Military Sealift Command Combined Synopsis and Solicitation Notice Information
1. This is a combined synopsis/solicitation for commercial products and commercial services prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued.
2. Solicitation number is N3220524Q2090 and is being issued as a Request for Quotes (RFQ). This solicitation does not have a Defense Priorities and Allocation System (DPAS) rating.
3. The solicitation document and incorporated provisions and clauses are those in effect through:

3.2 Item Description/Manufacturer’s Data:
3.2.1 Material/Components, including specific quantities and manufacturer make and model numbers, necessary to accomplish work required by this work item are included in the Bill of Material Lists of references 2.1.1 through 2.1.3.
3.3 Quantity:
3.3.1 Quantities specified in the Bill of Material Lists of references 2.1.1 through 2.1.3 are considered estimates. The Contractor shall provide the exact quantities and additional material such as miscellaneous cable hangars, banding material, paint, lugs, insulation, hardware, weld material, stuffing tubes, cable tags, etc. which are not included in the Bill of Material Lists of References 2.1.1 through 2.1.3 in order to install a fully functional system which meets the requirements of this specification.

5.0 NOTES:
5.1 The ship’s force will provide access to any required spaces.
5.2 The contractor shall coordinate all electrical lockouts/tag outs with the Chief Engineer and Principal Port Engineer.
5.3 The contractor and all subcontractors, regardless of tier must consult the General Technical Requirements (GTR), Reference 2.1.4, to determine applicability to this work item. In performance of this item, the contractor and all subcontractors regardless of tier must comply with the requirements of all applicable GTRs including but not limited to GTRs 1 through 7, 22, 23, 24, 25, 27, 28, and 29.
5.4 The contractor and all subcontractors regardless of tier are advised to review other work items under this contract to determine their effect on the work required under this work item.
5.5 Welding shall be in accordance with ABS requirements. The weld size shall be in accordance with ABS Steel Vessel Rules, Part 3, Chapter 2, Section 19.
5.6 Prior to initiating any work on the electrical system, de-energize and tag-out all sources of electrical power to the circuits involved in accordance with standard electrical safety practices (Reference 2.1.12). Restore electrical power upon the completion of all aspects of this work item.
5.7 All electrical work shall be performed in accordance with ABS, USCG, and IEEE-45, MIL-STD-1310(G) requirements.
5.8 If additional wire way or cable penetration material is required, the installation activity shall provide miscellaneous material to suit.
5.9 New cable and/or mounting of equipment that requires welding or hot work performed in the service areas (from the interior or exterior) shall maintain the fire tightness to the satisfaction of the ABS surveyor and the MSCREP.
5.10 All cable/wire shall be routed through proper wire ways or wire supports and utilize metal banding with rubber channel.
5.11 All electrical installations and modifications on weather decks shall penetrate boxes on the bottom (from underneath) and utilize a drip loop to discourage water intrusion.
5.12 Wire-ways and wire routes on a deck and not adjacent to a bulkhead are prohibited.
5.13 Wire-ways and wire routes that impede traffic, require detours, or otherwise pose a tripping hazard to personnel are prohibited.
5.14 To the greatest extent possible, wire and cable shall be run internal to the ship.
5.15 All disturbed MCTs, transits, penetrations, etc. shall be resealed with the existing product. If the existing product is not available, unknown, or not identifiable, the entire transit shall be repacked with an ABS approved system. Mixing products or multiple products in a single penetration, MCT, or transit is prohibited.
5.16 All findings shall be reported to the MSCREP via Condition Report(s).
5.17 Remove, replace, and relocate any interference necessary to accomplish each item in the work package.
6.0 QUALITY ASSURANCE REQUIREMENTS:

6.1 Welder, whether contractor or subcontractor provided, shall hold qualification documentation from American Bureau of Shipping (ABS), and United States Coast Guard (USCG) for the material to be welded. Welding procedures shall be approved by the ABS Surveyor for the particular applications.
6.2 All inspections and tests shall be performed in the presence of the MSCREP, ABS surveyor, where deemed necessary by the ABS Surveyor.
6.3 Inspection and acceptance of work shall be by the MSC representative (MSCREP) and ABS Surveyor.
6.4 The following Milestones shall be in accordance with the QASP:
6.4.1 Conduct Kickoff Meeting /submit minutes- After Award
6.4.2 Conduct SW Build Status Meeting on Engineering Build Start/ submit minutes unscheduled, as required.
6.4.3 Conduct SW build Status on Final Build / Submit Minutes unscheduled, as required.
6.4.4 MSC Approval of Final Software Version and Regression Test Procedures unscheduled, as required.
6.4.5 Submit Final Software version Description and Regression Testing Procedures unscheduled, as required.
6.4.6 Build Install, Regression Testing and I V&V support/ Submit report unscheduled, as required.
7 STATEMENT OF WORK REQUIRED
7.1 Electrical: Task the ship’s control system OEM or qualified activity to reconfigure the communication protocol and programming in the Ships Machinery Control System (MCS) to allow serial communication with the four new UPSs for remote monitoring. The existing MCS monitoring for the existing UPSs will be matched/mirrored to provide the same monitoring and mimic displays for the new UPSs. L3Harris is proposing software updates to the TAOE Machinery Control System software. The SW updates will be baselined into a new build, Build 28. The updates consist of 24 distinct software changes
7.2 CDRLs: Regression Test Procedures; Regression Test Report; Meeting Minutes; Software Version Description
7.3 SW BLD R28 Includes: 18 patches made to the software during the last build installation (Build 27) in early 2024 and in various visits to the ship since the last Build installation Six (6) software changes associated with interfacing the software to new UPS units on the ship: removal of old signals, addition of new signals, HMI page updates, monitoring UPS battery breaker status, update of PLC projects to account for the new signals, and updating of the Modbus serial interface to account for the new signals. Preparation of Drawing: Maintain red-lined mark ups of approved working drawings, to reflect all installations, modifications, and any changes accomplished. Red- lined drawings shall be used for creating the final “As-Built” drawings.
7.4 Provide final “As-Built” drawings to reflect the actual final installation configurations for all efforts accomplished in accordance with this work item.

7. The required delivery is FOB Destination and acceptance date is 30 January 2025.
8. The provision at FAR 52.212-1, Instructions to Offerors – Commercial applies to this acquisition and is incorporated by reference. The provision is amended as follows:
52.212-1 (ADDENDUM) INSTRUCTIONS TO OFFERORS--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES
a. Any inconsistency between FAR Provision 52.212-1 and the Addendum to FAR 52.212-1 shall be solved by giving precedence to the Addendum to FAR 52.212-1.
b. After receipt of quotes the Government may, with or without notice, negotiate with and, if desired, seek quote revisions from as many or as few quoters as it, in its discretion, deems appropriate.
c. The term “offeror” or “offer” as used in FAR 52.212-1 shall be understood to mean “quoter” and “quote,” respectively. Further, the term “award” shall be understood to describe the Government’s issuance of an order.
d. The Government will consider all quotes that are timely received and may consider late quotes in accordance with 52.212-1. Failure of a quote to address any items listed in the attached submission package may make a quote unacceptable.
e. Paragraph (b) of FAR Provision 52.212-1, Submission of Offers, is amended as follows:

a. For a Services buy, the quote shall contain all pre-award submission/certification requirements as defined in the statement of work (SOW).

7. Responses to the solicitation are due 10:00AM 25 September 2024. Quotes may be e-mailed to Shawnda Forbes, shawnda.m.forbes.civ@us.navy.mil. To be considered timely, an e-mail quote must be received in its entirety in the designated e-mail inbox by the due date and time for quote submission. Reference the solicitation number on your quote. E-mail quotes shall be in either Adobe or Microsoft Office format. No other method of submission is acceptable.
8. DOD Class Deviation 2023-O0001. A small business joint venture offeror must submit, with its offer, the representation required in paragraph (c) of FAR solicitation provision 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services, and paragraph (c) of FAR solicitation provision 52.219-1, Small Business Program Representations, in accordance with 52.204-8(d) and 52.212-3(b) for the following categories:
(A) Small business;
(B) Service-disabled veteran-owned small business;
(C) Women-owned small business (WOSB) under the WOSB Program;
(D) Economically disadvantaged women-owned small business under the WOSB Program; or
(E) Historically underutilized business zone small business.

9. Provision 52.212-2 Evaluation—Commercial Products and Commercial Services applies to this acquisition.
(a) The Government may issue a purchase order resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Quotes submitted in response to this solicitation shall not contain nor be subject to the vendor’s standard commercial terms and conditions. Any quote submitted in response to this solicitation, which includes the vendor's standard commercial terms and conditions may be considered a material defect and may be rejected as being non-responsive to the solicitation. The following factors shall be used to evaluate quote:
(i) technical capability of the item quoted to meet the Government requirement;
(ii) price;
Award shall be made to the lowest priced technically acceptable quoter.
To be considered a technically acceptable solution for a parts procurement, the quoted parts shall meet the solicitation requirements including required parts, delivery dates, and terms and conditions stated in the solicitation. To be considered a technically acceptable solution for a service, the quoted service shall meet the solicitation requirements including terms and conditions stated in the solicitation. The quote shall state that all aspects of the technical requirement, including required delivery date and part numbers, can be met.
The Government will evaluate quoted pricing for reasonableness utilizing techniques described in FAR 13.106-3.
(c) To consummate a binding contract between the parties, the successful quoter shall accept the purchase order in writing (see FAR 2.101).

(d) Comptroller General Examination of Record. (a) Definitions. As used in this provision— Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. (1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment—
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services—

(a) Definitions. As used in this provision— “Administrative proceeding” means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. (4)Any estate (other than a foreign estate, within the meaning of 26 U.S.C. 701(a)(31)); and (5)Any trust if– (i)A court within the United States is able to exercise primary supervision over the administration of the trust; and (ii)One or more United States persons have the authority to control all substantial decisions of the trust.
(b)Unless exempted, there is a 2 percent tax of the amount of a specified Federal procurement payment on any foreign person receiving such payment. See 26 U.S.C. 5000C and its implementing regulations at 26 CFR 1.5000C-1 through 1.5000C-7.
(c)Exemptions from withholding under this provision are described at 26 CFR 1.5000C-1(d)(5) through (7). The Offeror would claim an exemption from the withholding by using the Department of the Treasury Internal Revenue Service Form W-14, Certificate of Foreign Contracting Party Receiving Federal Procurement Payments, available via the internet at www.irs.gov/w14. Any exemption claimed and self-certified on the IRS Form W-14 is subject to audit by the IRS. Any disputes regarding the imposition and collection of the 26 U.S.C. 5000C tax are adjudicated by the IRS as the 26 U.S.C. 5000C tax is a tax matter, not a contract issue.
