About this file

This is a Sole Source Request form (24-103-205, C.R.S.) submitted by the Colorado State Patrol (CSP) Division requesting continuation of services with the Motorcycle Safety Foundation (MSF) for the Colorado Motorcycle Operator Safety Training (CO MOST) program. The request seeks approval to extend the existing contract with MSF to administer NHTSA-compliant motorcycle rider training courses, including curriculum development, instructor training, program promotion, and a Quality Assurance component. The vendor will maintain a Quality Assurance Team of minimum six members to conduct Quality Assurance Visits at training sites, ensure compliance with program standards, and address noncompliance issues. The contract period runs from July 1, 2026, through June 30, 2027, with a total estimated cost of $720,000 in services. No specific response dates, bidder conferences, or site visits are referenced in the request.

The sole source justification centers on statutory requirements established by HB 24-1021 and HB-26-1394 from the 2024 Legislative Session, which increase the number of required CO MOST course participants beginning in 2026 and mandate the CSP's continued administration of the program. MSF's curriculum is the only available option that allows instructor training and recertification to occur within Colorado, avoiding the expense and logistical burden of sending instructor candidates out of state. No comparative price analysis was conducted, as the statutory nature of the requirement precludes competitive pricing evaluation; however, prices have remained consistent for seven years without adjustment for student volume or inflation. The State intends to conduct a formal procurement process through a Request for Proposal during the contract period to identify alternative vendors for future years. A fiscal rule waiver would be required if the vendor relationship extends beyond five years total.

A sole source procurement is justified when there is only one good or service that can reasonably meet the need and there is only one vendor who can provide the good or service. A requirement for a particular proprietary item (i.e., a brand name specification) does not justify a sole source procurement if there is more than one potential bidder or offeror for that item. Note: All sole source requests will be posted on an electronic procurement system in accordance with §24-106-103(5) C.R.S.

Procured Goods Response: Contractor administered the Colorado Motorcycle Operator Safety Training (CO MOST) program, consisting of approved motorcycle rider training courses, motorcycle course instructors, program promotion, and promotion of public awareness.
Description of Goods/Services: The vendor will provide a curriculum that is NHTSA compliant. In addition, the vendor will provide a Quality Assurance component, where MSF conducts reviews of all site administrators and contract with the sites that meet MOST criteria. This is done to ensure the continuance of MOST standards of quality, consistency, and customer service. The MOST Quality Assurance (QA) program draws from current and certified MOST Instructors, MOST Instructor Trainer Trainers, Site Managers, and other qualified individuals in Colorado. The vendor will develop and maintain a QA Team (QAT) of a minimum of six members, which includes the project manager. The Program Coordinator will be on the team, but will not count toward the minimum number. Reports of the visits, with a completed Quality Assurance Visit (QAV) form, will be forwarded to the MOST Project Manager and CSP for review upon request. Other services to be provided include a Quality Assurance Visits (QAV), as well as QA work that identifies and provides steps to address any noncompliance issues related to the Policy and Procedure Manual. The CO MOST Program is to provide approved curriculum to obtain a Motorcycle endorsement through basic rider courses.
Description of Goods/Services #2:
Start Date: 07/01/26
End Date: 06/30/27
G3 Text Bpx: There are statutory changes that were adopted in the 2024 Legislative Session that go into effect in CY 2026, that will increase the number of people required to complete a CO MOST course (HB 24-1021). In addition to this, there are new personnel and leadership in the CO MOST Program with a deeper commitment to fiscal rule and policy adherence. The stability and longevity of the program is also addressed via HB-26-1394, thus creating a need for this program to meet statutory obligations.
G1 Text Bpx: A fiscal rule waiver would be requested for an extension of a contact beyond five years. This would be the only available option for the State to adhere to its statutory obligation to administer this program. During the duration of this sole source, the Department will solicit an RFP for these services in subsequent years.
F1 Text Bpx: There is a continuation of services to meet a statutory requirement given to the Colorado State Patrol. As a sole source, instructors are able to be trained within Colorado, and re-certification training is also able to be completed within Colorado. The Colorado State Patrol will actively engage in a procurement process to solicit a vendor who will be awarded a State contract during the time frame of this sole source.
E4 Text Box: 1. Prices are not able to be compared as there is a statutory requirement for the Colorado State Patrol to administer and provide training to people that are seeking a Basic Rider Course (BRC) that includes approved curriculum, track time, and classroom instruction. The prices paid to the vendor have been consistent for seven years with no adjustment for total number of students or any accounting for the rate of inflation. 2. See the answer listed in #1. 3. The curriculum allows instructors to train in Colorado. Other national curricula would necessitate sending instructor candidates out of state for both training and re-certification.
