Combined Synopsis/Solicitation - IONSCAN600 Extended Warranty
The 21st Contracting Squadron, Space Base Delta 1, Peterson Space Force Base (SFB), Colorado announces a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice.
This announcement constitutes the only solicitation; a quote is being requested and a written solicitation will not be issued.
This solicitation FA251723Q0044 is being issued as a Request for Quote (RFQ).
The solicitation document and incorporated provisions and clauses are those in effect through Federal
Acquisition Circular (FAC) 2023-02, 16 March 2023.
This procurement is a 100% Small Business Set-Aside.
The North American Industrial Classification System (NAICS) code is 334511. The size standard is 1350 employees.
The Government will award a Firm Fixed Price (FFP) purchase order.

Anticipated award date: 28 April 2023 Warranty coverage shall start on the day of award, and base year (CLIN 0001) will be for 12 months. All subsequent options, if executed, will also be 12 month coverage periods.

Provision FAR 52.212-2, Evaluation – Commercial Products and Commercial Services
Evaluation and Award Criteria The Government will award a contract resulting from the solicitation to the responsible Offeror whose offer conforming to the solicitation will be the most advantageous to the Government. Award will be made using Lowest Priced Technical Acceptability (LPTA) as an evaluation method for this requirement as detailed below.
The following factors shall be used to evaluate LPTA quotes:
• Factor One (1): Total Price
• Factor Two (2): Technical
Factor One (1), Total Proposed Price: 21 CONS will review all quotes, ranking Offeror’s quotes from lowest to highest based on proposed price. The lowest priced quote will then be evaluated for Technical Capability, which will be evaluated on an acceptable or unacceptable basis.
Factor Two (2) Technical: 21 CONS will evaluate quotes for technical acceptability in the preceding manner: Verification that quotes include the correct quantity, description, and meet the requirements listed in Attachment 1.
Acceptable – The quote clearly meets the requirements of the solicitation (in terms of quantity, part number, and description). The items (extended warranty) provided by the offeror meet all salient characteristics listed in Attachment 1.
Unacceptable – The quote does not clearly meet the requirements of the solicitation (in terms of quantity, part number, and description). The items (extended warranty) provided by the offeror do not meet all salient characteristics listed in Attachment 1.
Award Process The government will first order the offeror’s lowest to highest total price. The lowest priced quote will be evaluated for Technical Acceptability on “Acceptable/Unacceptable” basis. If the lowest priced quote is deemed “Acceptable,” the evaluation will stop and award will be made. If the lowest priced quote is deemed “Unacceptable,” no further consideration will be given to that offeror and the next lowest priced quote will be evaluated.
The Government will continue the evaluation process until reaching a technically acceptable quote.
Offeror’s whose quote is determined “Unacceptable,” will not be eligible for award. The Government intends to make a selection based on the initial quote submissions without conducting conversations.
Therefore, each quote should contain the offeror’s best terms from a price and technical standpoint.
Conversations may be conducted with one, some, or all offerors as the Government is not required to conduct conversations with any or all offerors responding to the solicitation.
Conversations – Fluid interaction(s) between the Contracting Officer and the offeror’s that may address any aspect of the quote and may or may not be documented in real time.
Note: The vendor acknowledges that should the quote terms and conditions and/or agreement conflict with mandatory provisions of the FAR and other Federal laws applicable to commercial acquisitions, to the extent of such conflict the FAR and Federal laws governing conflicting vendor terms and conditions and/or agreement are unenforceable and are not considered incorporated into any resultant Delivery Order. The vendor must be capable of providing assurance that all products are TAA compliant upon delivery.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-

5352.201-9101 Ombudsman
As prescribed in 5301.9103, insert the following clause:
OMBUDSMAN (OCT 2019)
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern.
The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). (c) If resolution cannot be made by the contracting officer, the interested party may contact the ombudsman, AFICC/OL-SPC, Director or Deputy Director of Contracting, 250 S.
