SECTION 5 – EVALUATION CRITERIA AND BASIS FOR AWARD
Basis for Award: Award will be made to the quoter whose quotation represents the best value to the Government.
Cos have broad discretion to establish evaluation procedures per RFO 12.203. The selection will be based on the vendor’s responsibility, responsiveness, and ability to provide the best value. Best value is defined as the lowest-priced quotation that meets the criteria for past performance, and responsibility. The government reserves the right to engage in interchanges with all, some, or none of the vendors. Furthermore, if no quotations align with the specified criteria, the Contracting Officer (CO) reserves the right to cancel the solicitation instead of conducting interchanges. In such cases, the government is under no obligation to issue a new solicitation. An evaluation plan, scored quotations, or competitive range are NOT required under simplified procedures (RFO 12.201-1).
The evaluation process will commence with an assessment of the lowest-priced quotation, following a determination of responsiveness and responsibility. Once responsiveness is confirmed, the lowest-priced proposal will undergo a technical evaluation in accordance with Section 7 of this solicitation. Any negative findings during this evaluation may result in the quoter being deemed non-responsible, rendering them ineligible for award consideration. Commonly utilized United States Government systems will be employed throughout this process:
1. System for Award Management (SAM).
2. Federal Awardee Performance and Integrity Information System (FAPIIS)
3. Excluded Parties List System (EPLS). Award will be made to the lowest priced, technically acceptable quote which is deemed responsible.
4. Procurement Integrated Enterprise Environment/Electronic Data Access (PIEE/EDA); and/or
5. The Contractor Performance Assessment Reporting System (CPARS) at https://www.cpars.gov
If the quoter is determined to be responsible and technically acceptable, their past performance will be evaluated based on its recency and relevance. Should the lowest-priced quoter meet the responsibility criteria and have acceptable past performance, the award will be granted to that vendor. However, if the lowest-priced quoter is https://www.cpars.gov/ deemed irresponsible or there are past performance issues, the evaluation will proceed to the next lowest-priced proposal. This process will continue until a vendor is identified who offers the lowest price, meets the responsibility criteria, and demonstrates satisfactory past performance.
The Government reserves the right to evaluate price realism if needed.
Award Type: ☐ Lowest Price Technically Acceptable (LPTA) ☒ Best Value Tradeoff ☐ Lowest Priced Technically Acceptable w/ Technical Capability Comparison
Evaluation Factors: ☐ Price Only ☐ Price + Technical ☐Price + Technical + Past Performance ☒ Other: Price and past performance
Technical Factors: N/A
Past Performance: ☒ Evaluated ☐ Not Evaluated
Price/Cost Evaluation: ☐ Lowest price among technically acceptable ☒ Price reasonableness (RFO 13.106-3)
Late Quotations: Per RFO 12.203I and RFO 52.212-1I, the Contracting Officer will exercise good business judgment in deciding whether to accept quotations received after the due date. A late modification to an otherwise successful quotation that makes terms more favorable to the Government will be considered at any time received.
Ombudsman: An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.
Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
If resolution cannot be made by the contracting officer, the interested party may contact the ombudsman, Mr. Alex Hight
