The sole-source justification cites Palantir as the only vendor capable of providing the required Space Joint Targeting Cycle capability without unacceptable delays. While 18 contractors on the Data Software Services (DSS) IDIQ contract expressed interest in future requirements, the government determined there was insufficient time to conduct a competitive procurement before the December 15, 2024 deadline. The government plans to release competitive FOPRs for both Space C2 and HAF requirements before June 15, 2025.

Justification and Approval (J&A) for Other Than Full and Open Competition

I. Agency and Contracting Activity.
The requiring activities are Space Systems Command, Battle Management Command, Control, and Communications (SSC/ BMC3), Space Command and Control (Space C2 (SSC/BCC)) and Headquarters Air Force (HAF). The contracting activity is SSC/ BCK, located at 483 N. Aviation Blvd, El Segundo CA 90245.
II. Nature and/or description of the action being approved.
This is a Class Justification and Approval (J&A) issued under the authority at 10 U.S.C. § 3204(a)(1), as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements, specifically, FAR 6.302-1(a)(2)(ii)(B) for continued Data-as-a-Service Platform support across the Department of Defense. As a result of this Class J&A, this action will be a modification to each of the existing two (2) Firm-Fixed Price (FFP) Contracts FA8806-23-C-0001
- Data-as-a-Service (DaaS) Platform for Space C2, which has an end date of 15 June 2025 (should the existing Option be exercised) and FA8806-23-C-0002 - DaaS Platform for Headquarters Air Force (HAF), which has an end date of 15 December 2024.
The modification to the Space C2 DaaS Platform Contract will incorporate new effort known as Ion Trail / Ion Cannon Development. This requirement was added to the SSC/BC PEO Portfolio, as directed by SSC/CC. The PoP for Space C2 will remain the same. The Space C2 DaaS Platform Contract will not be extended past the current anticipated completion date of 15 June 2025, however due to emergent Ion Trail requirements, the value is expected to increase by $12.3M from 15 December 2024 - 15 June 2025.
The modification to the HAF DaaS Platform Contract will extend the period of performance end date from 15 December 2024 to 15 June 2025. The HAF DaaS Platform Contract is anticipated to maintain current requirements and support irregular A1 added efforts for Envision -- this is anticipated to increase the contract value by $43.5M.
III. Description of supplies/services required to meet agency needs.
The DaaS Platform Contracts provide for the procurement of licenses; licenses acquired provides the Government with access to a commercial software platform accessible anywhere via cloud hosting services. This is important as the contractor provides a comprehensive Data-as-a-Service (DaaS) platform to support the Space Systems Command (SSC) and has been operationally accepted by Space Operations Command (USSPACECOM) for critical War fighter utilization. The platform integrates and manages large-scale data from various sources, including structured and unstructured datasets, while enabling advanced data analytics. To date, the platform has ingested over 2.4 Petabytes of sensitive Government information, critical for Department of Defense operations. It operates in secure environments with support for multiple classifications, such as Unclassified, Secret, TS/SCI, and Special Access Program (SAP). The DaaS solution includes open Application Programming Interfaces (APIs) for seamless data sharing across applications, ensuring support for the Department of Defense (DoD) and Joint Forces in space operations. The data shared via these APIs is crucial for DoD and Intelligence Community space operations.
The contractor provides software licenses, platform implementation, and support services to ensure the smooth operation and maintenance of the DaaS platform. This includes managing the system across classified cloud environments and ensuring data connections for ingestion and synchronization from over 250 government-identified sources. Additional support is provided for product configurations and application development to enhance mission-critical data analysis and transformation. Training for system administrators and users is conducted, along with developer documentation and user feedback sessions.
Currently, the solution meets stringent security requirements, including compliance with DISA Impact Level 5 and 6 standards, as well as accreditation for Sensitive Compartmented Information (SCI) information. The contractor has worked with the Government to expedite Authority to Operate (ATO) for the platform, ensuring the system is fully accredited for use across all necessary security fabrics. The platform's architecture includes disaster recovery and high-availability configurations to ensure mission-critical uptime.

The contractor also provides continuous monitoring and technical support for the platform. This includes handling system performance, availability, and security monitoring 24/7, as well as regular software updates and patches. The solution scales to accommodate tens of thousands of users concurrently, with flexibility for data pipeline automation, machine learning integration, and collaborative data exploration.
Intellectual Property (IP) Rights are not being procured under these contract. These contracts are procuring the use of a contractor commercial platform; under these efforts we are buying Use Licenses only, not the commercial platform IP Rights.
The Government owns the Data inputted into the contractor commercial platform and the Data ouput from the contractor commercial platform. Additionally, any data provided per the contract CDRLs comes with Government Purpose Rights.
The HAF Data-as-a-Service Platform Contract licensing will have an Authority to Proceed (ATP) of 16 December 2024. The Period of Performance (PoP) will be 6 months (16 December 2024 through 15 June 2025) to allow sufficient time for the issuance of a Fair Opportunity Proposal Request (FOPR) to be issued, the 18 Data Software Services (DSS) Indefinite Delivery Indefinite Quantity (IDIQ) contract holders to develop and submit proposals, internal technical and pricing evaluations, and the award of the Delivery Order (DO).
This estimate is based on historical actuals realized on the performance of contracts FA8806-23-C-0001 and FA8806-23- C-0002.
The appropriation types for this action are 3400 Operations & Maintenance for HAF and 3600/3620 Research, Development, Test and Evaluation (RDT&E) funds for Space C2. The funds for this effort are included in the GFY2025 budget that is currently awaiting Congressional approval and signature by the President. Letters of Funds Assurance have been provided by each organization and are included in the contract file. Award of efforts is subject to the Availability of Funds and/or Limitation of Funds, as appropriate.
The following CLIN structure and total estimated firm fixed price is anticipated:

The total estimated firm fixed price for the new Space C2 effort and HAF extension is: $55,829,588.00.
IV. Demonstration that the contractor's unique qualifications or the nature of the acquisition requires use of the authority cited above.
This procurement is justified under FAR 6.302-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements," (FAR 6.302-1(a)(2)(ii)(B) for unacceptable delays) due to the contractor's unique qualifications and the operational need for continuity in critical war fighter data services. Further it is determined that the issuance of a competitive effort using the DSS Multiple Award IDIQ Contract vehicle to award to any other source would result in unacceptable delays in fulfilling the Agency's requirements.
The contractor is the only provider capable of meeting the immediate and highly specialized requirements for the Data-as-a- Service (DaaS) platform used by the Space Systems Command (SSC). This platform has been fully integrated and operationally accepted by Space Operations Command for its critical war fighting and space operations, ingesting over 2.4

Petabytes of sensitive government information. Its unique ability to function across multiple security classifications -- Unclassified, Secret, TS/SCI, and Special Access Program (SAP) -- positions it as the only platform capable of supporting the Department of Defense (DoD) and Joint Forces in space operations at the required scale and security levels.
The contractor's platform is the only system that currently meets the agency's stringent security needs, as verified by government penetration testing and compliance with unique space data handling requirements. No other vendor currently has a solution that is both operationally certified and immediately capable of sustaining mission-critical operations within the necessary timelines. The ability to maintain real-time data ingestion from over 250 government-identified sources and ensure the seamless integration and analysis of this data is a critical requirement that the contractor has uniquely fulfilled.
Additionally, due to an unexpected request from USSPACECOM, a new requirement was introduced late in the acquisition process, necessitating adjustments to ensure it is fully incorporated into the procurement strategy. Due to a growing number of distinct threats in the space domain, USSPACECOM and the USSF operational community require access to the developed Space Joint Targeting Cycle capability to support a more holistic Space Tasking Cycle process configured on the Palantir Platform. The system's utilization must be continued by 15 December 2024, with access for operational users to the Space Joint Targeting Cycle workflow, to avoid critical impacts to multiple classified missions.
The Space Joint Targeting Cycle capability was configured through direct iteration with USSPACECOM operational groups to support elements of the Space Joint Targeting and Space Tasking Cycle, a process driven by a constrained and manual set of procedures that renders the space defense ecosystem vulnerable in the event of high operational tempo scenarios.
Specifically, the Space Joint Targeting workflow is a Mission Management and Space Defense Intelligence capability that uniquely fuses intelligence and other relevant data sources to provide a singularly coherent picture of terrestrial and orbital space data for operational planning and execution. It provides: the digital foundation to support Space Order of Battle updates, blue force asset defense, and critical operations in space; integrated user interfaces and an ontology fed by critical operational and intelligence data systems; and a capability to support exquisite role, attribute, and classification-based access controls and Zero Trust principles to enable the implementation of additional and relevant highly sensitive workflows.
There is currently no known system that can rapidly recreate these data integrations or support the novel tools configured within the Space Joint Targeting capability. In addition, there is no known system that provides a basis for development of the capabilities required to support a total Space Tasking Cycle workflow on a timeline to meet mission needs.
To fully address the vulnerabilities associated with the current Space Joint Targeting and Space Tasking Cycle process, USSPACECOM and USSF operational user groups require a flexible software baseline that can readily scale to quickly add more data sources and additional analysis tools and that supports a cross-domain connection at TS//SCI and SAP levels to provide operators with a single, cohesive environment. The Palantir Platform and the existing Space Joint Targeting Cycle capability configuration are uniquely capable of providing this baseline, which has already been deployed across TS//SCI environments and is actively undergoing SAP accreditation through the Warp Core program. Due to Space Joint Targeting Cycle capability being built on the licensed Palantir Platform, licenses to this Platform are required for operational organizations to maintain access to these mission essential capabilities. The Government's requirement cannot be satisfied by any other vendor in the marketplace. No licenses from other vendor(s) would provide USSPACECOM and USSF operational users with the required capability.
Due to the highly specialized nature of the platform, the significant time and resources already invested in its deployment and accreditation, and the critical operational requirements it supports, transitioning to another provider would result in substantial delays, loss of capability, and unacceptable mission risk. The need for continuity in these war fighter data services, coupled with the contractor's proven performance and existing infrastructure, makes this contractor the only source capable of delivering the required services without disrupting ongoing operations.
V. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under
FAR 5.202 applies.
Other potential sources considered include 18 Contractors on the DSS IDIQ Contract, however there is not sufficient lead time to properly conduct a Fair Opportunity request, evaluation, and award. When the FOPR is released, all 18 Contractors will have a fair opportunity to provide the Government with an offer. The intent is to release two (2) FOPRs, one for Space C2

The Government intends to release these two (2) FOPRs in a staggered approach to ensure Contractors are not overwhelmed by too many requests. The Government intent is to release the Space C2 FOPR to the DSS IDIQ Contractors before 15 Dec 2024 and the HAF FOPR after receipt of proposal for the Space C2 FOPRs.
Award of these FOPRs will be accomplished prior to 15 June 2025. The award of the efforts discussed herein will ensure fulfillment of the mission critical support to the mission partners and prevent a break in performance.
The last J&A was synopsized on SAM.gov for 30 days (see Notice ID 24-18 "Data-as-a-Service Platform," 24-18-0002 "Data-as-a-Service Platform" for HAF, and 24-18-0003 "Data-as-a-Service Platform" for NNC). For the current action, the Government intends to post a Notice of Proposed Contract Action.
VI. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
Based upon the program office's technical analysis of the offeror's Basis of Estimates (BOE) and the Contracting Officer's previous evaluation of proposed prices on the same and closely similar efforts on past proposals for DaaS Platform, the Contracting Officer expects they will be able to determine that the anticipated cost to the Government will be fair and reasonable. Further, the Palantir Platform is commercially available software. Prices for this upcoming effort will be compared to the current contracts and commercially available pricing information to ensure that the Government prices for the licenses and labor to support this platform are fair and reasonable. The Government will determine the price to be fair and reasonable through price analysis and historical data for similar or identical commercial software.
VII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
As part of this effort, a competitive acquisition for similar Data Software Services (DSS) was completed, resulting in the award of multiple contracts under an Indefinite Delivery Indefinite Quantity (IDIQ) vehicle. With the issuance of the 18 DSS Multiple Award (MAC) IDIQ Contracts, the DSS IDIQ Contractors have been given opportunities to review Draft Space C2 requirements and contract documents and will be given the opportunity to review the HAF requirements and contract documents.
Feedback and responses from DSS Contractors for the Space C2 requirements and contract documents, demonstrated at least 17 contractors are interested in these future requirements.
VIII. Any other facts supporting the use of Other Than Full and Open Competition.

IX. List of any sources that expressed, in writing, an interest in the acquisition.
Under the DSS IDIQ, the individual IDIQ contractors have expressed interest by responding to a draft Fair Opportunity Proposal Request for Space C2 requirements. Currently 17 contractors responded to the draft FOPR with feedback and suggestion to demonstrate their interest.
X. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisitions for the supplies or services required.
This proposed contract action represents the minimum time necessary to ensure the additional War fighter requirements are adequately included into the FOPR and related FOPR documents to allow the Government to quickly transition to the future award of delivery orders issued under the DSS IDIQ. Fair Opportunity will be provided to allow all DSS MAC IDIQ Contract holders to competitively proposed and be considered for selection of a DO. For the future, there are plans to release additional application development efforts for both Space C2 and HAF requirements to encourage more participation from the 18 DSS MAC IDIQ Contractors.
