SUPPLEMENTAL GENERAL CONDITIONS

PART 1 - GENERAL

1.1 CMS Campus and Back On Campus Phase 02

A. The CMS Headquarters Campus is located at 7500 Security Boulevard, Woodlawn, Maryland. Federally owned and operated, the campus comprises approximately 57.4 acres, four (4) primary interconnected buildings containing approximately 928,292 gross square feet, and 2,961 surface parking spaces. The buildings are located on the central portion of the site and were built in 1995. The remainder of the site is green space, portions of which are designated as wetlands and a wildlife refuge. Outdoor dining, walking trails, and benches are available to the buildings’ occupants. Overall, the buildings and grounds are considered to be in good condition.

B. The Centers for Medicare and Medicaid Services (CMS) has an on-going Back on Campus initiative in support of the Department of Health and Human Services Reduce the Footprint mandate. Phase 02 of this consolidation program includes Central Building Level 2 (C2), Lower Level of the South building (SLL) and Lower Level of the Central building (CLL).

C. Throughout the construction, all Contractor work practices and plans must be coordinated and controlled to minimize impacts to occupant functions, building operations and security protocols.

1.2 CMS Building Operations

A. The provisions outlined in Divisions 1 sections are considered the minimum requirements for the Contractor while working around the building operations including Central Building Level 2 (C2), Lower Level of the South building (SLL) and Lower Level of the Central building (CLL). Contractor advanced planning, and detailed, approved work plans, as well as daily coordination are required.

B. The Contractor shall have limited use of the portions of the premises scheduled for construction operations. The Contractor shall coordinate use of the premises to the specific work portions to allow for Government occupancy. See also section 01110 Phasing.

C. Contractor personnel are generally not to enter through the main entrance. Access into the project site will be through the back side of the South Loading Dock entrances.

However, after 5:00pm, weekends and Government Holdiays, Contractor personnel will need to enter through the main entrance only. Also, unbadged Contractor personnel that require escorting by CMS badged Contractor must enter the site through the main

00 80 00 - 2 02/24/2022 entrance only. Security screening, identification, sign-in, and escort by a badged Contractor personnel is required.

D. The utility systems and equipment located within and throughout the Central Building Level 2 (C2), Lower Level of the South building (SLL) and Lower Level of the Central building (CLL) shall remain operational, functional and secured throughout the project duration. See also section 013100 for requirements and processes for utility service interruptions or outages necessary to complete the project.

E. Use of the existing loading dock facilities is generally permitted for hauling materials, equipment and debris to and from the CMS Back On Campus Phase 02 project.

Permission is granted by the GSA Building Manager on a case by case basis. The loading dock is not to be used for extended Contractor functions, such as dumpster and trash chutes. See also section 011400 for permit,restrictions and security screening requirements on use of existing loading dock throughout construction.

F. Building internal and external egress, corridors and stairways are to remain clear at all times.

1.3 SPECIAL BUILDING REQUIREMENTS

A. The Contractor shall provide secure, fire-rated temporary barriers to prevent Contractor personnel within the Central Building Level 2 (C2), Lower Level of the South building (SLL) and Lower Level of the Central building (CLL) from directly accessing all other CMS facilities adjacent to the site. Wall to be constructed from existing floor deck to underside of ceiling deck.

B. Trash chutes are not anticipated but if the Contractor intends on using, a detailed plan is required for review and approval. At minimum, trash chutes are not to be installed where building occupants are in place, next to windows or adjacent to exterior pedestrian egress or vehicle services roads.

C. Fire watch will be required when construction is ongoing. C2, SLL and CLL spaces will require fire alarm and sprinkler protection, egress signage, emergency lighting to be maintained at all times. Do not use cutting torches until work area is cleared of flammable materials. At concealed spaces, such as duct and pipe interiors, verify condition and contents of hidden space before starting flame-cutting operations.

Maintain fire watch and portable fire-suppression devices during flame-cutting operations. Contractor shall furnish suitable type, fully-charged, operable portable fire extinguisher to each fire watcher. The Contractor shall provide fire watchers who know how to operate the fire extinguisher, how to initiate a fire alarm and how to summon the fire department. Fire watch shall be maintained 30 minutes after any hot work.

D. Utility Outages:

1. Existing building utilities are operated and maintained by the GSA building management staff. All Contractor requests for utility service outages must be

00 80 00 - 3 02/24/2022 coordinated through the Construction Manager and approved by the Building Manager.

2. Contractor outage requests must be submitted no later than 15 calendar days in advance of the outage date.

3. Outages to existing fire alarm and/or fire protection systems will require 21 day advance notification.

4. The government will be responsible for supporting all necessary, planned utility outages. However, in the event of unplanned utility interruptions that are the result of Contractor actions, Contractor shall be responsible for the cost impacts to the government.

1.4 OPERATING HOURS FOR CONSTRUCTION ACTIVITIES

A. The Central Building Level 2 (C2), Lower Level of the South building (SLL) and Lower Level of the Central building (CLL) are secure, government facility that is operated 7-days per week/24-hours per day/365-days per year. CMS employees within the CMS Campus observe all federal holidays and any special announced events such as inclement weather curtailment or declared federal observances. In the event that the government closes the CMS Campus due to Inclement weather curtailments, all contractors must follow Government regulations.

B. Typical construction period operating hours shall commence no earlier than 6 am and conclude no later than 6:00 p.m. Monday through Friday. Extended hours of operations, as well as Saturday and Sunday and holiday working hours may be requested in writing in advance. Requests will be reviewed and approval may be granted based on project benefit by the CMa and Building Manager.

C. Extended hours of construction operations shall be performed at no additional cost to the Government. The following work shall be performed during Government Unoccupied Hours:

1. Noisy producing work that may disrupt tenant operations in adjacent spaces must be performed during off-hours or weekend schedules. Noise levels exceeding 65db or noise levels that are consistent will be considered disrupting tenant functions.

2. Odor-producing work that may disrupt tenant operations in adjacent spaces must be performed during off-hours or weekend schedules. Usage of a welding smoke eater machinery or ventilate blower properly installed to exhaust fumes outside the building maybe be allowed within the building during normal construction hours, pending GSA Building Manager review. See also section 017410 Construction Indoor Air Quality.

3. Utility outages affecting building operations or tenant functions shall be planned for off hours. Contractor outage requests must be submitted no later than 15 calendar days in advance of the outage date. GSA Building Management will approve and assist with all utility outage including piping drain downs and lock out of equipment outages. Coordination between CMa, GC and GSA Building

Management is required to include advanced planning at progress meetings and three-week look ahead to plan scheduled outage request. See also section 013100 for requirements and processes for utility service interruptions or outages necessary to complete the project.

4. Demolition activities on the Central Building Level 2 (C2), Lower Level of the South building (SLL) and Lower Level of the Central building (CLL) shall be performed during off-hours

1.5 CONTRACTOR STAGING/PARKING

A. The construction drawings indicate proposed space available for Contractor use.

These potential areas are at the back of lot “F” near the salt dome and at the north side of the North building beween the service road and building. Privacy mesh/screening and fencing around the staging area are required. Staging areas shall keep access to existing utility easements as well as access to existing services, such as salt dome, manholes, valve boxes, and electric hand holes.

B. Parking: Limited parking will be available on site as shown on the site plan. Contractor parking is confined to the available spaces within the designated contractor staging area. This is intended for the Contractor superintendent and/or project management staff.

1. For Contractor’s laborers, parking is available in the laydown or in the back of Lot F near the salt dome.

2. Contractors will be required to provide vehicle information to the designated GSA Field Office Building Manager for proper notification to CMS Security to allow Contractors to park on the Government property and access into the Center of Medicare and Medicaid Services Headquarters Facility (CMS HQ). This should be a consolidated list from the Contractor and the government anticipates additions and deletions as the project progresses.

3. Contractor parking is also allowed in visitor parking spaces, this is intended for personal vehicles. Contractor trucks and other work vehicles are intended to be parked within designated staging area. CMS Security will designate and control all contractors’ access on the CMS Campus as well as parking throughout CMS property.

C. Dumpster is anticipated inside of designated contractor staging but on a case by case basis may be allowed near building so long as there are no impacts to service road, occupied tenants, public egress, etc. Should dumpster or any other temporary construction be placed on CMS property, then the contractor will be repsonsbile for restoring this property to original condition.

1.7 CMS HEADQUARTERS FACILITY SECURITY

A. GSA and CMS Security requires all contractors, sub-contractors and anyone working or visiting the premises (via any project) to be HSPD-12 badged or maintain a visitors badge. Anyone with an HSPD-12 badge will complete a HHS-745 form (for CMS Badge) and HHS-745A Form (for Escort Privileges) and have their credentials entered into Department of Health and Human Services (HHS) and the CMS Security Access System for building access and will be allowed access throughout the building pending upon approval through the Security Access System.

B. Upon contract awardby GSA, General Contractor employees must start their CIW process to obtain HSPD-12 badges for all of their employees and sub-contractors. See also section 015930 for security requirements.

C. CMS Security requires 48 hour advance notice for all deliveries, the Contractor will be required to complete a Parking / Delivery request prior to any deliveries or the delivery will be denied. Minimum information required for notices incude all vehicle information and all passengers information if they are visitors. All individuals shall have proper identification.

D. All Contractor material and equipment deliveries to the Center of Medicare and Medicaid Services Headquarters Facility (CMS HQ) Buildings are required to be screened by CMS Security. This includes Contractor tools, tool boxes arriving at the site. The Screening location is noted on the contract drawings. All deliveries should arrive at the North or Back Gate. The vehicle will be inspected to ensure they are on the delivery access roster for that day. After Inspection of the vehicle and proper ID check of the individuals, the Contractor will proceed to the loading dock, make contact with the security officer at the loading dock and will once again show their ID and go through individual screening. The items on the truck will be scanned using the X-Ray machine. If the items are too bulky the security officer will perform a visual inspection of the items.

E. All Contractor materials, equipment, tools, and other construction deliveries are security screened twice, once at north gate to campus (accessed from Dogwood Road) and again at the loading dock. GSA Building Management or the CMa has to notify Security for access to campus vehicle inspection area and to open the loading dock roll-up door. The Contractor must be onsite to accept the delivery.There will be no deliveries allowed beyond the loading dock operations, which are Monday-Friday, 7 am

– 5 pm at south loading dock.

1.2 PROJECT TEAM:

A. GSA is responsible for administering the contract and delivering the project on time and within budget. 1.4 MISCELLANEOUS PROVISIONS

A. Work in existing facilities shall correspond in all respects with the existing conditions to which it connects, or to similar existing conditions, in materials, workmanship and finish.

B. Alterations to Existing Conditions: Existing conditions shall be cut, drilled, removed, temporarily removed, or removed and replaced, as necessary for performance of Work under the Contract. Work out of alignment where exposed by removal of existing work shall be called to the attention of GSA. Necessary corrective work shall be as directed.

1. Replacements of existing conditions that are removed shall match similar existing conditions.

2. Unless otherwise indicated, existing structural members shall not be cut or altered without authorization by the Contracting Officer.

PART 1 – GENERAL

1.1 SUMMARY

A. The intent of this Section is to identify major project sequencing requirements and inform the Contractor of Government’s known restrictions that will affect the timing of work and provide general phasing guidelines.

B. The phasing scope described in this Section shall not be deemed to constitute the comprehensive scope of all Contract requirements but is identified herein to assist the

Contractor in the understanding of existing systems and conditions which may affect the

Contractor’s planned work sequence.

C. The Contractor shall provide necessary resources as needed to perform required services including, but not limited to, those described in the RFP, the construction documents, exhibits, and attachments made a part of the contract to successfully complete the construction work required for Back on Campus Phase 02.

D. The ultimate responsibility of comprehensive project phasing rests with the Contractor. All

Contractor phasing plans must be documented in a submittal and reviewed and approved by the Government prior to commencing with such plan. Also phasing activities shall be reflected in the Contractor’s baseline schedule (Project Schedule) and monthly updated

CPM construction schedules. Refer to Section 013110 – Critical Path Method Scheduling for submission of Contractor’s Preliminary, Baseline and updated CPM Project Schedules.

1.2 PHASING AROUND CMS OCCUPANCY

A. The project comprises three distinct portions of work, each with unique occupancy requirements which will influence how construction is sequenced and phased. One construction Notice to Proceed (NTP) date is anticipated on or about November 15, 2022 for all three portions. See also section 011000 for milestone dates for design and construction. However, there may be opportunities for early work packages which could necessitate more than one construction NTP.

1. C2: Upon NTP, C2 will have existing furniture and fixtures that remain and will be part of the GC demolition scope. There are two restrooms serving the C2 spaces. When contractor sequencing and phasing require, both restrooms will be allowed to be closed for a defined period. The defined period will require work plans, review and approval by GSA Building Management.

1.3 BUILDING SYSTEMS INTERFACE

A. Contract work that ties into and/or requires cutting & capping of the operational building systems must be coordinated so that required systems remain fully functional for the duration of this project. Coordination with the CMa and GSA Building Management staff is required to ensure operations are not impacted during project installations and testing.

Following is a brief summary of systems which may require contractor awareness and consideration as system tie-ins or cut/cap activities are conducted.

B. Sprinkler: The building has a full sprinkler system consisting of vertical sprinkler mains, combined risers and sprinkler floor control valve assemblies which are located in the egress stairways. GSA Building Management will work directly with Construction

Manager and the Contractor to coordinate all outage requests in advance with GSA Fire

Shop. This also includes daily burning permits which will require coordination between

GC, CMa and GSA Building Management and call made daily to GSA Fire Shop and CMS

Security. See also section 013100 for requirements and processes for utility service interruptions or outages necessary to complete the project.

C. Existing addressable Fire Alarm: The GC is responsible for a fully operational fire alarm system throughout the renovations. The existing FACP and related systems are to remain in service throughout demolition and renovation phases; there will be de commissioning of many existing fire alarm points, re programming and re testing by AHJ. These efforts are the responsibility of the GC. GC to survey and verify requirements of existing fire alarm cable and termination panels.

D. Existing IT/AV/PA/Security cabling: Cabling for security, infrastructure technology, Public

Address System, and Audio Visual services may run through the renovation areas but be connected to other occupied spaces. The GC is to identify, protect and relocate prior to demolishing these existing systems.

PART 1 - GENERAL

1.1 CONTRACTOR USE OF PREMISES

A. The Contractor will conduct an existing condition survey surrounding the project premises. Provide documentation in the form of photographs, videos and executive summary narratives in the electronic form to the Government prior to the commencement of any construction activity. The survey should include verification of all existing equipment that is to remain.

B. During the construction period, the Contractor shall have shared use of the designated premises for construction operations, including use of the indicated work site, limited by the Government's right to perform work or retain other contractors to perform work on portions of the project; and to perform operations and maintenance.

C. The Contractor shall limit use of the premises to the work in areas indicated, and to allow for Government occupancy and public use.

1. Contractor use of restroom facilities are generally prohibited. However, on C2 and CLL levels, use of existing restrooms while the space is being renovated is allowed up until renovations are completed and ready for government turnover.

2. Confine operations at the site to areas indicated. Do not disturb portions of the site beyond the areas in which Work is indicated including main lobby and entrances, existing egress stairways, passenger and freight elevators, active tenant occupancies

3. Keep driveways and entrances serving the premises clear and available at all times to the Government, Government employees and to visitors. Do not use these areas for parking or storage of materials.

4. Keep public areas, such as hallways, stairs, lobbies and toilet rooms, free from accumulation of waste material, rubbish, construction debris and construction materials.

5. Maintain existing building in a safe, secure and weather-tight condition throughout the construction period. Repair damage caused by construction operations to the satisfaction of the government. Take precautions to protect the building, its occupants and the public during the construction period. A representative of the Contractor shall be available to arrive on site within one (1) hour of notice should an emergency occur. Protect building site from flying debris.

6. Use of the existing loading dock facilities will be shared with Government activities on a first-come-first-served, wait-your-turn basis. The south loading dock is

02/24/2022 available for the delivery of materials, tools, and supplies between the hours of 7 am – 5 pm. There will be no deliveries allowed beyond the loading dock available operations. The Contractor must be onsite to accept the deliveries.

7. Schedule deliveries to minimize space and time requirements for storage of material and equipment on site. CMS Security requires 48-hour advance notice for all deliveries, the Contractor will be required to complete a Parking / Delivery request prior to any deliveries, or the delivery will be denied. Minimum information required for notices include all vehicle information and all passengers information if they are visitors. All individuals shall have proper identification. See section 008000 for details on all contractor deliveries required to be screened.

8. Existing materials and equipment that are removed as part of the construction operations, and that are not reused or designated to be salvaged as Government property, shall become the property of the Contractor and shall be removed from the site. Storage or sale of excess salvageable materials and equipment is not permitted on site. The contractor shall recycle those materials and provide the government salvage/recycling receipts listing details of the transaction per specification section 017419 “Construction Waste Management and Disposal”.

9. Trash chutes are allowed but only if plan is submitted and approved. Trash chutes are not to be installed where building occupants are in place, next to windows.

CMS Security and GSA Building Management will work with Construction Manager and the General Contractor to locate onsite laydown location.

10. Existing Elevator Use: Passenger elevators are prohibited from Contractor and Construction Personnel. Use of GSA's existing freight elevator will be permitted with GSA approval. However, the freight elevators will be shared with Government activities on a first-come-first-served, wait-your-turn basis. Freight elevators must be protected, cleaned and maintained in a condition acceptable to GSA. At Substantial Completion, restore elevators to condition existing before initial use, including replacing worn cables, guide shoes, and similar items of limited life. Do not load elevators beyond their rated weight capacity. Provide protective coverings, barriers, devices, signs, or other procedures to protect elevator car and entrance doors and frame. If, despite such protection, elevators become damaged, engage elevator Installer to restore damaged work so no evidence remains of correction work. Return items that cannot be refinished in field to the shop, make required repairs and refinish entire unit, or provide new units as required. If required by local jurisdiction or union, provide temporary phones for elevators. Coordinate with Elevator maintenance contractor and GSA Building Management.

11. Temporary Use of Permanent Stairs: Use of existing stairs for construction traffic will be permitted, provided stairs are protected and finishes restored to new condition at time of Substantial Completion. Contractor to post signage to alert unauthorized people to stay-out. All contractor signage must be documented in a signage plan submitted for review and approval by the Government.

a. GSA Building Management will coordinate with the CMa and the General Contractor to designate a single 2nd floor stairwell door for access onto the 2nd floor for all parties authorized to work on the floor (General Contractor, CMa, CMS, GSA or deemed authorized).

b. Contractors entering the building through South loading dock could walk the stairwell to the 2nd floor to access the C2 construction workspaces.

c. All stairwell doors that are locked is to prevent access onto the 2nd floor, doors are locked from the outside. Anyone on the 2nd floor has emergency egress through any stairwell door from the inside of the 2nd floor.

12. Stairwell doors that are locked will not be chalked open. If locked doors require accessibility during the day, notification from the GC to Construction Manager and GSA Building Management Team must be provided.

13. Pollution producing equipment shall not be located near air intakes where airborne smoke or fumes could be drawn into the building. When not required for powering unloading operations, turn off engines when docked.

14. Smoking is not permitted in or around the building, see Facilities Management Regulation (FMR) Case 2008-102—3. Also see Code of Federal Regulations (CFR) 41 CFR Part 102-74.

15. No apparatus with an open flame is allowed to be used within the facility without the prior receipt of a burn permit. Contact the CMa and GSA Building Management to obtain burn permits. Burn permits are required for each separate occurrence.

16. County permits and inspections: The Contractor is responsible for obtaining any necessary permits and making arrangements for any necessary inspections. All fees and payments for permits and inspections shall be the responsibility of the Contractor, at no additional cost to the Government.

Photographs: Contractor must submit the CMS Form CMS–20001 for permission pass for taking photos and videos inside the building which must be required and approved by CMS Security Management. Coordinate with GSA Building Management as to the use of cameras in the building. Prior to any photography, submit the following information in writing to the GSA Building Management for approval:

a. Company name

b. Name of individual who will be using camera

c. Camera make, model, and serial number

Individual shall keep a copy of the approved camera pass whenever they are on site with the camera. All pictures must be reviewed by the GSA Building Management or their designated representative prior to leaving site.

A. The Government reserves the right to occupy, place, and install equipment in completed areas of the building prior to Substantial Completion, provided such occupancy does not interfere with completion of the Work. The Government's installation of equipment and partial occupancy shall not constitute acceptance of the total Work.

1. Prior to partial Government occupancy, mechanical and electrical systems for the space shall be fully operational, and required inspections and tests shall be successfully completed.

2. Upon occupancy, the Government will operate and maintain mechanical and electrical systems serving the occupied portions of the building and assume responsibility for maintenance and custodial service for the occupied portions of the building.

B. The CMS Campus is fully operational during construction duration. Work accomplished during Government Unoccupied Hours shall be performed at no additional cost to the Government. Contractor shall submit a proposed schedule and gain the Contracting Officer's approval at least 48 hours before proceeding with any work during Government Unoccupied Hours.

C. Extended hours of construction operations shall be performed at no additional cost to the Government. The following work shall be performed during Government Unoccupied

Hours:

1. Noisy producing work that may disrupt tenant operations in adjacent spaces must be performed during off-hours or weekend schedules. Noise levels exceeding 65db or noise levels that are consistent will be considered disrupting tenant functions.

2. Odor-producing work that may disrupt tenant operations in adjacent spaces must be performed during off-hours or weekend schedules. Usage of a welding smoke eater machinery or ventilate blower properly installed to exhaust fumes outside the building maybe be allowed within the building during normal construction hours, pending GSA Building Manager review. See also section 017410 Construction Indoor Air Quality.

3. Utility outages affecting building operations or tenant functions shall be planned for off hours. Contractor outage requests must be submitted no later than 15 calendar days in advance of the outage date. GSA Building Management will approve and assist with all utility outage including piping drain downs and lock out of equipment outages. Coordination between CMa, GC and GSA Building

Management is required to include advanced planning at progress meetings and three-week look-a-heads to plan scheduled outage request. See also section

013100 for requirements and processes for utility service interruptions or outages necessary to complete the project.

C. Frivolous RFI: RFI that requests information that is clearly indicated on or reasonably inferable from Contract Documents.

1.3 GENERAL RFI PROCESS

A. Submit RFI through the Construction Manager utilizing the GSA established Electronic Project Management (ePM) database.

B. Number RFIs sequentially using only next sequential number. Do not include subcontractors RFI number on form; include date submitted.

1. Each page of attachments to RFI shall bear RFI number and shall be consecutively numbered.

C. Identify Project, pertinent Drawing sheet and detail number, and Specification Section.
