About this file
This document is a Class Justification and Approval (CJ&A) for the Naval Air Systems Command (NAVAIR) to issue sole-source task and delivery orders to General Electric (GE) Aviation under Basic Ordering Agreement N00019-21-G-0004. The orders will support program management, engineering, logistics, and various recurring and non-recurring efforts related to the CH-53K T408-GE-400 engines and associated support equipment. The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1), as GE Aviation is the sole source designer, developer, and manufacturer of the T408 engines, and the Government does not have the technical data package to compete the efforts. The CJ&A is valid through September 30, 2025. The related federal contract opportunity is a Cost-Plus-Fixed-Fee (CPFF) modification to a delivery order under the Basic Ordering Agreement, awarded to GE Aviation on an other than full and open competition basis to support a CH-53K Cybersecurity Risk Assessment and Risk Management Framework implementation for the T408-GE-400 Full Authority Digital Engine Control.

CLASS JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Systems Command (NAVAIR) Headquarters.
2. Description of Action for Approval.
This Class Justification and Approval (CJ&A) document authorizes and approves the issuance of task and delivery orders to General Electric (GE) Aviation in Lynn, MA on a sole-source basis under Basic Ordering Agreement (BOA) N00019-21-G-0004 for program management, engineering, logistics support and various recurring and non-recurring efforts related to the CH-53K® T408-GE- 400 (T408) engines and associated support equipment. Authority to award under this CJ&A expires on 30 September 2025.
3. Description of Supplies/Services.
The orders covered under this CJ&A include actions in support of H-53; CH-53K Engineering Development Model (EDM) engines, System Demonstration Test Article (SDTA) engines, Low-Rate Initial Production (LRIP) engines, and Full Rate Production (FRP) T408-GE-400 engines. Orders placed under this BOA by PMA-261 will support GE efforts related to program management, engineering, logistics support and various recurring and non-recurring requirements, to include studies, design, prototyping, and testing of improved systems, engineering change proposals and modification kits.
Estimated Dollar Value in Millions
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
In accordance with FAR 6.302-1(a)(2)(ii)(A), the Government has deemed the efforts covered under this BOA to be in support of the continued development or production of a major system or highly specialized equipment, including major components thereof, wherein it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition.
GE Aviation is the sole source designer, developer and manufacturer of the T408 engines.
Additionally, GE Aviation has made corporate investments in T408 engine development, and as such, they are the only source with the requisite skilled personnel, knowledge, experience and data to perform the requirements. Without Government Purpose Rights (GPR) to this data, the Government does not have a sufficient technical data package to compete the efforts described under this CJ&A.
In 2006, GE Aviation was established as the CH-53K engine supplier as a result of a competitive source selection conducted by Sikorsky, under the initial CH-53K System Development and Demonstration (SDD) Contract (N00019-06-C-0081). A sole-source GE Aviation contract was established in 2013 for T408 engines for the CH-53K System Demonstration Test Article (SDTA) aircraft (N00019-13-C-0132). The Government estimates the duplicative cost to stand up another source for such specialized supplies and services that require unique H-53 capabilities to be $ , which is based on
. Therefore, awarding to another source other than GE Aviation would result in a substantial duplication of cost that is not expected to be recovered through competition.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Market research conducted for the proposed effort via a Sources Sought notice posted to the SAM.gov website on 24 March 2023; no other vendor expressed interest or submitted a capabilities statement. In accordance with FAR 5.201(b), a Synopsis is posted on SAM.gov dated 11 May 2023.
There were no responses received. Responses received from interested sources will be evaluated by the Contracting Officer prior to contract award.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies and/or services covered by this CJ&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in paragraph (5) above NAVAIR has no plans at this time to compete future contracts for the types of supplies and services covered by this CJ&A. If another potential source emerges, NAVAIR will assess whether competition for future requirements is feasible. As this is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a) (S-70) (i), the prior CJ&A was provided to the approval authority to review. Approval of this CJ&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a) (S-70) (ii).
