1. CLAUSES INCORPORATED BY REFERENCE (FAR 52.252-2) (FEB 1998)
This contract incorporates one or more clauses by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. Also, the full text of a clause may be accessed electronically at this/these address(s): https://www.acquisition.gov/?q=browsefar
CLAUSES INCORPORATED BY REFERENCE:
2. 52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
The government will award a contract resulting in the “Best Value” and “Trade Offs “from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the government, price and other factors considered. The following factors shall be used to evaluate offers:
1. The responsible offeror shall be capable of providing the bandwidth upon award of contract, or provide the bandwidth to the comm building in English village with only the connections let to complete within 2 business days. The full performance of the internet service will be expected to commence within 7 days after initial setup of equipment, i.e. switches, multiplexers, cabling w/in comm building.
2. The Ability to use existing fiber connection OR other existing connections w/out adding installation time/tasks involved in trenching/installing substantial qty’s of new cable since DPG COMM building is at least 33 miles from Interstate 80 where some fiber connections exist.
3. The government will award to the lowest priced offeror meeting above criteria.
The government will evaluate offers for award purposes by adding the total price for all options, as well as any initial equipment required to be purchased for final connectivity. The government may determine that an offer is unacceptable if the option prices are significantly unbalanced (total cost not reasonably balanced across the 5 periods of performance).
TRADE OFF EVALUATION: FACTORS 1 AND 2 ABOVE ARE MORE IMPORTANT THAN PRICE. Factor #1 is most important and the government reserves the right to award to any vendor with existing cabling/connectivity if that service would result in an active connection PER specifications.
The government intends to award without negotiations. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(end of provision).
