5. Rationale Justifying Use of Cited Statutory Authority.

In accordance with Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(iii)(B), NAWC-AD determined the ASGSI services are only available from the original source and award to any other sources would result in u Calzoni is the original designer, developer, and manufacturer of the ASGSI systems and is the only source with the requisite knowledge, technical data, experience, and technical expertise to provide the supplies and services ordered under this BOA.

The Government does not have access to sufficient data to competitively procure the ASGSI requirements. The Government invested in less than of the ASGSI system design and, therefore, does not have rights to the proprietary data and software needed to manufacture and support the USN ASGSI requirements. Calzoni possesses rights in data and software and is the only qualified source with knowledge of the ASGSI design to perform these efforts in a timely manner. Without the technical data, any other source would require at least six years to design and develop a qualified ASGSI system. The lead-time to build a prototype without the technical knowledge is approximately three years. These estimates are based on the time required to develop, finalize the design, and produce the current ASGSI systems installed aboard various USN ship classes. Calzoni is the only company that possesses the knowledge and has been developing the ASGSI technology as part of the DDG 1000 program for USN Visual Landing Aid Systems. The supplies and services identified in section three are necessary to support known and emerging U.S. Navy requirements. Furthermore, a strategy deviating from the current technical efforts and specifications would result in an approximately expense.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

NAWC-AD conducted market research utilizing various database searches, such as the Dynamic Small Business search website and the Federal Procurement Database System. Market research confirmed that only Calzoni can provide support for the ASGSI system installed on USN ship classes. Additionally, a search of "Advanced Stabilized Glide Slope Indicator" was conducted via Google. Search results indicated Calzoni is the sole proprietor of this equipment; the Google search results included Cilas and AGI, but these sources do not have access to the prerequisite knowledge, expertise and proprietary design information for the qualified ASGSI system required to satisfy the effort. NAWC-AD will continue assessing the market throughout the BOA ordering period to determine if new potential sources have emerged.

NAWC-AD posted a request for information on beta.SAM.gov on 22 July 2020 to solicit input from vendors interested in this requirement. One response was received from Deltek. However, the inquiry pertained only to market research information and did not express any technical capacity to satisfy the requirement. NAWC-AD replied to Deltek on 6 August 2020, and received no further response. The pre-solicitation synopsis for this BOA resulted in no responses other than the one received from Calzoni. Additionally, NAWC-AD posted a synopsis for this BOA on beta.SAM.gov on 6 August 2020. Only one response was received from a representative

, inquiring about the procurement history. NAWC-AD replied and provided the previous contract number and contractor, and received no further responses. However, the procuring contracting officer (PCO) will evaluate any subsequent responses prior to award.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR 15.402, the PCO shall ensure that all supplies and services provided under this contract are provided at a fair and reasonable price. The Contractor will submit a formal price proposal for each order with sufficient information to support the accuracy and reliability of the estimate. Experienced technical analysts, cost analysts and contract specialists with the aid of necessary field pricing support will review the proposals. The PCO will utilize cost and price analysis as the basis for negotiating a fair and reasonable price for each order.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAWC-AD Lakehurst has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NAWC-AD Lakehurst will assess whether competition for future requirements is feasible.

Because this effort is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with Defense Federal Acquisition Regulation Supplement (DFARS) Procedures, Guidance, and Information (PGI) 206.304(a)(i), the prior CJ&A was provided to the approval authority for review. Approval of this CJ&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(ii).
