52.212-2 Evaluation—Commercial Products and Commercial Services
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
Comparative Analysis: Technical and Price
Limitation on Evaluation and Comparative Analysis:
The Government will conduct an initial review of all submitted quotations to verify they conform to the basic combined synopsis/solicitation requirements. Following this initial review, the Government will rank the conforming quotations by price (from lowest to highest). The Government will then limit its detailed comparative analysis and final consideration for award to only the top five (5) lowest-priced quotations.
The Government will compare the technical features and prices of these top five (5) quotations against one another to determine which offer is the most advantageous and provides the best value to the Government. Quotations not in the top five (5) lowest-priced tier will not be further evaluated.
(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Addendum to 52.212-2 Evaluation—Commercial Products and Commercial Services
(a) The Government will award an order or purchase order resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Evaluation Factors:
This evaluation will utilize comparative analysis to provide the best value to the Government. Award may be made to other than the lowest priced quote if the Government determines that a price premium is warranted due to technical merit.
However, the closer the merits of the technical quote are to one another, the greater will be the importance of price in making the award determination. In the event that two or more technical quotes are determined technically equivalent, award may be made to the lower priced quote provided the price is reasonable. Responses to this solicitation will be evaluated against the following factors:
FACTOR 1: Technical
The quoter should provide technical information based on the following critical criteria as outlined in the J&A document:
a. Submit documentation validating that the offered items are genuine Cooper Crouse-Hinds Plug, Tip (NSN 5935012607742) (P/N 10250287-1 or E1010-165), fully compliant with the approved Brand Name Justification & Approval (J&A). No alternate parts or generic equivalents will be considered.
b. Provide supporting technical and logistical documentation for evaluation, including but not limited to: Certificate of Conformance (CoC), manufacturer technical specification sheets, standard commercial warranty terms, confirmed delivery lead times (F.O.B. Destination), etc.)
Mere re-statements of the requirements or statements from the quoter that the quoter is compliant that do not include proof that the quoter can demonstrate the aforementioned items are unacceptable. If the quote is determined unacceptable in any of the technical evaluation factors or subfactors, the quote may not be considered for award.
In addition to the information submitted by quoters, the Contracting Officer may consider other information reasonably related to the evaluation factors, to include the personal knowledge of the competitor's commercial and Government customers and past performance databases. The Government may consider any other value-added benefit quoted in its best value determination.
The Contracting Officer may communicate with a quoter at any time during the evaluation without regard to the Revolutionary FAR Overhaul (RFO) Part 15 rules concerning competitive range determinations and discussions. The Contracting Officer may also identify the quoter most likely to provide best value and hold negotiations solely with that quoter to finalize the order and/or negotiate more favorable terms for the Government.
FACTOR 2: Price
Quoters must quote all items. The total evaluated price will be computed by adding the total estimated amount for each item.
