Combined Synopsis/Solicitation Vinyl Records Request for Quote (RFQ)
Contract Specialist: Erica Little Procurement Contracting Officer (PCO): Christopher Finik
1. This is a combined Synopsis/Solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.

All instructions, templates, and formats contained herein shall explicitly be adhered to;
otherwise, a quote is determined to be incomplete and shall not be considered for award.
If you are the apparent awardee, the Government will notify you immediately by sending a copy of the contract for your signature. The signed contract shall be returned to the Government within 24 hours once it is received, and will then be distributed once the contract is awarded. If you do not meet the required deadline, the Government reserves the right to award to the next technically acceptable offeror.

5. A notice regarding any set-aside: The proposed acquisition is set aside as a 100% small businesses set-aside. All Small Businesses are encouraged to participate by submitting quotes.

9. Contract Line Item Number(s) (CLINs) and items, quantities and units of measure, (including option(s), if applicable): Bid shall not exceed two decimal places.
10. Description of requirements for the items to be acquired:
The required contract must include: mastering, lacquer cutting, and duplication for two thousand (2,000) twelve-inch (12”) double vinyl LPs with sleeves, color labels, color jackets; packaged and shrink-wrapped for delivery. Specifically, each twelve-inch (12”) lacquer master for this double vinyl album (four sides in total at no less than eighteen minutes per side) will be mastered from audio files from the United States Air Force Band. Each twelve-inch (12”) double vinyl album will be labeled with full-color labels; packaged in a protective sleeve with full color insert; and packaged in a full color jacket that may be gate-fold or wide-spine in format. Delivery of the described items outlined above will take place no later than ten months after the vendor has taken receipt of all required materials

Addendum to FAR 52.212-1, Instructions to Offerors
The following is to be added to FAR 52.212-1 paragraph (b):
1. The quote in its entirety shall not exceed twenty (20) pages, double sided.
2. Please provide the following documentation in your technical quote:

NOTE: The aforementioned documentation are considered technical factors and are required for a quote to be considered technically acceptable for contract award.
3. All questions are due on or before 5:00 PM EST, 8/12/2022, answers will be posted to beta.SAM.gov not later than 8/17/2022.
4. Offers shall be emailed to Contract Specialist Erica Little via e-mail at erica.little@us.af.mil and Contracting Officer Christopher Finik via e-mail at christopher.finik@us.af.mil. Please DO NOT post offers to beta.SAM.gov. Failure to respond to both may result in being technically unacceptable.
5. Please request read receipt on all submitted quotes.
6. Offers are due on or before 5:00 PM EST, 8/19/2022. Offers shall be valid for a period no less than 30 days.
18. The Following Provisions Are Incorporated By Full Text:
FAR 52.212-2 Evaluation – Commercial Items (Nov 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate offers:
(i) Technical
(ii) Price
Award will be made on the basis of the Lowest Evaluated Price of Technically Acceptable quotes in accordance with FAR 13.106-2.
Factor 1 – Technical Factor: Contractor’s proposal shall demonstrate an understanding of the Government’s requirements by including the following:
1. The Contractor submits a price quote in accordance with the instructions in section 17 of the Addendum to FAR 52.212-1 identified above.
2. The Contractor shall submit their technical approach for the completion of this effort and statement acknowledging they have the technical capabilities to perform the requirements as stated in the (Statement of Work (SOW).
3. The Contractor will have and provided a current SAM registration with a Small Business certification under this solicitation NAICS code.
4. The Contractor shall provide a completed copy of FAR 52.212-3, with Alternative I - Offeror Representations and Certifications-Commercial Items.
5. The Contractor shall complete and provide representation IAW FAR 52.204-24, and provide additional disclosures, if applicable. See pages 5 through 8 of this document for full provision.
6. The Contractor shall complete and provide representation IAW FAR 52.204-26, and provide additional disclosures, if applicable. See pages 5 through 8 of this document for full provision.
7. The Contractor shall complete and provide representation IAW DFARS 252.204-7017 and provide additional disclosures, if applicable. See pages 9 through 10 of this document for full provision.
Contractors will be evaluated as acceptable or unacceptable according to the following definitions:
Acceptable: The proposal clearly meets the minimum requirements of the solicitation.
Unacceptable: The proposal does not meet the minimum requirements of the solicitation.
To receive a Technically Acceptable rating for Factor 1, ALL required documentation must be evaluated as technically acceptable.
Factor 2 – Price: ONLY bids that are evaluated as Technically Acceptable will be evaluated for Price. The price evaluated for this factor will be the sum of CLIN 0001. Price will be evaluated for reasonableness in accordance with FAR 13.106-2.
Award will be made on the basis of the Lowest Evaluated Price of Technically Acceptable quotes in accordance with FAR 13.106-2 to the Contractor who is determined to be responsible in accordance with FAR 9.103.
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

FAR 52.252-1 -- Solicitation Provisions Incorporated by Reference (FEB 1998)
This solicitation incorporates one or more solicitation provisions by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. The offeror is cautioned that the listed provisions may include blocks that must be completed by the offeror and submitted with its quotation or offer. In lieu of submitting the full text of those provisions, the offeror may identify the provision by paragraph identifier and provide the appropriate information with its quotation or offer. FAR 52.204-24 -- Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (Nov 2021)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products or Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision—
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.
Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.
Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) ( https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".
(d) Representation. The Offeror represents that—
(1) It [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and

(e) Disclosures.
(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment—
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number;
and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services—
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment—

52.204-26 Covered Telecommunications Equipment or Services-Representation (Oct 2020)
(a) Definitions. As used in this provision, "covered telecommunications equipment or services" and "reasonable inquiry" have the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".
(c)
(1) Representation. The Offeror represents that it □ does, □ does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument.

The Offeror is not required to complete the representation in this provision if the Offeror has represented in the provision at 252.204-7016 , Covered Defense Telecommunications Equipment or Services—Representation, that it “does not provide covered defense telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument.”
(a) Definitions. “Covered defense telecommunications equipment or services,” “covered mission,” “critical technology,” and “substantial or essential component,” as used in this provision, have the meanings given in the 252.204-7018 clause, Prohibition on the Acquisition of Covered Defense Telecommunications Equipment or Services, of this solicitation.
(b) Prohibition. Section 1656 of the National Defense Authorization Act for Fiscal Year 2018 (Pub. L. 115-91) prohibits agencies from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service to carry out covered missions that uses covered defense telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) at https://www.sam.gov for entities that are excluded when providing any equipment, system, or service to carry out covered missions that uses covered defense telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless a waiver is granted.
Representation. If in its annual representations and certifications in SAM the Offeror has represented in paragraph (c) of the provision at 252.204-7016 , Covered Defense Telecommunications Equipment or Services—Representation, that it “does” provide covered defense telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument, then the Offeror shall complete the following additional representation:
The Offeror represents that it [ ] will [ ] will not provide covered defense telecommunications equipment or services as a part of its offered products or services to DoD in the performance of any award resulting from this solicitation.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
