About this file
This is a Class Justification and Approval (CJ&A) document for a sole-source Basic Ordering Agreement (BOA) between the Naval Air Systems Command (NAVAIR) and L3Harris Technologies, Inc. for the Integrated Defensive Electronic Countermeasures (IDECM) AN/ALQ-214 program. The BOA covers logistics and engineering efforts for the AN/ALQ-214 system, including procurement of materials, technical support, maintenance, software development, test and evaluation, and engineering services. The contract will satisfy both domestic and Foreign Military Sales (FMS) customers, with an estimated total BOA value redacted and funded through fiscal years 22-27 using Research, Development, Test & Evaluation, Aircraft Procurement, Navy, and O&M Navy funds.
The document justifies the sole-source award based on L3Harris Technologies being the sole designer, developer, manufacturer, and depot repair facility for all AN/ALQ-214 variants. The government has a limited-rights license to technical data and has determined that awarding to any other source would result in unacceptable delays, estimated at 24 months to conduct a new competition and up to 4 years to achieve desired product maturity. The BOA was posted on sam.gov in October 2021 and May 2022 with no competitive responses received, and each subsequent order will be individually synopsized. The contract expires on 30 April 2027, with NAVAIR noting no immediate plans to compete future contracts for these specific supplies and services.

CJ&A_22_0311
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The sources sought required by Defense Federal Acquisition Regulation Supplement (DFARS) Procedures, Guidance, and Information (PGI) 206.302-1 was waived on 17 October 2022. In accordance with FAR 16.703(d)(2)(iv), this BOA was synopsized and posted on the sam.gov website on 19 October 2021 and 25 May 2022. No responses have been received to date. Additionally, each order under this BOA will be synopsized individually and posted on the sam.gov website in accordance with FAR Subpart 5.2. Any responses received will be evaluated by the contracting officer prior to negotiations of each order. No additional research was conducted because it is not practicable, for the reasons discussed in Paragraph 5 above, for any company other than L3Harris Technologies, Inc. to provide the required supplies and services.
7. Determination of Fair and Reasonable Cost.
The contracting officer has determined the anticipated cost to the Government of the supplies/services covered by this CJ&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons described in Paragraph 5, NAVAIR has determined competing this requirement to be impractical and has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVAIR will assess whether competition for future requirements is feasible. As this effort is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(i), the prior CJ&A was provided to the approval authority for review.
Approval of this CJ&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(ii).
