About this file

The document consists of two letters dated April 26, 2024, exchanged between the Arizona Department of Environmental Quality (ADEQ) and Clear Creek Associates/GeoLogic Associates regarding a potential conflict of interest in a solicitation (BPM006010) for the ASRAC Assessment and Remediation of Hazardous Substances. The correspondence involves Procurement Officer Ana Machiche from ADEQ and R. Douglas Bartlett, Vice President at GeoLogic Associates, with NXP USA, Inc. being a referenced party.

The solicitation centers on environmental assessment and remediation services, specifically within the Water Quality Assurance Revolving Fund (WQARF) program. The key issue is a potential conflict of interest, as GeoLogic Associates' key personnel (Bartlett, Jamie Kennealy, Thomas Suriano, and Russell Granfors) have previously represented NXP USA, Inc. at a regulated site. In response, Clear Creek Associates commits to recusing itself from representing ADEQ at sites where NXP has been involved, such as the 56th Street and Earll Drive Site and the West Van Buren WQARF Site, to maintain professional integrity and avoid conflicts of interest.

Re: Request for Clarification – Solicitation # BPM006010 ASRAC Assessment and Remediation of Hazardous Substances

Dear Ms. Machiche:

Clear Creek Associates, LLC (Clear Creek) provides the following response to your request for clarification regarding Attachment 11, References indicated in your letter of April 26, 2024.

Clear Creek acknowledges that NXP USA, Inc. (NXP) is a responsible party at a WQARF Site (the 56th Street and Earll Drive Site) and that Clear Creek represents NXP at that site. To avoid a conflict of interest, Clear Creek will recuse itself from representing ADEQ on that site or at other sites where NXP has participated in site related matters. As an example, Clear Creek would recuse itself from supporting ADEQ at the West Van Buren WQARF Site. Clear Creek believes its ability, and the abilities of the identified key personnel, to represent ADEQ at other WQARF sites would not be affected by our representation of NXP.

Please call if you have any questions.

Sincerely, CLEAR CREEK ASSOCIATES
