This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the information in FAR Part 12, Acquisition of Commercial Items, using Simplified Acquisition Procedures under the test program for commercial items found at FAR 13.5, as supplemented with the additional information included in this notice. This announcement constitutes the only solicitation. PAPER COPIES OF THIS SOLICITATION WILL NOT BE AVAILABLE. This combined synopsis/solicitation shall be posted on The Official U.S. Government System for Contract Opportunities at SAM.gov. The Request for Quotations (RFQ) number is N4215823Q0035.
This solicitation documents and incorporates provisions and clauses in effect through FAC 2023-04 and DFARS Change 09 June 2023. It is the responsibility of the contractor to be familiar with the applicable clauses and provisions. The clauses may be accessed in full text at these addresses:

The NAICS Code is 336611- Ship Building and Repairing and the size standard is 1250 employees. The Product Service Code is J091 (Maintenance, Repair and Rebuilding of Equipment: Fuels, Lubricants, Oils, and Waxes). This acquisition is a total Small Business Set-Aside.
Naval Sea Systems Command (NAVSEA), Norfolk Naval Shipyard (NNSY) intends to award a Firm Fixed Price (FFP) Single Award Contract, for software license reinstatement and renewal, to provide critical data for the carriers and submarines undergoing repairs at each of the four naval shipyards.
The period of performance for this acquisition is anticipated to begin 01 August 2023 through 20 September 2023.
The solicitation, any documents related to this procurement, and all amendments issued will be in electronic form.
The solicitation is available and posted to this site with a close date of 20 July 2023 at 01:00PM EST (Eastern Standard Time).

Prospective Offeror’s are responsible for downloading their own copy of the solicitation and for frequently monitoring the SAMs website for solicitation amendments. The Government is not responsible for inability of the Offeror’s to access solicitation documents posted. All responsible sources may submit a proposal which shall be considered by the Government. By submitting a proposal, the offeror will be self- certifying that neither the principal corporate officials nor owners are currently suspended, debarred, or otherwise ineligible to receive contracts from any federal agency. Failure to do so may represent grounds for refusing to accept the proposal. By submission of a proposal, the offeror acknowledges the requirement that a prospective awardee must be registered in the System for Award Management (SAM) database will make an offeror ineligible for award, during performance, and through final payment of any contract resulting from the solicitation, except for awards to foreign vendors for work to be performed outside the United States.

Scope:
1.1 Accomplish a shipboard remediation (Particulate Contamination) of approximately 1500 gallons of Mil-
H-22072 Hydraulic Fluid, Catapult NATO Code Number H-579 on Catapult 1 and Catapult 3.

3. Contractor Responsibilities:
3.1 The Contractor shall provide a Process Control Procedure (PCP) IAW NAVSEA Standard Item 009-09 of applicable document 2.1.
3.2 Contractor shall use the specified revisions of technical documents to agree with the requirements of the Authorized Work Package. Arbitrary use of revision available is not acceptable
3.3 The Contractor shall adhere to all security requirements for Norfolk Naval Shipyard specified in applicable document 2.4 and Safety, Health and Environment (OSHE) requirements specified in applicable document 2.5
3.4 The Contractor shall develop and complete all paperwork, including but not limited to Technical Work Documents (TWDs), Test Documents, Condition Reports, and request forms.
3.5 Any request for deviation or waiver of any technical requirement shall be submitted by the Contractor as described in 009-01 of reference 2.1.
3.6 Contractor shall provide all equipment, rigs, adapters, pumps, and hoses necessary to accomplish tasked work.
3.7 Waste shall be handled IAW Reference 2.5.
3.8 Contractor to maintain existing system Level II cleanliness IAW NAVSEA Standard Item 009-107
3.9 Contractor to inspect any temporary storage tanks used to hold MIL-H-22072 Hydraulic Fluid prior to use. Acceptance Criteria: Free of debris and foreign material.
3.10 Maintain communication with NNSY during each aspect of the Hydraulic Fluid Reclamation via Daily
Progress Reports. (CDRL A001).
3.11 Acceptance Criteria and Reportable Information for MIL-H-22072C, Hydraulic Fluid, Catapult, NATO
Code Number H-579.
3.11.1 Reprocessed Hydraulic Fluid, Catapult, NATO Number H-579 IAW MIL-H-22072C shall meet the following requirements IAW Ref. 2.3 Particulate contamination: AS4059 Class 11 Max
3.11.2 The final report for the reprocessed Hydraulic Fluid, NATO Number H-579 IAW MIL-H-
22072C, shall include test results for the following characteristics, compared to the following nominal values:
Particulate contamination: AS4059 Class 11 Max Water Content: 45% - 50% (Report Only)
Viscosity: 41-51cSt @ 104 F (Report Only) pH: 8.0 to 9.8 (Report Only)
3.12 Contractor shall certify that the reprocessed hydraulic fluid meets the defined limits as listed in paragraph 3.11.1 for particulate contamination only after reclamation efforts are accomplished
3.13 Contractor shall email a copy of Final Report and Certificate of Analysis to the NNSY Code 432 designated representative within one (1) business day of knowing results, for approval. This report shall detail the contamination removal trend and provide quantitative fluid cleanliness results as certified by an independent ISO 9000 laboratory. Norfolk Naval Shipyard will provide approval/disapproval of test results within two (2) business days. (CDRL A002)
3.14 Per FAR 22.102-1(a) entitled “Safety”, Contractors are hereby informed that their employees or representatives present on property under Norfolk Naval Shipyard cognizance must follow Federal and State OSHA requirements; Norfolk Naval Shipyard OSHE Program Manual, NAVSHIPYDNORINST P5090.2 requirements; OSHE Control Manual (OSHECM) requirements; or safety requirements for site specific location of the contract.
3.15 Contractors and Non-NNSY Government Agencies (NNGAs) are hereby informed that their employees or representatives present on property under Norfolk Naval Shipyard (NNSY) cognizance must adhere to Federal OSHA requirements for hazardous energy control IAW 29 CFR 1915.89 and must follow Hazardous Energy Control (HEC) procedures as identified in NAVSEA’s Occupational Safety, Health, and Environment Corporate Manual (OSHECM) Chapter 250 (latest revision), when performing work under NNSY contract. All HEC work to be performed by Contractors and NNGAs requires that NNSY Technical Points of Contact (TPOCs) and/or Contracting Officer’s Representatives (CORs) be notified of the HEC scope of work prior to starting work. Any changes or deviations in the initial scope of HEC work requires the NNSY TPOCs and/or CORs be informed of the change/deviation. Appendix 250.B-1 through B-3 of OSHECM Chapter 250 for multiple employer work identifies when Contractors and NNGAs are required to assign their Lockout/Tags-Plus Coordinator (LOTC) to coordinate HEC work with the cognizant NNSY LOTC. HEC locks shall be provided by the contractor or NNGA for their employees use. The HEC locks shall have red bodies with name labels or name tags affixed, identifying who installed the HEC lock(s) and a point of contact telephone number. HEC lock name labels and tags must be made of materials that will hold up to the environment to which they are exposed. HEC tags used for Tags-Plus HEC work shall be provided by the cognizant NNSY LOTC to the contractor or NNGA for their use if machinery, equipment, or systems (MES) cannot be locked out. OSHECM Chapter 250 Tags-Plus procedures will be strictly followed.
3.16 Contractors and NNGAs may obtain electronic copies of OSHECM Chapter 250 (latest revision) and access the OSHA 1915.89 web site by using the following link to NNSY’s public access web site:

4. Government Responsibility:
4.1 Crane services for mobilization of contractor’s equipment and supplies on and off vessel. Note:
Contractor must provide lift requests to NNSY Project Team in accordance with current NNSY Project lift request guidelines. As Required
4.2 NNSY or Ship’s Force (Option of the NNSY Project Team) will handle the pumping of the MIL-H- 22072C from the CAT 1 hydraulic system to the contractor’s staging area on the Flight Deck.
4.3 NNSY or Ship’s Force (Option of the NNSY Project Team) will handle the pumping of the MIL-H- 22072C from contractor’s staging area on the Flight Deck back into the CAT 1 hydraulic system.
4.4 New System Filters, Gaskets, O-Rings, and make-up Hydraulic Fluid as required. Note: Contractor will process for reuse all fluids available from the Catapult system current volume (at the time of project), some minor loses in recoverable volume will occur. As Required
4.5 Laydown area for Contractor’s equipment. As Required
4.6 Low Pressure (LP) Air Services (approx. 100 psig) As Required
4.7 Electrical power for equipment. The contractor shall use temporary service request form NNSY
9900/12 for requests. As Required
4.8 Fork lift available to assist in Unloading/Reloading equipment. Contractor must provide notice to the
Work Integration Leader/Zone Manager that a forklift with operator is required. Note: Ship’s Force may provide these services at the option of the NNSY Project team. As Required
4.9 Restroom facilities as needed for duration of service. As Required
4.10 Disposal of all generated waste (fluids, filters, oil absorbents). As Required
5. Request for Base Access
5.1 Defense Biometric Identification System (DBIDS):
5.1.1 Any new contractor, vendor or supplier requesting base access AFTER 31 May 2017 will be required to obtain a DBIDS credential. NCACS credentials will no longer be issued.
5.1.2 Only DBIDS credentials will be issued to ALL contractors, vendors and suppliers seeking base access AFTER 14 August 2017.
5.1.3 Defense Biometric Identification System (DBIDS) increases installation security and communications by receiving frequent database updates on changes to personnel/credential status, law enforcement warrants, lost/stolen cards, and force protection conditions. The system provides a continuous vetting anytime the DBIDS card is scanned at an installation entry point.
5.2 NCACS Card Holders
5.2.1 If you currently have a Navy Commercial Access Control System (NCACS) card, the following is required to get a DBIDS credential.
5.2.1.1 Present your NCACS Card and a completed copy of the SECNAV FORM 5512/1 to the base Visitor Control Center representative.
5.2.1.2 The VCC will pull up your information in the computer, ensuring all information is current and correct.
5.2.1.3 Once your information is validated, a temporary DBIDS credential is provided.
5.2.1.4 Your temporary credential will have an expiration date, prior to which you will need to obtain your permanent DBIDS credential (~ 90 days).
5.2.1.5 For each additional U.S. Navy installation to which you need access, the first time you visit you only need to bring your DBIDS credential and statement of purpose for base access when arriving at the Visitor Control Center.
5.2.1.6 The representative will enter base access authorization and then you may proceed to work.
5.3 Non-NCACS Card Holders
5.3.1 If you do NOT have an NCACS Card, the following is required to obtain a DBIDS credential:
5.3.1.1 Present a letter or official document from my government sponsoring organization that provides the purpose for your access.
5.3.1.2 Present valid identification, such as a passport or Real ID Act-compliant state driver's license.
5.3.1.3 Present a completed copy of the SECNAV 5512/1 form to obtain your background check.
5.3.1.4 Upon completion of the background check, the Visitor Control Center representative will complete the DBIDS enrollment process, which includes your photo, finger prints, base restrictions, and several other assessments; after all this is done, you will be provided with your new DBIDS credential.
5.3.1.5 You may now proceed to work.
5.4 Non-Participants
5.4.1 One-Day Passes: Participation in the DBIDS is not mandatory, and if the Contractor chooses to not participate, the Contractor's personnel will have to obtain daily passes, be subject to daily mandatory vehicle inspection, and will have limited access to the installation. The Government will not be responsible for any cost or lost time associated with obtaining daily passes or added vehicle inspections incurred by non-participants in the DBIDS.

INSTRUCTIONS TO OFFERORS
In addition to FAR 52.212-1, “Instructions to Offerors – Commercial Items”, the following information shall be received by NAVSEA Service Contracts Division, Norfolk Naval Shipyard no later than the closing date of the Solicitation.
This requirement will be awarded using procedures under Federal Acquisition Regulations FAR Part 12 – Acquisition of Commercial Items and FAR Subpart 13, Simplified Acquisition Procedures.
Quotes are due on or before 07/20/2023 at 01:00PM Eastern. Quotations shall be emailed to Contract Specialist, Rebekah Riggins, rebekah.r.riggins.civ@us.navy.mil.
1. Proposal content and instructions when submitting a quote shall consist of:
a. Technical Acceptability
b. Price Submission
c. Acknowledgement of any amendments
- Technical Acceptability: Each Vendor shall provide proof/certification that they are in compliance with the required certifications and qualifications outlined within the Statement of Work (SOW) included within the solicitation. The information provided should be presented in such a manner as to enable the government to make a thorough and complete evaluation and arrive at a sound determination as to whether or not the service proposed and described will satisfy the requirements of the Government as stated in this request for quote. It is the contractor’s responsibility to ensure that their quotation clearly demonstrates their ability to perform these requirements.

Failure to meet any technical requirement for an item (or specification) will make the quotation unacceptable for that item (or that specification).If an item (or specification) is technically unacceptable, its price will not be considered for award.
- Price Submission: The vendor’s proposed price will be evaluated on the basis of price reasonableness.
All prices must be considered fair and reasonable as determined by the Government. All quotes submitted in response to this solicitation shall stand firm for sixty (60) calendar days from the response date of this solicitation. The estimated amount for each line item will be added together to determine the total estimated price which will become the evaluation price. Signed copies may be submitted via electronic submittal at rebekah.r.riggins.civ@us.navy.mil.
- Acknowledgement of any amendments: Vendors shall submit one original signed copy of the completed Standard Form (SF) 1449, and if applicable, executed copies of all Amendments, and executed Representations and Certifications.
2. Each offeror must provide the following information with the quote:
1. The Request for Quotes (RFQ) number;
2. The Name, Address, Telephone Number, and Cage Code or Duns number of the offeror;
3. Include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the RFQ. Proposals that reject the terms and conditions of the RFQ may be excluded from consideration;
4. Acknowledgment of Solicitation Amendments (SF-30), if any;
5. Completed FAR 52.212-3 Representations and Certifications unless otherwise completed in SAM;
6. Confirmation of the ability to meet the period of performance as contained herein;
7. Provide a technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. Technical Submission including but not limited to equipment specifications, manuals, and photographs.
The completion and submission of the above items will constitute a quote and will be considered the vendor’s unconditional assent to the terms and conditions of this Solicitation and any attachments and/or exhibits.
Failure to provide all of these documents by the required date and time may preclude a quotation from award consideration at the discretion of the Government.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that--

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
The Government intends to award a single, Firm-Fixed Price (FFP) type contract to the responsible offeror whose proposal represents the lowest price technically acceptable after evaluation in accordance with the factors in the solicitation. The offeror’s proposal shall be in the form prescribed by, and shall contain a response to each of the areas identified in solicitation provision FAR 52.212-1 entitled “Instructions to Offerors-Commercial Products And Commercial Services” and its Addendum.
The Government intends to award the contract without discussions. The establishment of a competitive range is not anticipated. Accordingly, each Offeror should submit its most favorable terms from a price and technical standpoint.
However, the Government reserves the right to establish a competitive range and conduct discussions if later determined by the PCO to be necessary. Failure to provide the information required by 52.212-1 and its addendum may result in the offeror’s quote being deemed unacceptable and ineligible for award. The information required by 52.212-1 and its addendum is necessary for the government to properly evaluate the offeror’s quote.
The evaluation of proposals will consider the technical acceptability to be more important than the price.
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
