About this file
This document is a Market Research Questionnaire issued by the Defense Logistics Agency (DLA) Land and Maritime for a potential Long-Term Contract (LTC) for nonrechargeable batteries with National Stock Numbers 6135014783935 and 6135015279592. The agency is seeking market research to develop a realistic solicitation for an Indefinite Quantity Contract, with potential contract options including a five-year term or a three-year base period with two one-year option years. The questionnaire targets battery manufacturers and distributors, requesting detailed information about company size, capabilities, pricing structure, and commercial sales history.
Key elements of the market research include assessing supplier interest, commercial item status, pricing mechanisms (potentially with firm fixed pricing and escalation rates), and delivery capabilities. Respondents are asked to provide information on company size (NAICS 335910 "Battery Manufacturing"), small business classification, manufacturing or distribution status, traceability of products, quantity price breaks, and willingness to provide cost or pricing data. The deadline for completing and returning the market research questionnaire is 12 November 2025, with technical data package drawings available in cFolders. The contract is intended to be advantageous to both the warfighter and potential contractors, with an emphasis on open communication and comprehensive market research.

V. COMMERCIAL QUESTIONS:
* It is the Contracting Officer’s authority to determine an item(s) commercial or not and if the commercial price(s) are Fair and Reasonable. This is usually accomplished through proof that commercial market forces have driven the setting of the commercial price.
1. Is this item a Commercial Items per FAR 2.101(b)? |_| Yes |_| No -Commercial product means—
(1) A product, other than real property, that is of a type customarily used by the general public or by nongovernmental entities for purposes other than governmental purposes, and–
(i) Has been sold, leased, or licensed to the general public; or
(ii) Has been offered for sale, lease, or license to the general public;
(2) A product that evolved from a product described in paragraph (1) of this definition through advances in technology or performance and that is not yet available in the commercial marketplace, but will be available in the commercial marketplace in time to satisfy the delivery requirements under a Government solicitation;
(3) A product that would satisfy a criterion expressed in paragraph (1) or (2) of this definition, except for-
(i) Modifications of a type customarily available in the commercial marketplace; or
(ii) Minor modifications of a type not customarily available in the commercial marketplace made to meet Federal Government requirements. “Minor modifications” means modifications that do not significantly alter the nongovernmental function or essential physical characteristics of an item or component, or change the purpose of a process. Factors to be considered in determining whether a modification is minor include the value and size of the modification and the comparative value and size of the final product. Dollar values and percentages may be used as guideposts, but are not conclusive evidence that a modification is minor;
(4) Any combination of products meeting the requirements of paragraph (1), (2), or (3) of this definition that are of a type customarily combined and sold in combination to the general public;
(5) A product, or combination of products, referred to in paragraphs (1) through (4) of this definition, even though the product, or combination of products, is transferred between or among separate divisions, subsidiaries, or affiliates of a contractor; or
(6) A nondevelopmental item, if the procuring agency determines the product was developed exclusively at private expense and sold in substantial quantities, on a competitive basis, to multiple State and local governments or to multiple foreign governments.
2. If yes, please provide evidence of commercial sales and support needed to substantiate commerciality. Without evidence, we cannot make a determination that the acquisition is commercial and the requirements for Certified Cost or Pricing Data WILL apply.
Documentation that would potentially help support your commerciality claim may include but is not limited to:
1. Published Catalogs/Price Lists
2. Un-Redacted Commercial sales history (e.g. Invoices showing sales to companies outside of Federal, State or Local Government, etc.). The importance of provided un-redacted invoices is to assist in proving the item(s) have been sold commercially at like prices and for like quantities for same or similar items.
4. Proof of availability or announcement of the Commercial Item to the general public.
5. Website where you sell it or where it is sold to the general public.
6. You can provide a narrative below to explain any commerciality information you might provide and also provide supporting evidence. For example, you can identify that the cells go into other commercial applications or are sold commercially and provide information for the housing, etc. (it’s just an example.)
