About this file

This is a Class Justification and Approval (CJ&A) document from the Department of the Navy authorizing a sole-source contract award.

The Naval Air Warfare Center Aircraft Division (NAWCAD) at Patuxent River, Maryland is issuing a five-year Basic Ordering Agreement (BOA) to Sierra Nevada Corporation (SNC) on a sole-source basis, with ordering authority delegated to NAWCAD Lakehurst. The contract covers hardware, engineering services, and technical services for the Webster Outlying Field (WOLF) Air Traffic Control & Landing Systems (ATC&LS) Division. Specific components and assemblies to be procured include the AN/SPN-46(V) Radar Doppler Video Processor, AN/SPN-46(V) Radar Control Group, Unit 19 Upgrade, AN/SPN-46 Receiver and Transmitter, AN/APN-245 and AN/APN-246 Radio Beacon Sets, AN/ARA-65 Instrument Carrier Landing System (ICLS) Receiver, Unmanned Common Automatic Recovery System (UCARS), and AN/SPN-35C Receiver and Radar Processor Controller. Services include fabrication, modification, repair, replacement, and upgrades to maintain and improve ATC&LS components and assemblies.

The justification for sole-source award is based on 10 U.S.C. § 3204(a)(1), citing that only one responsible source exists and no other supplies or services will satisfy agency requirements. SNC is identified as the Original Equipment Manufacturer (OEM) possessing exclusive knowledge, technical expertise, and production-level data necessary to provide the required supplies and services without costly reverse engineering. Market research conducted via SAM.gov Sources Sought postings in October 2023 and December 2023 yielded no viable competitive responses. Additional research through Google search, Thomas Register, and Dynamic Small Business search sites confirmed that only SNC possesses the specialized manufacturing knowledge and OEM data required. The Contracting Officer has determined the anticipated cost to be fair and reasonable. The document notes that future competition will be assessed if alternative sources emerge, and references DFARS PGI 206.304(a)(S-70)(i) regarding prior Class J&A approval for follow-on requirements.
