in fulfilling the Navy’s requirements. CHA is the only manufacturer that possesses the technology, infrastructure and capacity to produce and conduct verification testing for the MJU-68/B within the timeframe to meet USN deployment schedules as well as USAF requirements and other Global F-35 operations. Chemring USA (Kilgore Flares Company (KFC)) in Toone, TN is another Magnesium Teflon Viton (MTV) flare producer that has experienced production line shut downs due to repeated explosive incidents beginning in FY2018, and technical manufacturing issues, resulting in continued delays causing a backlog of MJU-68/B production requirements that will not be completed until February 2021, at the earliest. If the requirements contemplated under this CJ&A were to be produced by KFC, assuming continuous production at historical delivery rates and no further production setbacks, it is anticipated that requirements for the base year (FY21) would not be fulfilled until November 2023. This timeframe does not support approved USN and USAF deployment dates or Global JSF theater operations. CHA is capable of fulfilling the Government’s delivery requirements no later than November 2022. Any interruption in procurement of these items would pose critical setbacks to JSF fielding plans and further exacerbate inventory levels impacting operational readiness.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The Sources Sought required by DFARS PGI 206.302-1 was posted on 06 December 2019. The proposed contract was synopsized on the FEDBIZOPS website on 10 February 2020. On 10 January 2020, IPS Custom Automation submitted a general capability statement in response to the Sources Sought. The general capability statement did not include any information indicating IPS’s capability in producing MJU-68/B requirements. On 22 January 2020 NAVAIR Contracts informed IPS of the determination that they would not be considered a potential source for the production of the MJU-68/B requirements. Any additional inquiries will be addressed by the PCO prior to commencement of negotiations. PMA-272 conducts on-going market research to determine whether there are any other viable manufacturers of MTV flares. No other sources have been identified that could meet this requirement.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402, the Contracting Officer must ensure that all supplies and services are procured at fair and reasonable prices. The Contractor will submit a formal price proposal with certified cost or pricing data and sufficient information to support the accuracy and reliability of the estimate. The proposal will be reviewed by experienced technical analysts, cost analysts and contract specialists with the aid of necessary field pricing support from Defense Contract Management Agency and Defense Contract Audit Agency. The Contracting Officer will utilize the formal price proposal as the basis for negotiating fair and reasonable pricing.
8. Actions to Remove Barriers to Future Competition.
PMA-272 will continue market research and support the MTV flare industrial base, with a long-term goal of competing future efforts. Because this effort is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(i), the prior J&A was provided to the approval authority for review. Approval of this CJ&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(ii).
