SUBJECT: Contracting Officer’s Determination that Circumstances of the Contract

REFERENCE: FAR 13.106-1(b), Soliciting from a single source
Federal Acquisition Regulations (FAR) FAR13.106-1(b) states: “Soliciting from a single source (1) For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand- name or industrial mobilization). Below are the rational that lead the Contracting Officer (CO) to determine circumstances to solicit from only one source, H-11 Digital Forensics
1. The purpose of this procurement is to purchase equipment for the use in Center Advanced training in the Cyber Division specifically, to be used by and issued to students in the Hardware Data Acquisition Training Program (HDATP) at the Glynco facility has been identified as being essential officers and agents who attend FLETC’s training programs.
The government cannot accept any alternative version of the request Brand Name. The current request is the only approved version for used to support FLETC’s training mission.
2. TAG, ISP, and Chip-off programmers that support a variety of different chips that are found on mobile devices, IoT, vehicles, etc. must be tested and validated by vendor for accuracy and reliability and the follow up support.
3. Tools such as a micro miller station for milling chip off of board must be tested and validated by vendor. Insufficient models can damage the boards information rendering them useless and destroying all evidence contained within.
4. Vendor to provide training on the proper use of the equipment and any future updated equipment as well. Must be subject matter expert of the tested and validated equipment by vendor.
H-11 Digital Forensics Inc has been identified as the only responsible source that can provide the required items listed in paragraph 1 above.
5. Evaluation of Other Potential Sources are as follows:
a. A GSA Advantage search was conducted for the items. Results were no vendor offers these items.
b. A search was conducted under LCI and again no vendor offers these items.
c. A google search was performed and two (2) other companies sold similar items.
Based on the information above, it has been determined by the CO that an award to H-11 Digital Forensics, Inc for H-11 DEK, MP-11-ADPT and H-11 Certified Chip-Off Training under FAR 13.103-1(b) is in the best interest of the Government.
