This is a combined synopsis/solicitation for commercial items prepared in accordance with the Federal Acquisition Regulation (FAR) format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation;

proposals are being requested and a written solicitation will not be issued. The solicitation is being issued in conjunction with FAR PART 13.106 and FAR 13.5 Simplified Procedures for Certain Commercial Items. The solicitation number is FDA_21-223-1237649. This solicitation is issued as a Request for Quote (RFQ).

The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2021-02, November 23, 2020.

The associated North American Industry Classification System (NAICS) Code is- 334516- Analytical Laboratory Instrument Manufacturing; with a Small Business Size Standards 1,000 in number of employees. This requirement is set aside for small business.

Respondents are responsible for submitting proposal/quote and any supporting documents before 1:00 PM Central Time - Local Prevailing Time in Jefferson, Arkansas on January 15, 2021 by e- Mail to howard.nesmith@fda.hhs.gov.

Statement of Need:

The U.S. Food and Drug Administration (FDA), National Center for Toxicological Research (NCTR), Office of Scientific Coordination (OSC), requires an Electron Microscope Charged Coupled Device (CCD) Camera.

Background:

FDA/NCTR/OSC includes the Nanotechnology Core Facility which provides research support mission to FDA scientists. This support includes an electron microscopy core facility for high resolution imaging system installed in 2010. The system includes a JEOL JEM-2100 Electron Microscope obtained for the purpose of imaging sub-micron to sub-nanometer scaled material to aid in FDA relevant research. This electron microscope records images using a Gatan Ultrascan CCD (charge-coupled device) digital camera attached to it. In order to maintain the Electron Microscope effectiveness, the FDA requires the camera to be replaced before it fails permanently.

Minimum Technical Specifications/Requirements:

• Charged Coupled Device (CCD) Camera shall be specifically designed for Electron Microscopes that also run as cryoEM microscope

• CCD shall be compatible with a JEOL JEM-2100 model JU2006076 Electron Microscope

• CCD shall not interfere with the JEOL STEM detector

• CCD shall not act as an anti-contaminator when cooled, creating a film of plasticizer on the surface of the CCD emanating from the CCD electronics exposed to the vacuum

• CCD chip sized shall be appropriately 64mm x 64mm @ 4000 pixels

• CCD shall be able to read microscope parameters directly from the microscope

• CCD shall have an approximate 4000 x 4000 pixel area, with a pixel size of between 15 -

• CCD chip shall be usable for image processing from cryoEM

• CCD shall be capable of recording cryoEM images in any one of several imaging formats that can be easily converted to 16-bit TIF with 65,536 levels of grey o CryoEM imaging shall include low and high dose tomography and low dose single particle collection.

• CCD operating software shall integrate with the JEM-2100 STEM detector and shall be able to process a live power spectrum in part for astigmatism correction and alignment evaluation

• CCD shall include a computer necessary to run the software and the entire system which shall integrate on and with a JEOL JEM-2100 TEM.

• CCD shall be installed on the JEOL JEM-2100 TEM

• CCD shall include one week of on-site training

• CCD shall have at minimum a 12-month warranty

• Supplier shall recommend operations that will prevent contamination build-up of the

CCD chip.

Post-Warranty Corrective/Remedial Repair and Preventive Maintenance Service Requirements:

• All maintenance and repair activities shall be performed by formally trained and certified technicians/engineers. All repairs and PM services shall be performed following Original Equipment Manufacturer (OEM specifications, manuals, and service bulletins, using OEM replacement parts, components, subassemblies, etc.

• Proposed pricing shall provide unlimited Corrective/Remedial and Preventive Maintenance Service(s) inclusive of shipping, labor, travel, replacement parts, subassemblies, components, or modules necessary for repairs, etc.

• The PM Service plan shall include at least one (1) on-site visit for preventative maintenance, routine calibration and certification of the instrument per year.

• Contractor shall provide corrective/remedial repair visits within 2-3 business days of call for service (for issues that can’t be resolved remotely via phone or Internet).

• The Contractor shall provide unlimited technical support Mondays – Fridays (excluding Federal Holidays) between the hours of 7:00 AM - 5:00 PM Central Time and shall begin working on a solution to the problem within 8 business hours of contact for assistance.

(e.g., telephone-based, email-based, website-based, etc.)

• Manufacturer’s call center accessible by FDA Contracting Officer’s Representative (COR), Technical Representative (TR) and/or System Operator Personnel for technical assistance shall be staffed by senior engineers to provide a high level of expertise for troubleshooting the instrument.

• The service plan shall include access to OEM technical developments, repair procedure bulletins, and unlimited software, firmware, and application updates.

• Deliverables: Service Records and Reports The Contractor shall, commensurate with the completion of each service call or preventative maintenance visit, provide the end-user of the equipment and the Contracting Officer with a copy of a field service report/ticket identifying the equipment name, manufacturer, model number, and serial number of the equipment being serviced/repaired and detailing the reason for the service call, a detailed description of the work performed, the test instruments or other equipment used to affect the repair or otherwise perform the service, the name(s) and contact information of the technician who performed the repair/service, and for information purposes, the on-site hours expended and parts/components replaced.

The FDA does not accept documents which contain the use of macros. Document submissions required throughout the award period(s) shall not have enabled macro functionality. Any document(s) delivered having macro functionality will be deemed delinquent, if not corrected prior to the due date.

Addendum Paragraph (a). Supplies and/or services delivered hereunder shall be inspected and accepted at destination by the Contracting Officers Representative (COR) or Technical Point of Contact (TPOC) specified below. If the supplies or services are acceptable, the COR/TPOC shall promptly forward a report of inspection and acceptance to the paying office. B. The Technical Representative is responsible for:

(1) Monitoring the Contractor's technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements;

(2) Interpreting the statement of work and any other technical performance requirements;

(3) Performing technical evaluation as required;

(4) Performing technical inspections and acceptances required by this contract; and

(5) Assisting in the resolution of technical problems encountered during performance.

Contractor Performance Evaluation(s) In accordance with Federal Acquisition Regulation (FAR) Subpart 42.15 – Contractor Performance Information, the FDA will complete annual and final contractor performance evaluations. Annual evaluations will be prepared to coincide with the anniversary date of the contract. Additional interim performance evaluations may be prepared at the CO’s discretion, as necessary. Final performance evaluations will be completed upon contract expiration.

FDA will utilize the Contractor Performance Assessment Reporting System (CPARS) to execute annual and final contractor performance evaluations. CPARS is a secure internet website located at https://www.cpars.gov/main/cparsmain.htm. FDA will register the contractor in CPARS upon receipt of the name and email address of two (2) individuals who will be responsible for serving as the Contractor’s primary and alternate CPARS contacts. Once FDA registers the contractor in CPARS, the Contractor will receive an automated CPARS email message which contains User IDs and instructions for creating a password.

Once a performance evaluation is issued, the Contractor’s primary and alternate CPARS contact will receive an email instructing them to logon to CPARS to review the performance evaluation.

The Contractor has 14 calendar days from the date of performance evaluation issuance in which to review the evaluation. If the Contractor agrees with the performance evaluation outcome, the evaluation becomes final. Should the Contractor disagree with the performance evaluation outcome, rebuttal comments must be submitted via the CPARS within 14 days from date the evaluation was issued by FDA. Any disagreement between the CO and the Contractor will be referred to a contracting official one level above the CO, whose decision will be final.

Copies of each performance evaluation and contractor responses, if any, will be retained as part of the official contract file and will be used to support future award decisions. Evaluations will also be stored for a 3-year period (6 years for construction) in the https://www.cpars.gov/ system.

Contractors may obtain CPARS training material and register for on-line training at https://www.cpars.gov/main/cparsmain.htm . There is no fee for registration or use of the CPARS system.

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.
