About this file
Document Type: Class Justification and Approval (CJ&A) for sole-source contract award
This Class Justification and Approval authorizes the Naval Air Systems Command (NAVAIR) to award sole-source contracts to Sikorsky Aircraft Corporation (Lockheed Martin Company, Stratford, Connecticut) for the procurement of CH-53K Full Rate Production (FRP) aircraft and associated support for the United States Marine Corps H-53 Heavy Lift Helicopters Program (PMA-261). The authority to act under this CJ&A expires September 30, 2029. The procurement covers CH-53K aircraft Lots 7 through 13, with a baseline aircraft quantity of 146 aircraft and potential for up to 193 aircraft with additional Congressional authorization and appropriation. Deliverables include fully configured aircraft, Advance Acquisition Contracts (AAC) for long-lead components, spares, support equipment, test equipment, training equipment and services, recurring and non-recurring engineering associated with engineering changes, technical publications, logistics support, and integration of the T408-GE-400 engine. Planned quantities are based on the Office of the Secretary of Defense (OSD-22) budget for fiscal years 2022 through 2029.
The justification for sole-source award rests on Sikorsky's position as the Original Equipment Manufacturer (OEM) of the legacy H-53 fleet and the only responsible source possessing requisite engineering data, technical skills, and fabrication knowledge since the 2006 Systems Development and Demonstration (SDD) contract award. Market research conducted via a Sources Sought notice posted December 4, 2020, and a pre-solicitation synopsis posted December 21, 2020, yielded no responses. The Contracting Officer has determined the anticipated cost will be fair and reasonable, and NAVAIR has no plans to compete future contracts for these supplies and services.

7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/ services covered by this CJ&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in paragraphs (4) and (5) above, NAVAIR has no plans at this time to compete future contracts for the types of supplies and services covered by this CJ&A. Because this effort is a follow-on for supplies and services previously awarded on a noncompetitive basis, in accordance with DFARS PGI 206.304(a)(i), the prior CJ&A (19-0182) was provided to the approval authority for review.
