About this file
This document is a justification for other than full and open competition for a federal contract. It details a planned sole source award to Pratt & Whitney for concept optimization, preliminary design, and risk reduction efforts to enhance the F135 propulsion engine. The contract value is approximately $XX million in FY22 and FY23 Research, Development, Test and Evaluation funds. Efforts are expected to complete a Preliminary Design Review by September 2023 and risk reduction tasks by September 2024. As the original designer and manufacturer of the F135 system, Pratt & Whitney possesses required data, knowledge, and expertise to redesign internal components and understand engine mechanics and dynamics. The government does not have sufficient rights to technical data to permit competition. A synopsis was posted to SAM.gov in June 2022 with no responses received to date. The contracting officer determined costs to be fair and reasonable, and a class waiver to DFARS requirements was approved in August 2022. The justification was approved by the Principal Civilian Deputy Assistant Secretary of the Navy for Research, Development and Acquisition.

CUI // REL TO USA
The design and risk reduction efforts described above are planned for procurement under the contract actions described below; however, some work may shift from one of these contract actions to the other during execution.
F135 Engine Enhancement Package Concept Optimization and Preliminary Design o This contract action will include all necessary labor, material, and engineering resources necessary to conduct concept optimization and preliminary design for the F135 Engine Enhancement Package.
o This contract action is expected to complete the Preliminary Design Review by 30 September 2023.
F135 Engine Enhancement Package Risk Reduction o As concept optimization and preliminary design mature, one or more contracting actions, currently planned as modifications to the contract action described above, will be executed to add scope for identified critical path engineering and development tasks.
o Performance under these contract actions is expected to complete by 30 September 2024.
The estimated total dollar value of the supplies and services to be procured under this contract is , comprised of Fiscal Year 2022 and Fiscal Year 2023 Research, Development, Test and Evaluation (RDT&E) funds. The current planned allocation between contract actions is described below. However, there is a high likelihood that funding allocations between contract actions will shift during execution.
F135 Engine Enhancement Package Concept Optimization and Preliminary Design:
F135 Engine Enhancement Package Risk Reduction:
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 3204(a)(1) (formerly at 10 U.S.C. 2304(c)(1)), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
In accordance with Federal Acquisition Regulation (FAR) 6.302-1(a)(2), the requirements covered by this CJ&A are available only from P&W and no other supplies or services will satisfy agency requirements. As the original designer, developer, and manufacturer of the F135 propulsion system, P&W is the only source with the required technical data and requisite knowledge, experience, and technical expertise to provide the anticipated hardware, engineering services, and studies. The contract actions covered by this CJ&A will procure design, technology maturation, risk reduction, and weapon system integration of the F135 propulsion system. These efforts will involve redesigning internal components of the F135 and require a holistic and detailed understanding of F135 mechanics and gas path dynamics. The Government does not possess the bulk of the technical data necessary to provide this understanding, and in the limited cases where the Government does have relevant technical data, it lacks sufficient license rights to provide the data for competition. In accordance with the approved F-35 Lightning II Joint Strike Fighter (JSF) Acquisition Strategy, the Government did not acquire, and does currently have plans to acquire, the additional technical data or license rights necessary for competition. Therefore, complete technical data packages suitable for full and open competition are not available at this time to permit sources other than P&W to perform the contemplated contract actions.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practical.
On 9 June 2022, a synopsis was posted on the sam.gov website and to date, no responses have been received. Additionally, on 22 Aug 2022 a Class Waiver to the requirements set forth in DFARS PGI 206.302-l was approved by the F-35 Joint Program Office Director of Contracts.
Lastly, the Government did not conduct additional market research because it is not practicable, for the reasons discussed in paragraph five above, for any company other than P&W to provide the required supplies and services.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this CJ&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
In accordance with the approved F-35 Lightning II JSF Acquisition Strategy, and as noted above, the Government did not acquire technical data suitable for competition for the F135 propulsion system or its subsystems under the original F135 System Development and Demonstration contract. For the reasons set forth in paragraph five above, the Government has no plans at this time to compete F135 Engine Enhancements in the future but will continue to explore other opportunities for air system modernization.
CERTIFICATIONS AND APPROVAL
SENIOR PROCUREMENT EXECUTIVE APPROVAL
Upon the basis of the above justification, I hereby approve, as Senior Procurement Executive of the Navy, the solicitation of the proposed procurement(s) described herein using other than full and open competition, pursuant to the authority of 10 U.S.C. 3204(a)(1) (formerly 10 U.S.C.
2304(c)(1)), Only one responsible source and no other supplies or services will satisfy agency requirements.
