viii. FAR 52.212-2, Evaluation Criteria – Commercial Items (Oct 2014).

a. The Government will award a firm fixed-priced contract, on a competitive basis, resulting from this solicitation to the responsible offeror whose quote conforms to the solicitation and will be the most advantageous to the Government, price and other factors considered. The Government will award to the lowest priced offeror that is determined to be technically acceptable. The following factors shall be used to evaluate offers:

b. Factor 1 - Technical Acceptability:

i. Technical Acceptability will be based on the contractor providing all the required licenses listed in Attachment 1. Quotes that receive an unacceptable rating will not be considered for award.

ii. Quotes that do not meet all stated requirements of the solicitation may be considered non-responsive and may not be considered for award.

The factor will be rated as Acceptable or Unacceptable.

• Acceptable is defined as the quote provides all licenses in attachment 1.

• Unacceptable is defined as the quote does provide all licenses in attachment 1.

c. Factor 2 - Price:

i. The quoted price for all licenses, including all new products and product renewals will be evaluated in order to determine if the total price is reasonable in accordance with FAR 13.106-3(a). Pricing for technically unacceptable quotes will not be evaluated.

d. Award Process.

i. First, the Government will rank the proposals from lowest price to highest price.

The total price will be calculated as the sum of the contractor’s prices submitted for all licenses, including all new products and product renewals Next, the Government will evaluate the quotes on an acceptable or unacceptable basis, starting with the quote with the lowest price. Any subfactor evaluated as “Unacceptable” will render the entire quote unacceptable and, therefore not awardable. If the quote with the lowest price is determined technically acceptable, the Government will evaluate the contractor’s price, to include all options, for price reasonableness, as described above. If the lowest priced quote is technically acceptable and the price is reasonable, this contractor’s quote represents the best value to the Government and award will be made to that contractor. The evaluation will stop without any consideration to other quotes; however, if the lowest priced quote is not technically acceptable, the Government will evaluate the next lowest priced quote for technical acceptability, followed by an analysis of their price to verify reasonableness. The evaluation process will continue until reaching a technically acceptable quote with a price that is reasonable, or until all quotes are evaluated.

ix. Offerors shall include a completed copy of the provision at FAR 52.212-3 (Oct 2018), Offeror Representations and Certifications -- Commercial Items, with their offer.

x. Clause 52.212-4, Contract Terms and Conditions -- Commercial Items (Oct 2018), applies to this acquisition.

xi. Clause 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders (Oct 2018) -- Commercial Items, applies to this acquisition (See Attachment 3).
