About this file
This is Amendment No. 3 to DEP Contract No. HW557, a state contract between the Florida Department of Environmental Protection (DEP) and ARCADIS U.S., Inc. The amendment was executed on August 28, 2013, by ARCADIS and September 11, 2013, by the DEP. The original contract was entered into on December 23, 2010, with previous amendments dated May 9, 2011, and March 6, 2012. Teresa Booeshaghi serves as the DEP Contract Manager responsible for contract administration and execution authority.
The amendment increases the contract funding increment by $1,177,573.04, raising the total contract amount from $3,736,676.79 to $4,914,249.83. The amendment adds performance-based language establishing requirements for satisfactory deliverables, including provisions for re-performance of unsatisfactory services at no additional cost within thirty days of notification. It establishes a corrective action plan (CAP) process with specific timelines: contractors must submit CAPs within ten calendar days of receiving a Department notice of deficiency, the Department has ten calendar days to approve or reject the CAP, and contractors have ten calendar days to commence implementation. The amendment reserves the Department's right to terminate the contract for failure to perform, request additional remedial steps, or require implementation of CAPs within a sixty-day timeframe. These provisions apply to all goods and services delivered under the contract.
