About this file
This is a Combined Synopsis/Solicitation for Cooling Tower Maintenance issued by the National Institute of Standards and Technology (NIST) Center for Neutron Research (NCNR). The solicitation (RFQ 1333ND25QNB610374) seeks a contractor to perform comprehensive maintenance services for two cooling tower systems supporting a nuclear test reactor, with a base year and four option years. The cooling towers, built in 2002 and 2011, require routine maintenance, repairs, cleaning, and potential emergency support across three and two cooling cells respectively, including associated subsystems like deicing, fire protection, and plume abatement systems.
The procurement is structured as a full and open competition under NAICS code 811310 with a small business size standard of $12.5M. Offerors must submit electronic quotations by email, divided into four volumes: Technical Approach, Experience/Past Performance, Price Quotation, and Terms and Conditions. Evaluation criteria include technical approach, experience, past performance, and price, with non-price factors considered significantly more important. Contractors must be registered in the System for Award Management (SAM) and will be assessed on their ability to demonstrate relevant cooling tower maintenance experience through project references and past performance.

(End of Provision)
The associated North American Industrial Classification System (NAICS) code for this procurement is 811310, Commercial and Industrial Machinery and Equipment (except Automotive and Electronic) Repair and Maintenance, with a small business size standard of $12.5M.
This acquisition is being solicited as full and open competition.
BACKGROUND:
The National Institute of Standards and Technology (NIST) Center for Neutron Research (NCNR) owns and operates a heavy water-moderated nuclear test reactor and associated neutron beam research facility. The NCNR’s reactor is licensed with the Nuclear Regulatory Commission (NRC) under the name National Bureau of Standards Reactor (NBSR). The Reactor's secondary cooling water is cooled by a set of cooling towers. The cooling towers are located behind the NCNR (Building 235). The main cooling tower was built in 2002 by Balcke-Dürr. It's constructed on a concrete basin with pressure treated and marine grade wood and fiberglass siding. Exterior wood surfaces consist of a stairway, railings, and plywood decking. It has 3 cooling cells (#1, #2 and #3). The secondary cooling tower is a modular design. It was erected in 2011, is supported on steel pilons and is made of stainless steel. It is a BAC model 3781C tower. It has 2 cooling cells (#4 and #5). While the overall condition of the cooling towers is good, they need routine maintenance, repairs, and cleaning. The NCNR operates 24/7 and could potentially require emergency repair services or support at the facility in addition to regular maintenance and repair services. The NCNR requires the services of a contractor to inspect, clean, perform routine maintenance, and complete required repairs on both sets of cooling towers inclusive of several subsystems that work in tandem with the main cooling tower structures. These systems include a deicing system, a fire protection system, and a plume abatement system. The cooling towers need emergency support, assessments, and repair services. See Attachment A, Statement of Work (SOW) and Attachment B, Cooling Tower Files, for full requirement details.

The quotation shall be clearly and concisely written as well as be neat, indexed (cross-indexed as appropriate) and logically assembled. Note: The term “indexed” refers to a table of contents that lists sections and page numbers. All pages of the quotation shall be appropriately numbered.

The Offeror’s quotation shall be clearly divided into the following distinct volumes as separate attachments:
Volume I – Technical Approach Volume II – Experience/Past Performance Volume III – Price Quotation Volume IV – Terms and Conditions
Volume I – Technical Approach:
No pricing information shall be included in this volume. The quoter shall submit technical approach and capability documentation which may include a narrative, charts, graphs, tables, drawings, product/service literature, and as applicable, demonstrated authority to provide the necessary items and perform the required services identified in the SOW (Attachment A). The documentation shall clearly describe, in sufficient detail, the quoter's authority, proposed items, resources and methods to successfully fulfill the requirements. The submission shall clearly identify each line item above. The submission must demonstrate that the proposed solution meets or exceeds requirements described in the SOW by providing a citation between the SOW paragraph and the relevant section of the technical description. The offeror shall propose a separate firm-fixed-price quotation for each CLIN. Price quotations shall remain valid for a period of 90 days from the date quotations are due. Contractor shall state express warranty coverage (if applicable).
Volume IV - Terms and Conditions NOTE: System updates may lag policy updates. The System for Award Management (SAM) may continue to require entities to complete representations based on provisions that are not included in agency solicitations. Examples include:
52.223-22, Public Disclosure of Greenhouse Gas Emissions and Reduction Goals—Representation, 52.212-3, Offeror Representations and Certifications—Commercial Products and Commercial Services - paragraph (d).
Contracting officers shall not consider or use these representations when making award decisions or enforce requirements. Entities are not required to, nor are they able to, update their entity registration to remove these representations in SAM.
Provisions Offerors shall provide a completed copy of all FAR provisions listed below:
1. 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services (May 2024)(Deviation Feb 2025). The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) website accessed through http://www.sam.gov/portal. Acceptance of Terms and Conditions (Addendum to FAR 52.212-1(b) (11)):
If the contractor objects to any of the terms and conditions contained in this solicitation, the contractor shall state "The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:" [Contractor shall list exception(s) and rationale for the exception(s)]. It is the sole responsibility of the contractor to identify in their quotation any exceptions to the terms and conditions of the solicitation. If the contractor does not include such a statement, the submission of a quotation in response to this solicitation will be regarded as the Contractor's acceptance of the Government's terms and conditions for inclusion into the resultant purchase order (PO).
Note: This procurement is not being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If an Offeror submits a quotation based upon an FSS or GWAC contract, the Government will accept the proposed price. However, the terms and conditions stated herein will be included in any resultant purchase order, not the terms and conditions of the Offeror's FSS or GWAC contract, and the statement required above shall be included in the quotation.
(End of provision Addendum to 52.212-1)
Provision 52.212-2, Evaluation-Commercial Products and Commercial Services applies to this procurement. The evaluation criteria included in paragraph (a) of the provision are as follows:
EVALUATION CRITERIA
The Government intends to award a single purchase order (PO) from this solicitation using simplified acquisitions procedures for Certain Commercial Products and Commercial Services in accordance with FAR subpart 13.5. The government will make an award, based on best value, to the vendor with the proposed solution that is most advantageous, price and other factors considered. When combined, non-priced factors are significantly more important than price. As Technical Evaluation Factors become more equal among quoters, price shall become more of a determining factor. The Government reserves the right not to award a PO and to make an award without discussions based solely upon initial quotes.
Evaluation Factors:
1) Technical Approach: Evaluation of technical capability shall be based on the information provided in the technical quotation. NIST will evaluate whether the quoter has demonstrated that its proposed service meets or exceeds all minimum criteria. Quotations that do not demonstrate the proposed service meets all criteria will not be considered further for award. If a quoter does not indicate whether its proposed service meets all criteria, NIST will determine that it does not.
2) Experience: NIST will evaluate the extent to which the offeror’s proposal demonstrates experience in successfully completing at least three (3) projects that involve the maintenance and/or repair of cooling towers of similar performance. Projects submitted for evaluation with a direct correlation to the proposed requirements will be rated more favorably than those with lesser relevance.
3) Past Performance: The Government will evaluate the quoter's past performance to determine the extent to which it demonstrates that the quoter has successfully completed relevant contracts in the past five (5) years. In assessing the quoter's past performance information, NIST will evaluate, as appropriate, successful performance of contract requirements, quality and timeliness of delivery services, cost management, communications between contracting parties, proactive management and customer satisfaction. Evaluation of this factor will be based on information contained in the technical portion of the quotation and information provided by references. Offerors shall provide three (3) past performance references. The Government will evaluate past performance information by contacting appropriate references, including NIST references, if applicable. The Government may also consider other available information in evaluating the Offeror’s past performance. The Government will assign a neutral rating if the offeror has no relevant past performance information.
4) Price: The proposed price will be evaluated for reasonableness. The evaluation will determine whether the proposed prices are reasonable in relation to the solicitation requirements. Prices must be entirely compatible with the technical portion of the quotation.

Also, the IRS may publish a revenue ruling, which is an official interpretation by the IRS of the Internal Revenue Code, related statutes, tax treaties, and regulations. A revenue ruling is the conclusion of the IRS on how the law is applied to a specific set of facts.
