Dumpster Services Kansas City, MO

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

(ii) Solicitation number 12FPC423Q0095 is issued as request for quotation (RFQ). The acquisition procedures at

FAR Part 13.5 are being utilized.

The Government anticipates issuing a firm fixed price commercial services contract with a base and one option year, the later subject to the availability of funds. Award will be made to the responsible quoter whose quote responds to the terms of the RFQ and is the Lowest Price Technically Acceptable (LPTA) quote to the government.

Pricing will be evaluated to determine reasonableness once quotes have been determined technically acceptable by the

Government. For evaluation purposes, the total evaluated price is the sum of the base and option line items.

Pricing that is unrealistically low may be considered an indication that the Quoter does not possess adequate understanding of the requirement or the requisite technical capability to successfully perform the work.

(iii) This solicitation documents and incorporates provisions and clauses are those in effect through Federal Acquisition

Circular 2023-04, effective June 2, 2023.

(iv) This requirement is being 100% set aside for small business participants only. The applicable NAICS code is

562111 Solid Waste Collection - which has a size standard of $47 million. For more information on size standards visit http://www.sba.gov/size. Active SAM.gov registration is required in order to be awarded the contract and must me active throughout the period of performance. Interested quoters must provide proof of active SAM.gov registration.

(v) Prices shall be listed for each Contract Line Item Number (CLIN) of this RFQ. Please refer to Attachment 3 - Price

Sheet.

(vi) Description of the services include providing Waste Collection Services for the National Resource Conservation

Service (NRCS) USDA FPAC Mission Support Division, Kansas City, MO. Please refer to the specification in this package. Attachment 1, Statement of Work (SOW) of required working area are incorporated and made a part of this Solicitation. Price includes all costs, materials, labor, supervision, including travel. Review the detailed description of the services and deliverables required.

A site visit is scheduled for Wednesday, August 9th, 2023, between 9:00am and 12noon, located at USDA FPAC

Management Services Division, 2312 East Bannister Road, Kansas City, MO 64141. Contact Ralph Garcia Jr at

816-730-7938 for additional directions.

(vii) Responses are due on Monday August 14th, 2023 no later than 2:00 pm, Eastern Time. Please send your quote via email to the Contract Specialist, Jill Craft at jill.craft@usda.gov . Interested vendor is responsible for ensuring that the documents are submitted in a timely manner as to reach the destination before the closing time.

Responses received after the above time will not be considered for award.

(viii) Services shall be performed in Kansas City, MO. Service to begin by September 1, 2023.

The provision at 52.212-1, Instructions to Offerors—Commercial, applies to this acquisition. The following addenda also apply. Offerors must read and follow these additional instructions to receive consideration:

a. Technical Narrative

Quoters should submit a written narrative that thoroughly addresses the requirements of the SOW. The quoter must provide a narrative that adequately describes the quoters experience and plans for executing the work, including resources and personnel available to meet the required services. The narrative should be supported by evidence that gives credibility to the statements made by the quoter and in turn gives the Government enough information to understand and gain confidence in what the quoter is stating. The narrative should be no longer than 2 pages.

b. Past Performance should include 3 professional references with contact name, address, e-mail, and phone number.

c. Copy of the Missouri DOT license/insurance.

(xi) The Government intends to make an award based on the Lowest Price Technically Acceptable process. In order to be considered Technically Acceptable, a contractor must provide the following information and provide information as to their capability to complete the work as required. The price quote must include the following documents.

1. Amendments signed, if any

2. Attachment 2 - Certifications

3. Attachment 3 - Price Sheet

4. Narrative/Past Performance

5. Quoters must also provide a copy of the Missouri DOT license/insurance to be considered.

Quoters who provide the required information will be considered for award. Failure to provide the information stated will result in not being considered for award.

Award will be made to the firm who has been found technically acceptable and has provided the lowest price.

10th, 3:00PM ET 2023.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-

Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the

Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. 52.217-9 Option To Extend the Term of the Contract. (MAR 2000)

(a) The Government may extend the term of this contract by unilateral written modification to the Contractor prior to award expiration provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 45 calendar days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 2 years subject to the availability of funds.

FAR 52.242-15 STOP-WORK ORDER (AUG 1989)

(a) The Contracting Officer may, at any time, by written order to the Contractor, require the Contractor to stop all, or any part, of the work called for by this contract for a period of 90 days after the order is delivered to the Contractor, and for any further period to which the parties may agree. The order shall be specifically identified as a stop-work order issued under this clause. Upon receipt of the order, the Contractor shall immediately comply with its terms and take all reasonable steps to minimize the incurrence of costs allocable to the work covered by the order during the period of work stoppage. Within a period of 90 days after a stop-work is delivered to the Contractor, or within any extension of that period to which the parties shall have agreed, the Contracting Officer shall either—

(1) Cancel the stop-work order; or

(2) Terminate the work covered by the order as provided in the Default, or the Termination for Convenience of the

Government, clause of this contract.

(b) If a stop-work order issued under this clause is canceled or the period of the order or any extension thereof expires, the Contractor shall resume work. The Contracting Officer shall make an equitable adjustment in the delivery schedule or contract price, or both, and the contract shall be modified, in writing, accordingly, if—

(1) The stop-work order results in an increase in the time required for, or in the Contractor’s cost properly allocable to, the performance of any part of this contract; and

(2) The Contractor asserts its right to the adjustment within 30 days after the end of the period of work stoppage;

provided, that, if the Contracting Officer decides the facts justify the action, the Contracting Officer may receive and act upon the claim submitted at any time before final payment under this contract.

(c) If a stop-work order is not canceled and the work covered by the order is terminated for the convenience of the

Government, the Contracting Officer shall allow reasonable costs resulting from the stop-work order in arriving at the termination settlement.

Agriculture Acquisition Regulation (AGAR) Provisions and Federal Acquisition Regulations

452.204-70 MODIFICATION FOR CONTRACT CLOSEOUT (Deviation July 2022)

(a) If unobligated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

(b) If unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature. (The CO may also request a Release of Claims be completed by the contractor, although not required for contract and orders using SAP procedures.) If the bilateral modification and Release of

Claims are not returned to the CO within 60 days, the CO shall release the modification as unilateral and proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

1 INTRODUCTION

The U.S. Department of Agriculture (USDA) Farm Production and Conservation (FPAC), Natural Resources Conservation Service at Kansas City, MO requires waste collection services via a 40-yard roll off dumpster.

1.1 Mission

The FPAC-Business Center mission is to deliver conservation solutions so agricultural producers can protect natural resources and feed a growing world.

1.2 Background

The U.S. Department of Agriculture (USDA) Farm Production and Conservation

(FPAC) requires waste collection services at the 2312 East Bannister Road, Kansas City, MO 64141 location.

1.3 Scope of Work

The contractor shall provide waste collection services. The contractor shall provide a standard commercially available 40-yard roll on / roll off dumpster with a maximum weight limit of 12,000 to 16,000 pounds. Weight limits do vary, however, based on the type of material being put into the container. Contractor shall track and report to the FPAC MSD

POC all container weights and number of services provided during the month. The Contractor shall perform services IAW approved scheduled pick-up calls and respond to calls for service when dumpsters reach full before scheduled pick-up.

The Contractor shall provide 3 dumps each month with the average weight of the material to be

~8,000lbs. However, more dumps may be needed depending on the waste levels. The dumpster is to be delivered to the west dock entrance and placed in coordination with USDA

Staff onsite.

The Contractor shall remove and properly dispose of nonhazardous materials that are not otherwise cost efficient to recycle. Contractor will secure the load to and from the waste disposal site and will keep dumpster at the contracted location until the end of the contract

The Contractor shall ensure that the dumpster is in good working conditions during the period of performance of this requirement. The Contractor shall evaluate the condition of collection recycle/refuse containers on a quarterly basis and provide this information via email to USDA technical POC. Deteriorated waste containers shall be replaced or repaired by the Contractor at no cost to the Government. The Contractor shall replace unsafe containers within two (2) working days of receiving notification. The Contractor shall furnish replacement containers when containers are removed for cleaning, painting, maintenance, or repair.

The Contractor shall pick up all spillage resulting from emptying of container and compacting of solid waste, recycle material, or other activity. Complaints regarding unsanitary conditions due to Contractor negligence shall be corrected by the Contractor within two (2) hours of notification. All solid waste container tops, lids, and doors shall be closed after emptying and shall be in good working conditions.

2 GENERAL REQUIREMENTS

2.1 Non-Personal Services

The Government shall neither supervise Contractor employees nor control the method by which the Contractor performs the required tasks. Under no circumstances shall the

Government assign tasks to, or prepare work schedules for, individual Contractor employees, except for the site lead. It shall be the responsibility of the Contractor to manage its employees and to guard against any actions that are of the nature of personal services or give the perception of personal services. If the Contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the Contractor’s responsibility to notify the Contracting Officer, in writing, immediately.

2.2 Contractor Personnel Qualifications

Be professional, trained and insured to perform waste collection services for the federal government.

2.3 Contractor Key Personnel

The Contractor shall assign to this contract the following key personnel (suggested personnel):

2.4 Location and Hours of Work

2.6 Invoicing

Invoices shall be submitted monthly after services are provided. Payment will be processed in accordance with FAR Clause 52.212-4. Invoices must be submitted electronically through the Invoice Processing Platform (IPP) system. In addition to the information required by

FAR 32.905(b) each invoice must contain a breakdown of the total amount. Invoices and supporting documentation shall be uploaded into the IPP system.

2.7 Identification of Contractor Personnel

Contractor employees must always have company identification on while performing tasks of this contract.

3 REQUIREMENTS/TASKS

3.1 Task One – Drop Off and Set Up 40-foot Rollaway Dumpster.

3.2 Task Two- Haul rate for pick-up. (3x during monthly intervals) Vendor to be notified for pick-up and disposal requests.

3.3 Task Three-Disposal Rate Cost Per Ton. Submit TARA weight with certificate with each invoice within 10 calendar days of job completion.

5.SPECIAL REQUIREMENTS

5.1 Security

The contractor employees are required to have a company identification tag on at all times during the performance of this work.

5.2 Government Furnished Property (GFP, Equipment (GFE), Information (GFI), and/or Services

This contract does not require the contractor to be issued any government furnished property, equipment or information. Contractor must furnish all equipment, licenses, and insurance for the duration of the performance period of this contract.

Contractor furnished containers shall be in a serviceable condition upon placement and remain in a serviceable condition during the term of the contract.

5.3 Insurance

The table below lists the kinds and minimum amounts of insurance required, as referenced in contract clause FAR 52.228-5 (Insurance–Work on a Government Installation).

In addition, the contractor must provide coverage for any other risks as deemed appropriate, since the Government is not indemnifying the Contractor against any risks under the contract. A current duplicate (not machine reproduced) certificate of insurance must be submitted to the Contracting Officer (CO) for approval before the Contractor begins work under this contract duplicates of renewal certificates (not machine reproduced) obtained by the CONTRACTOR during the life of this contract must immediately be provided to the

CO. Also, see the cause, "Insurance Additional Named Insured" below.

The insurance policy must contain an endorsement that any cancellations or material decreases in the coverage’s shall not be effective, unless the insurer or the Contractor gives advance written notices of cancellations or changes in accordance with the CO's instructions.

All premiums or costs incurred to comply with these insurance requirements will be paid by the Contractor. If the Contractor already has an organizational policy in effect, the CO requires evidence that it satisfies all the above stated requirements. The Contractor is required to provide such evidence as deemed necessary by the Contracting Officer before a notice to proceed with contract performance issued. The Government reserves the right to disapprove the purchase of any insurance coverage not in the Government's interest.

This contract requires that all insurance coverages be kept in full force and effect until all contract work is completed; the insurance requirements also apply to subcontractors.

The Government will not be responsible for any losses, damages, or liabilities beyond the amounts, limits, and conditions of the above-required insurance.

The requirement of contract clause 52.228-5 is hereby supplemented to provide that the general liability policy shall name "The United States of America, acting by and through FPAC Business

Center”, as an additional insured with respect to operations performed under this contract.

52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or

Equipment. (Aug 2020)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or

Services—Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and

Certifications-Commercial Items.

(a) Definitions. As used in this provision—

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video

Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019

(Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i)Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii)Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year

2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a

Federal contract. Nothing in the prohibition shall be construed to—

(i)Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii)Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award

Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for

“covered telecommunications equipment or services”.

(d) Representation. The Offeror represents that—

(B)A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C)Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii)For covered services—

(A)If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as
