About this file

This document is a Clauses and Provisions file for a Navy solicitation (N0006025RC015RT-0) for Black Box KVM hardware devices. The procurement involves acquiring 20 units of BBX-EMD2002SE-DP-R and BBX-EMD2002SE-DP-T high-performance KVM Emerald SE devices that provide seamless desktop experiences on TCP/IP networks, along with 60 units of HDMI and DisplayPort cables. The total procurement is for 80 total units, with delivery required by 31 August 2025 to Commander Second Fleet in Norfolk, VA.

The solicitation is a firm fixed-price contract using FAR Parts 12 and 13, with evaluation based on three factors: Technical Specifications, Authorized Reseller Certification, and Price. The North American Industry Classification System (NAICS) code is 334118 with a size standard of 1,000 employees. Vendors must be registered in the System for Award Management (SAM) database to be eligible, and the product service code is 7B21 for IT Telecom-Computer hardware. The government reserves the right to award to a vendor other than the lowest-priced quoter and may request additional pricing information to support price reasonableness.

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

The Government intends to award a Firm Fixed Price (FFP) contract as a result of this solicitation in accordance with FAR Part 12, and FAR Part 13. Award will be made on a brand name basis in accordance with FAR 13 after the price is determined to be fair and reasonable. The Government intends to evaluate and award a contract based on initial quote; therefore, the Quoter’s initial quote should contain the Quoter’s best terms from a price standpoint.

Total price will be evaluated taking into the account the total FFP for the supplies. Price analysis using procedures of FAR 13.106-3 will be used to evaluate price reasonableness. The Government mayevaluate any and all information submitted by the vendor to support the reasonableness of prices proposed. The method of evaluation used by the Contracting Officer is solely within the discretion of the Contracting Officer

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
