(16) Description:

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, “Streamlined Procedures for Evaluation and Solicitation for Commercial Items,” as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested, and a written solicitation document will not be issued.

(ii) This solicitation is a request for quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2022-05 03/0702022.

(iii) The associated North American Industrial Classification System (NAICS) code for this procurement is 332999, with a small business size standard of 750 employees.

(iv) The US Forest Service is seeking to purchase NFES 0881 Wrap - Structure Protection to be used in wildland fire fighting to protect structures by providing a thermal barrier between the structure and an approaching flame front.

(v) See “Schedule of Items” for specifications/requirements in Section A.

(vi) Date(s) and place(s) of delivery and acceptance and FOB point are located in the

“Schedule of Items” in Section A.

(vii) The provision at 52.212-1, Instructions to Offerors-Commercial Products and

The offeror shall complete only paragraph (b) of this provision since they must be registered in the System for Award Management (SAM) as accessed through https://www.sam.gov in order to respond to solicitations and be awarded contracts.

matthew.cox2@usda.gov. Questions must be received no later than 04/20/2022 at 5:00PM Mountain Time. No further questions will be accepted after that date and time unless deemed in the best interest of the Government by the Contracting Officer.

(xv) You are reminded that representatives from your company SHALL NOT contact any US Forest Service employees to discuss this RFQ during this procurement phase. ALL questions and concerns regarding this RFQ shall be directed to the above Contracting Officer.

(xvi) Offerors shall provide only one (1) quote. QUOTES shall be emailed to matthew.cox2@usda.gov no later than 04/28/2022 at 5:00PM Mountain Time. Non-compliance with this requirement may result in disqualification of the quote. The estimated quantities shown are for evaluation purposes only. Contractor will be paid for actual quantities. The quoter must quote on all line items. Only quotes to the nearest cent will be accepted.

(xvii) The government intends to award a Firm-Fixed Price Purchase Order as a result of this RFQ that will include the terms and conditions set forth herein. To facilitate the award process, ALL quotes shall include a statement regarding the terms and conditions herein as follows:

Section C – Requirements, Packing, & Palletization

Description:

Structure protection wrap is used in wildland fire fighting to protect structures by providing a thermal barrier between the structure and an approaching flame front. The structure wrap consists of an aluminum foil laminated onto a fiberglass cloth. The foil protects structure by reducing heat transfer to the structure from radiant heat. The fiberglass cloth provides durability to the laminated cloth and attenuates heat transfer from convective heat.

Requirements: NFES 0881 Wrap - Structure Protection Rolls shall meet the following requirements.

The structure wrap shall be composed on aluminum foil laminated to a glass cloth with the following specification:

Packaging:

Structure protection wrap shall be packaged in a roll. No more than 28 rolls shall be placed in a pallet.

Palletization:

The shipping (transport) containers shall be palletized. The pallets shall be 45-inch length x 62-inch width, general purpose, four-way entry, flush stringer, and double-face non-reversible pallets.

Section D – Packing and Marking

Packaging shall be sufficient to prevent damage to ensure safe delivery at destination. Items shall also be packaged in such a manner that it will ensure acceptance by common carrier if that shipping method is utilized.

Shipping addresses shall be verified with the Technical POC located in Section G prior to the occurrence of shipping.

All shipments shall be Free On Board (FOB) Destination and insured against loss or damage and shall carry sufficient insurance to cover the full replacement value of the specific items being shipped unless otherwise agreed to by the Government in writing.

(d) Comptroller General Examination of Record Comptroller General Examination of Record. 452.204-70 Modification for Contract Closeout.

MODIFICATION FOR CONTRACT CLOSEOUT (MONTH YEAR)

Upon contract closeout for contracts utilizing Simplified Acquisition Procedures (SAP) according to FAR 13:

(a) If unobligated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

(b) If unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature. (The CO may also request a Release of Claims be completed by the contractor, although not required for contract and orders using SAP procedures.) If the bilateral modification and Release of Claims are not returned to the CO within 60 days, the CO shall release the modification as unilateral and proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

452.237-75 Restrictions Against Disclosure (FEB 1988)

(a) The Contractor agrees, in the performance of this contract, to keep all information contained in source documents or other media furnished by the Government in the strictest confidence. The Contractor also agrees not to publish or otherwise divulge such information in whole or in part in any manner or form, or to authorize or permit others to do so, taking such reasonable measures as are necessary to restrict access to such information while in the Contractor's possession, to those employees needing such information to perform the work provided herein, i.e., on a “need to know” basis. The Contractor agrees to immediately notify in writing, the Contracting Officer, named herein, in the event that the Contractor determines or has reason to suspect a breach of this requirement.

(b) The Contractor agrees not to disclose any information concerning the work under this contract to any persons or individual unless prior written approval is obtained from the Contracting Officer. However, the certification will be considered in connection with a determination of the Offeror’s responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.

(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. As a minimum, the quote must clearly provide the following information for the listed factors:

(1) Quote Acceptability - The Government must deem quotes acceptable to consider them for award. The following sub factors will be used to determine quote acceptability:

(i) Assent to terms of the solicitation - Submit all required documentation requested in the solicitation. To be deemed acceptable the quote cannot take exception to any requirements of the solicitation.

(ii) FAR 52.212-3 Offeror Representations and Certifications-Commercial Products and Commercial Services.

(iii) Utilization of Bio-based projects - Provide statement addressing bio-based products to be used on this contract. If no bio-based products are being used, a non-applicable statement is required.

(iv) Technical Capability - Provide a one-page description of the product being proposed. NFES 0881 STRUCTURE Protection Wrap must be to specifications listed in Section C, page(s) 6 and 7 herein.

(v) Past Performance - Offeror is not required to provide Past Performance data but instead the Government will pull CPARS Data, for the prior 3 years to determine if Past Performance is Acceptable/Unacceptable. If the Offeror does not have CPARS data, the Offeror will be required to provide three (3) relevant, in magnitude and scope, Past Performance Questionnaires. (see Attachment 2) If CPARS Data is available, Past Performance Questionnaires will not be needed.

The following information will be compiled to create the Business Portion:

1. Schedule of Items in Section A, Page(s) 4-6, completed by Offeror -and/or a quote on company letterhead clearly itemized or broken down by exact line item and including all information as indicated in Section A, Schedule of Items herein.

*If amendments are issued, amendments shall be acknowledged in Quote.

2. Price – Schedule of Items in Section A, Page(s) 4-6, completed by Offeror -and/or a quote on company letterhead clearly itemized or broken down by exact line item and including all information as indicated in Section A, Schedule of Items herein.

*Offeror is required to quote on unit prices and total cost for all items.

3. FAR 52.212-3 Offeror Representations and Certifications-Commercial Products and Commercial Services. Completed - Pages 30-43 NOTE: The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certifications electronically in the System for Award Management (SAM) accessed through https://sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) though (u) of this provision.

4. Utilization of Bio-based projects. Provide statement addressing bio-based products to be used on this contract.
