Capability, on a simple "Acceptable" or "Unacceptable" basis. An offeror must receive a rating of "Acceptable" to proceed to Phase 2.

• Evaluation Standard: The offeror’s technical proposal, based on the submitted "Technical Questionnaire," must meet all minimum requirements of the Performance Work Statement (PWS).

• Acceptable: The proposal meets the minimum requirements of the solicitation.

• Unacceptable: The proposal fails to meet one or more minimum requirements and is therefore unawardable.

Phase 2: Past Performance and Price Evaluation

For all offerors rated "Acceptable" in Phase 1, the Government will then evaluate Past Performance and Price. Past Performance and Price are approximately equal in importance.

• Factor 2 - Past Performance: The Government will conduct a performance risk assessment based on the offeror's past performance. Offerors shall identify no more than three (3) recent and relevant projects completed within the last five (5) years. A relevant project is defined as one that is similar in size, scope, and complexity to the requirements described in the attached PWS, specifically involving tree trimming, removal, and related services for government or commercial clients. The Government will evaluate the quality and relevance of an offeror's past performance to assess the risk associated with their likelihood of success. This evaluation will be based on information gathered from the Past Performance Information Retrieval System (PPIRS/CPARS) and other sources, including any references provided.

The Government’s assessment will result in a single Performance Confidence rating as defined below. More relevant past performance will be a key consideration in this assessment.

Performance Confidence Description Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

Neutral Confidence No recent/relevant performance record is available. This rating is neutral and will not be evaluated favorably or unfavorably.

• Factor 3 - Price: The Government will evaluate the offeror’s proposed pricing for fairness and reasonableness. The total evaluated price will be calculated by summing the proposed prices for all sub-CLINs across all ordering periods.

(b) Award Decision Logic. The award will be made to the technically acceptable offeror that provides the best value to the Government. Past Performance is approximately equal to Price.

(c) Notice of Award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)
