The Contractor shall not release any data, report or other material of any nature obtained or prepared under this contract without the specific written approval of the Contracting Officer.
PART 2
TECHNICAL REQUIREMENTS
2.1 Supervision and Inspection
a. Supervision of employees performing the required work shall be the Contractor’s responsibility. This is to include all supervision necessary in planning, organizing, and completing the work required in the contract. All costs in connection with supervision are included in the contract unit prices listed in the Schedule.
b. The Contractor shall designate an individual to act as his/her authorized representative to receive all necessary work assignments. This individual must be completely familiar with both the general and technical requirements of this contract and be able to secure full compliance with work assignments issued by the Contracting Officer. The authorized representative will function as the contact between the Contracting Officer or his/her authorized representative and the Contractor, and as such, must be available during normal working hours.
c. The Prime Contractor laboratory shall be, at the time of proposal submittal, capable of performing the following analyses on water and solid samples: volatile organics (8260C), semi-volatile organics (8270C), organochlorine pesticides (8081A), polychlorinated biphenyls (8082), herbicides (8151A), explosives (8330), full-suite TCLP (1311), and TAL metals (ICP trace/GFAA). Before testing services can be performed by the laboratory, the COR will notify the candidate laboratory of the acceptability of the declaration and supporting documentation. ELAP accreditation information is to be provided annually while supporting USACE contracts. An environmental laboratory either anticipating, or engaged in support of USACE contracts, shall notify the COR immediately of change in status of laboratory operations that may affect on-going compliance with these requirements. The USACE COR may, at any time, conduct audits (including requests for pertinent data or information) that support an environmental laboratory’s self-declaration of compliance with this policy. If the COR finds the laboratory non-compliant;
alternate, compliant laboratory services will be utilized by the Contractor at no additional cost to the Government, until such time as compliance is again demonstrated. Before performing environmental testing for USACE, the laboratory shall have access to the approved Quality Assurance Project Plan.
e. The Contracting Officer or his/her designated representatives shall have access to the laboratory at all reasonable times for inspection purposes to observe sample analysis and ensure compliance with contract requirements.
2.2 Laboratory Requirements
a. General. Essential prerequisites for obtaining reliable data are: trained and experienced personnel, adequate facilities and equipment, and selection of appropriate analytical methods.
b. Facilities
The laboratory must comply with Federal OSHA regulations. The laboratory shall be available for inspection by the Contracting Officer or his/her authorized representative during normal working hours to ensure that the above requirements are maintained. CLAUSES INCORPORATED BY FULL TEXT
52.202-1 DEFINITIONS (JUN 2020)
When a solicitation provision or contract clause uses a word or term that is defined in the Federal Acquisition Regulation (FAR), the word or term has the same meaning as the definition in FAR 2.101 in effect at the time the solicitation was issued, unless--
(a) The solicitation, or amended solicitation, provides a different definition;
(b) The contracting parties agree to a different definition;
(c) The part, subpart, or section of the FAR where the provision or clause is prescribed provides a different meaning;
(d) The word or term is defined in FAR part 31, for use in the cost principles and procedures; or
(e) The word or term defines an acquisition-related threshold, and if the threshold is adjusted for inflation as set forth in FAR 1.109(a), then the changed threshold applies throughout the remaining term of the contract, unless there is a subsequent threshold adjustment; see FAR 1.109(d).
(End of clause)
52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Technical
- Must be accredited by the DoD Environmental Laboratory Accreditation Program (ELAP) for all chemical methods. For radiochemical methods, accreditation is required for alpha and gamma spectroscopy, gross alpha, and gross beta.
- Must be able to meet an Emergency Turn around Time (TAT) from the point of sample receiving at the laboratory to data delivery to the COR of 30 hours; and a rapid TAT capability of 5 days. Contractor must clearly demonstrate a reasonable approach to accomplish the TAT requirement.
Technical and past performance, when combined, are equally important to price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL PRODUCTS AND
COMMERCIAL SERVICES (OCT 2022)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
