1.0 General Information
Scope of Work
The Willamette National Forest requires roadway maintenance service on an estimated 15.1 miles of road located on the McKenzie River Ranger District Work scope includes Roadway Surface Maintenance (811), Spot Surfacing 2.0 Background

2.0 Contractor Requirements
This is a non-Personnel Services Contract. The Contractor shall furnish all labor, supervision, equipment, transportation, (except those designated as Government-furnished), and incidentals for road maintenance activities within the Willamette National Forest within the scope of this contract.
Performance Tasks
Item 0001/0002 811 Surface Maintenance Level 2 and 3 Roads
811.01 Service Required
Smooth and shape native or aggregate surfaced roads including traveled way, shoulders, turnouts, and intersections. When roller compaction is required, a minimum of an 7-10 ton vibratory roller will be operated over the full width of the roadway for a minimum of 3 complete passes over the full width until there is no visible evidence of consolidation. One pass is defined as operating the vibratory roller from the point where blading begins to the point where blading ends. Adjust the moisture content to a level suitable for compaction.
811.02 Performance Standards
A road surface is maintained to standard when the surface is compact (when required), crowned, or sloped to drain, without segregation of the surfacing materials. The road surface has no ruts, rills or other irregularities & suitable materials have been recovered and incorporated. Unsuitable materials have been removed.
When ordered by the Contracting Officer to work in a weed infested area the contractor will be required to prevent spreading the infestation into un-infested areas by cleaning equipment. The contractor will use washing stations approved by the Contracting Officer.
Road Maintenance Level 3
Road maintenance level 3 is defined in the FSH 7709.59, sec. 62.32 as:
“Assigned to roads open and maintained for travel by a prudent driver in a standard passenger car. User comfort and convenience are not considered priorities. The “Manual on Uniform Traffic Control Devices” (MUTCD) is applicable. Warning signs and traffic control devices are provided to alert motorists of situations that may violate expectations.
“Roads in this maintenance level are typically low speed with single lanes and turnouts.
Appropriate traffic management strategies are either ‘encouraged’ or ‘accept.’ Discourage or prohibit strategies may be employed for certain classes of vehicles or users.
Maintenance level 3 roads have the following attributes:
• Are passable to prudent drivers in passenger cars during the normal season of use.
• Usually do not consider user comfort and convenience priorities.
• Are subject to the requirements of EM-7100-15 and MUTCD for signs.
• Are typically single lane with turnouts visible from either direction.
• Typically, it must be driven at low speeds.
• May be local or collectors.
• Have low- to moderate-traffic volume.
• Typically, connect to arterial and collector roads or other maintenance level 3 roads.
• May include some dispersed recreation roads.
• Provide drainage via a combination of dips and culverts.
• Typically, it may have potholes or wash boarding.
Road Maintenance Level 2
Road maintenance level 2 is defined in the FSH 7709.59, sec. 62.32 as:
“Assigned to roads open for use by high-clearance vehicles. Passenger car traffic, user comfort, and user convenience are not considerations. Warning signs and traffic control devices are not provided with the exception that some signing, such as W-18-1 “No Traffic Signs” may be posted at intersections. Motorists should have no expectations of being alerted to potential hazards while driving on these roads. Traffic normally is minor, usually consisting of one or a combination of administrative, permitted, dispersed recreation, or other specialized uses. Log haul may occur at this level.” Appropriate traffic management strategies encourage, accept, discourage, and prohibit.
Maintenance level 2 roads have the following attributes:
• Are maintained for use by high-clearance vehicles and not suitable for passenger cars.
• Do not consider passenger car traffic, user comfort, and user convenience.
• Have low traffic volume and low speed.
• Typically, there are local roads that connect to collectors and other local roads.
• Have dips or cross drains as the preferred drainage treatments.
• Avoid the use of culverts, arches, and bridges when possible.
• Typically, they have very few, if any, signs or other traffic control devices.
• Are subject to the requirements of EM-7100-15 and MUTCD for all signs.
• Do not consider surface smoothness.
• Do not always provide motorists with alerts to potential hazards.
• May not be passable during periods of inclement weather

811.03 Measurement
Measurement under this Section will be made by the total number of units for each item listed in the SCHEDULE OF ITEMS completed and accepted.
A. Mile: Surface maintenance will be measured along the centerline of the roadway. Turnouts are incidental. Measurement will be to the nearest one-tenth (0.1) mile.
Item 0003 813 Spot Surfacing, Gradation
813.01 Service Required
Load, haul, and place surface material to repair or stabilize road surfaces. Roller compaction is required. A minimum of a 7–10-ton vibratory roller will be operated over the full width of the roadway for a minimum of 3 complete passes over the full width until there is no visible evidence of consolidation. One pass is defined as operating the vibratory roller from the point where blading begins to the point where blading ends. Adjust the moisture content to a level suitable for compaction.
813.02 Performance Standard
A. Spot surfacing is complete when the designated quantity of the ordered material has been placed.
B. All materials transported onto National Forest System land will be weed free. Written documentation of methods used to determine the weed-free status of any and all materials furnished by the contractor will be furnished to the Contracting Officer before transporting any materials onto National Forest System land.

813.03 Measurement
Measurement under this Section will be made by the total number of units for each item listed in the SCHEDULE OF ITEMS completed and accepted.
A. Measure spot rock by the final cubic yard in-place.
B. Material measured by the cubic yards
Item 0005 881 Mobilization
881.01 Service Required
A. Mobilization of personnel, equipment, and material to the project site.
B. Moving equipment outside the established work schedule as ordered.
881.02 Performance Standards
The equipment will be clean and weed free prior to moving it to the project area. This cleaning shall remove all soil, plant parts, seeds, vegetative matter, or other debris that could contain or hold seeds. All subsequent move-ins of equipment to the project area shall be treated in the same manner as the initial move-in. Equipment shall be considered free of soil, seed, and other such debris when a visual inspection does not disclose such material. This requirement does not apply to service vehicles, water trucks, pickups, cars, and/or similar vehicles. Additional equipment washing is applicable to all equipment on site requiring washing, NOT individual pieces of equipment.
Unless otherwise agreed, the Forest Service shall be given a minimum of 24 hours’ notice when equipment is ready for inspection. The notification will include an agreed upon location where the equipment will be available for inspection by the Forest Service. Inspection will be required after every cleaning. Subsequent equipment moving mileage is defined as a one-way moving distance above 10 miles from the present work site to the ordered work site. Moving is complete when the contractor has moved from the present work site to the ordered work site and returned to the previous location.

881.03 Measurement:
A. Measurement under this Section will be made by the total number of units for each item listed in the SCHEDULE OF ITEMS completed and accepted. A. Each: Measured by the total number of units for each item in the schedule of items completed and accepted.
B. Mile: Work activity will be measured along the shortest feasible route to the nearest one (1) mile, from the starting location of the move to the ordered work site.
3.0 Payment
The accepted quantities will be paid at the contract price per unit of measurement per the schedule of items when work is completed.
4. 0 Property

Contractor Property
(a) The contractor may store equipment and materials within the Willamette National Forest on or near the work site. as approved by the COR. The contractor shall submit an equipment and materials storage to the COR for approval within 14 calendar days of contract award.
(b) The contractor stores equipment and material at its own risk and is responsible for the security of any contractor property stored on Government lands and facilities. The contractor holds the Government harmless for property security and damage.
5.0 Contractor Key Personnel
The Contractor shall provide a Contract Manager and designated alternate, as applicable, who has full authority to act for the Contractor on all contract matters relating to this contract. The Contract Manager or alternate shall be available during the Government's regular working hours and shall be available on site within one hour after the Government's regular working hours. The Contractor shall submit the name and contact information of the contract manager in writing to the COR within 14 calendar days of award.

(viii) FAR 52.212-1 Instructions to Offerors – Commercial Products and Commercial Services (SEP 2023) (Provision)
Addenda to Provision FAR 52.212-1:
For simplified acquisitions, the word quote or quoter is substituted in provision FAR 52.212-1 for the word offer or offeror.
Addenda to Provision FAR 52.212-1 paragraph (b) Submission of Offers:
1) Offerors must have an active entity registration in the System for Award Management in order to submit an offer. https://www.sam.gov/SAM/
2) Offerors shall ensure that all representations and certifications are up to date in SAM.gov at time of offer submission.
3) Offers shall be submitted in response to this solicitation in two volumes. Volume I, Technical Proposal. Volume II, Price Proposal. ueiSAM shall be affixed to each volume.

a) Technical Proposal – The technical proposal shall address the evaluation factors in
52.212-2. At a minimum the technical proposal will include:
i) Past Performance – Provide a list of similar projects completed by your firm over the past three years. Similar project is defined as similar to US Forest Service Road Maintenance Service as specified in the Performance Work Statement. Include a brief description of the project, dollar amount, year completed, and project owner contact information (name, phone, and email). If there is no past performance information available, the offeror will receive a neutral rating.
ii) Technical Capability – Provide a list of equipment and key personnel (with qualifications) that will be used to complete this project. The following key personnel shall be identified by name: Project Lead. A brief resume listing qualifications and competencies related to similar projects shall be included in volume I technical proposal of the quotation:

Price Proposal – Include the following:
1) Fill in the schedule of items on page 1 of this solicitation.
2) If there are amendments, acknowledge any amendments to this solicitation by completing and signing the posted SF-30 form.
3) Notification of Subcontracting
The Contractor shall notify the Contracting Officer as part of their solicitation response of any subcontract arrangement. The subcontractor shall have the experience and be equipped for such work. The written notification shall include as a minimum:
(a) The name, address, UEI number and telephone number of the subcontractor
(b) The date upon which the subcontract was entered into and its duration
(c) A detailed description of the work being subcontracted including a list of contract items, units, etc., as appropriate.
(d) Documentation of the subcontractor's representative authority. Subcontracting any portion of the contract shall not relieve the Prime Contractor of any responsibility under this contract. Any subcontract agreement shall contain all terms and conditions of the prime contract.

(ix) FAR 52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021) (Provision)
(a) The Government will award a Firm-Fixed Price contract resulting from this solicitation to Vendor whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. (b) The Government will select the quote that represents the best benefit to the Government to fulfill the requirement based on the judgment of the contracting officer and Forest Service users.

(4). The Government may ask questions to one or more submitters but is not obligated to do so.
(5). The Government may reject all offers.
(6). The contracting officer and Forest Service users may use any means available to examine the Vendor’s past performance.
(c) A written notice of the award or acceptance of an offer, will be emailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party, unless a written notice of withdrawal is received before the award.

FAR 52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (NOV 2021) (Provision)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at FAR 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at FAR 52.212-3, Offeror Representations and Certifications- Commercial Products or Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at FAR 52.204-26, or in paragraph (v)(2)(ii) of the provision at FAR 52.212-3.
(a) Definitions. As used in this provision—
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause FAR 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) ( https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".
(d) Representation. The Offeror represents that—
(1) It ☐ will, ☐ will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that—

(e) Disclosures. (1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment—
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services—
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained:
Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment—

(a) The Contractor shall comply with the following Federal Acquisition Regulation (FAR) clauses, which are incorporated in this contract by reference, to implement provisions of law or Executive orders applicable to acquisitions of commercial products and commercial services:
(1) FAR 52.203-19, Prohibition on Requiring Certain Internal Confidentiality Agreements or Statements (JAN 2017) (section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235) and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions)).

(d) Comptroller General Examination of Record. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
