CJ&A 21-0372

described under this CJ&A. The Government has requested that GE Aviation provide or sell the technical data rights and to date, the Contractor is unwilling to sell.

The maintenance strategy for T408 engines is Organization-to-Depot. The proposed efforts under this CJ&A will support T408 engine CRI and CIP efforts and provide interim Depot Level parts provisioning, repair and test support for T408 engines until organic depot level capability is established in late CY2024. Programmatic delays at Fleet Replacement Center East (FRCE) have resulted in zero T408 test cell capability outside of the original equipment manufacturer (OEM). As a result, the Marine Corps currently has no means of inducting Fleet engines and returning them in Ready-forIssue (RFI) condition without support from GE Aviation. In 2006, GE Aviation was established as the CH-53K engine supplier as a result of a competitive source selection conducted by Sikorsky, under the intial CH-53K System Development and Demonstration (SDD) contract (N00019-06-C-0081). A subsequent competition was conducted and resultant sole-source GE Aviation contract was established in 2013 for T408 engines for the CH-53K System Demonstration Test Article (SDTA) aircraft (N00019-13-C-0132). A NAVAIR Cost Department validated estimate reflects a total of $ of development costs invested into non-recurring engineering (NRE) on the SDD and SDTA contracts, for development of the engine test assests. It is concluded that pursing a new competition for engine repair and test capabitilites would substaintally duplicate costs, that would not be recouped through a competition. As such, GE Aviation is the only source capable of meeting the Governments needs for immediate interim repair and test cell capability without substaintial duplication of costs.

8. Actions to Remove Barriers to Future Competition.

For reasons set forth in paragraphs (4) and (5) above, NAVAIR has no plans at this time to compete future contracts for the types of supplies and servies covered by this CJ&A. If another potential source emerges, NAVAIR will assess whether competitionfor future requirements is feasible.
