OPOAM 3016.505-90(a)(2)(ii) Justification for Exception to Fair Opportunity
JEFO No.: - 1 -
JEFO No.:
Date: March 13, 2020 PR Number:
1. Agency and Contracting Activity.
The Department of Homeland Security (DHS), Office of Procurement Operations (OPO), Information Technology Acquisition Center (ITAC) Division, prepared this Justification for an Exception to Fair Opportunity (JEFO).
2. Nature and/or description of the action being approved.
DHS/OPO intends to award a task order without considering other awardees under the GSA Alliant 2 Unrestricted multiple award Indefinite Delivery Indefinte Quantity (IDIQ) contract pursuant to FAR 16.505(b)(2)(ii)(B).
3. A description of the supplies or services required to meet the agency’s need (including the estimated value).
The Office of the Chief Information Officer (OCIO), Solutions Development Directorate (SDD), Enterprise Platform Software and Services (EPSS), requires a Cloud-based hosting and development solution to support the full application development lifecycle for DHS cloud integrated web services based on agile methodologies. EPSS provides services to a broad customer base throughout DHS. Web Content Management as a Service (WCMaaS) provides an integrated computing platform, multiple environments, a solution stack, and cloud services for DHS public web sites to support the DHS customer base.
EPSS has a requirement for cloud hosting for 22+ public-facing websites for the Department of Homeland Security including but not limited to:
DHS.gov USCIS.gov FEMA.gov CBP.gov TSA.gov ICE.gov CISA.gov US-CERT.gov Schoolsafety.gov
JEFO No.: - 2 -
The Independent Government Cost Estimate (IGCE) for this effort is for a 12-month period of performance, which includes a three month base period of performance, a three month option period, and a six month option period.
4. Identify the exception to fair opportunity and supporting rationale. The task order will be issued in accordance with FAR 16.505(b)(2)(i)(B), “Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized”.
Market research was conducted in February 2020 and cloud hosting support is commercially available, however due to CGI, Federal Inc (CGI) being the only vendor with Authority to Operate (ATO), no other vendor can provide this support.
A disruption of cloud hosting would be detrimental and cost prohibitive as described below:
5. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
The anticipated fixed unit price delivery order will be determined by the Contracting Officer (CO) to be fair and reasonable. The CO will compare the price proposed to historical prices paid.
The program manager will review the proposal received to determine if the proposal meets the requirements of the statement of work.
6. Any other facts supporting the justification.
None
7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.
No.: - 3 -
This solution is DHS’s action to overcome barriers to competition.
The program office will continue to perform market research on different hosting solutions through Government and Commercial databases, reviewing trade and professional journals, attending conferences and other means in its’ effort to ensure that if additional products become available that meet the needs of the Government, they may be considered in order to have full and open competition.
8. DHS intends to post this requirement on FedBizOpps pursuant to FAR 16.505(b)(2)(ii)(D).
9. Technical/Requirements Personnel Certification.
Pursuant to FAR 16.505(b)(2)(ii)(B)(9), I certify that this requirement meets the Government’s minimum need and that the supporting data, which form a basis for the justification, are accurate and complete.
Technical Representative/COR Date
10. Contracting Officer Certification and Approval
Pursuant to FAR 16.505(b)(2)(ii)(B)(8), I certify that this justification is accurate and complete to the best of my knowledge and belief.
