The solicitation will consist of two volumes:
Phase 1:
Volume I, Factor I – Technical Certifications Volume I, Factor II – Delivery Date Required.
Phase 2:
Volume II, Factor III – Price
Factor I – Technical Certifications
1) In order to minimize the risk of the government purchasing counterfeit products or unauthorized secondary market equipment, which would not be supported by the Original Equipment Manufacturer (OEM), and to ensure that the Government purchases only equipment that is genuine (i.e., not counterfeit or gray market), authorized (e.g., including appropriate licenses), and supported (e.g., warranty and support services) by the OEM, the vendor is required to submit an OEM authorized reseller certification with the vendors Request for Quote (RFQ) response.
The authorized reseller certification certifies that it is a Manufacturer Authorized Partner as of the date of the submission of their quote, and that it has the certification/specialization level required by the Manufacturer to support both the product sale and product pricing, in accordance with the applicable Manufacturer certification/specialization requirements.
2) Vendor shall warrant that the products are new, in original packaging. By submitting a response to the RFQ, the Vendor confirms to have sourced all Manufacturer products submitted in this quote from Manufacturer or through Manufacturer Authorized Partners only, in accordance with Manufacturer's applicable policies in effect at the time of purchase.
Factor II – Delivery Date Required.

The price Quote shall include all elements of price and such other price information considered appropriate to support the vendor’s Quote. The pricing information shall be completed in accordance with the following:
No partial bids or additional items will be accepted. Failure to quote all part numbers or add additional items will result in ineligibility for award. In order to assist in the contracting officer’s price analysis, additional price information may be required and may consist of copies of applicable published price lists with effective dates, catalog pages of products, evidence of discounts off the published price lists, historical price/sales information supported by copies of paid invoices OR price breakdown of all cost elements. The price submission is not page limited, but is strictly limited to price information.
52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
The selection of a quoter for award will be conducted in two phases. Phase I will consist of the evaluation of Factor I – OEM authorized reseller certification and Factor II Delivery Date Required. Quoters receiving a rating of “Acceptable” in Phase I shall move on to Phase II. Phase I will consist of Factor III – Price.
The selection of a quoter for award will be conducted by ranking quotes which moved on to Phase II according to price, inclusive of all option pricing. A quoter’s proposed prices will be determined by adding all extended amounts for the CLINS. If the lowest priced quote is evaluated, that quote represents the best value for the Government and the evaluation process stops at this point. Award shall be made to that quoter without further consideration of any other quotes.
Volume I: Non-Price Quote
Phase I
Factor I – Technical Certifications
Factor I will be evaluated on an Acceptable/Unacceptable basis on its submission of the proof of possessing its OEM authorized reseller certification. This will be evaluated during Phase I on an Acceptable/Unacceptable basis in accordance with the Technical Acceptable/Unacceptable ratings Table 1 below. Quoter shall submit 1 copy of the required certifications.
Factor II – Delivery Date Required.
Factor II will be evaluated on an Acceptable/Unacceptable basis on its submission of the proof being able to meet the required delivery date by May 20th, 2025. This will be evaluated during Phase I on an Acceptable/Unacceptable basis in accordance with the Technical Acceptable/Unacceptable ratings Table 1 below.
Phase II
Factor III – Price
Total price will be evaluated taking into the account the total FFP for the base year and option periods. Price analysis will be used to evaluate price reasonableness.
The Government may evaluate any and all information submitted by the vendor to support the reasonableness of prices proposed. The method of evaluation used by the Contracting Officer is solely within the discretion of the Contracting Officer.
Options will be evaluated pursuant to solicitation provision FAR 52.217-5, Evaluation of Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
A written order in response to the vendor’s quotation will be e-mailed or otherwise furnished to the successful vendor. The Contracting Officer may ask the vendor to provide written acceptance of an order. In other circumstances the vendor may indicate acceptance by proceeding with the services ordered.
Vendors responding to this solicitation are advised that, prior to award, the government may request vendors to submit additional information/data to support price reasonableness such as copies of paid invoices for the same or similar items, sales history for the same or similar items, price list with effective date and/or copies of catalog pages along with any applicable discounts. Failure to submit the requested information may result in disqualification of the submitted quote.
