g) Late submissions, modifications, revisions, and withdrawal of offers.

a. Offerors are responsible for submitting offers and any modifications or revisions to the Government office designated in the solicitation by the time specified in the solicitation.

b. Any offer, modification, or revision received after the time specified for receipt of offers is “late” and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition. However, a late modification of an otherwise acceptable offer that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.

c. If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

d. Offerors may withdraw their offers by written notice to the Government received at any time before award.

h) Contract award. The Government intends to evaluate offers and award a contract without discussions with Offerors. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms. However, the Government reserves the right to conduct discussions, if necessary. The Government may reject any or all offers if such action is in the public interest, accept other than the lowest offer, and waive informalities and minor irregularities in offers received.

i) Debriefings. If a post-award debriefing is given to requesting Offerors, the Government will disclose the following information, if applicable:

a. The agency’s evaluation of the significant weak or deficient factors in the debriefed Offeror’s offer.

b. The overall evaluated cost or price and technical rating of the successful

Offeror and the debriefed Offeror and past performance information on the debriefed Offeror.

c. The overall ranking of all Offerors when any ranking was developed by the agency during source selection.

d. A summary of the rationale for award.

e. For acquisitions of commercial products, the make and model of the product to be delivered by the successful Offeror.

f. Reasonable responses to relevant questions posed by the debriefed Offeror as to whether the agency followed source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities.

Section 4: Evaluation – Commercial Products and Commercial Services

j) The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

a. Technical. The technical rating reflects the degree to which the offer meets or does not meet the requirements listed in Attachment 1.

Technical Acceptable/Unacceptable Rating Method Adjectival Rating Description Acceptable Offer meets the requirements of the solicitation.

Unacceptable Offer does not meet the requirements of the solicitation.

b. Past Performance. Past performance will be rated on an “Acceptable” or

“Unacceptable” basis at the overall factor level using the ratings shown below.

Past Performance Acceptable/Unacceptable Rating Method Adjectival Rating Description

Acceptable

Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable

Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

i. Past performance information may be obtained from any sources available to the Government, to include, but not limited to, the Contractor Performance Assessment Reporting System (CPARS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and the Supplier Performance Risk System (SPRS).

ii. In the case of an offeror without a record of past performance, or for whom information on past performance is so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have “Unknown” past performance. In the context of acceptable/unacceptable, “Unknown” shall be considered “Acceptable”.

c. Price. Pricing will be evaluated in a two-step process.

1. Total Evaluated Price (TEP) Calculation (Weighted Pricing)

In accordance with RFO FAR 15.104(b)(1) and 15.202(d), the Government will evaluate proposed prices to ensure they are fair and reasonable. For award purposes, the Government will calculate a Total Evaluated Price (TEP). The TEP will be determined using a weighted formula applied to the offeror's proposed prices for Contract Line Item Numbers (CLINs) 0001, 0002, and 0003.

The evaluation weights are assigned as follows:

CLIN Description Evaluation Weight 0001 Basic Rider Course eP1x11 25% 0002 Basic RiderCourse2 (BRC2) – Skills Practice 50% 0003 Advance RiderCourse (ARC) – Skills Practice 25%

Calculation Method:

The proposed extended price for each CLIN will be multiplied by its respective weight to determine the weighted CLIN price. The sum of these weighted CLIN prices will constitute the overall TEP used to evaluate and compare offers.

2. Balanced Pricing Evaluation

Following the calculation of the TEP, the Government will evaluate the offeror's proposed prices to ensure they are materially balanced in accordance with the updated RFO FAR 15.404-6 (Unbalanced Pricing)

k) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

l) Determination of Responsibility. In accordance with FAR subpart 9.1 –

Responsible Prospective Contractors, an offeror must be determined to be responsible by the Contracting Officer in order to be eligible for award.

m) Notice of award. A written notice of award or acceptance of an offer furnished by the successful Offeror within the time acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
