CJ&A_20_0067
CLASS JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Training Systems Division (NAWC-TSD) - Orlando, FL
2. Description of the Action Being Approved.
This Class Justification and Approval (CJ&A) authorizes and approves the issuance of sole source contract actions for the E-2D Hawkeye Integrated Training System (HITS} program to Rockwell Collins Simulation & Training Solutions (RCSTS),400 Collins Rapid NE, Cedar Rapids, IA 52498. Negotiated prices at time of contract award will be limited to the items detailed in Section 3 below. However, portions of the trainer updates and all sparing efforts will be negotiated and awarded after the necessary data (i.e. trainer source data, trainer software baselines, and final parts list) for ordering and pricing becomes available. For these reasons, a Class J&A is the most appropriate course of action. Authority to act under this class justification expires on 30 April 2024.
3. Description of Supplies/Services.
This E-2D Advanced Hawkeye (AHE) acquisition is for the procurement of the following: an Aircrew Procedures Trainer (APT) deployed to Naval Air Station Norfolk, Virginia. These actions will also include aircraft to simulator concurrency updates, integrated interoperable devices, technical data, and spares to facilitate successful transitioning of the HITS to the post-delivery support phase.
Originally developed by RCSTS on the competitively awarded HITS-Aircrew (HITS-A) and HITS- Maintenance (HITS-M) delivery orders, the HITS products are an integrated multi-media instructional system that blends instructor-led training, computer based courseware, and complex, high fidelity training devices to meet approved proficiency and qualification curriculum for the E-2D AHE. The HITS products report readiness within a training management system to facilitate efficient student production while reducing development and operational support costs to the E-2D AHE program.
The total estimated value of this CJ&A procurement is $22,000,000.00.
Estimated Dollar Value in Thousands

4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
The requirement for an APT to back-fill the device being re-located to lwakuni is necessary to meet fleet requirements in Norfolk, with a fleet need date in FY24. The APT in Norfolk requires the latest baseline with the most current DSSC load to meet fleet requirements. Due to the integrated requirements of HITS products in content, networking, and interoperability, segregating products into multiple contract actions outside of a single HITS baseline is not viable. Under HITS-Ill, RCSTS is delivering the flight trainers with a HITS software baseline (which includes the Delta Software System Configuration (DSSC) #3 configuration). The RCSTS HITS training media baseline data required for APT will be delivered to the Government and validated in FY24 under the existing HITS-Ill effort, the same FY as the fleet need date for the APT in Norfolk. The baseline information is not available sooner because development, delivery, testing and retrofits of training products preclude an earlier delivery of the data. Doing so will induce a prohibitive risk of incompatibility among training media and an unacceptable Cyber Security posture within the HITS secure network enclave.
Once the required data is secured, a competitive solicitation for an alternate source could be pursued in FY24 with an estimated contract award in FY25. It is estimated an alternate source will take a minimum of forty-eight (48) months from contract award to delivery to provide the initial training capability. The estimate is based on the initial time RCSTS took to provide HITS deliveries under prior efforts, allowing for delivery in FY29 or 5 years after the fleet need date. This delay is unacceptable and will fail to meet the Navy Training System Plan (NTSP) and CNAF required HITS schedule. Therefore, RCSTS is the only source with training media source and design data required to update the HITS and deliver training devices as close as possible to the required RFT date of FY24. The award date is October 2020 with delivery in April of FY24. Because the scope of the CJ&A for HITS-Ill only included the requirement for one flight device, a separate CJ&A is required to address the present requirement. Based on the above, RCSTS is the only source possessing the required source data and training media baseline information to deliver the necessary device by the required RFT dates above as mandated by the NTSP and CNAF schedule.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
In order to comply with PGI 206.301-1, the PCO also issued a sources sought notice to Beta.Sam (formerly Federal Business Opportunities (FedBizOpps)) on 13 December 2019. The intent of the notice was to seek information on the availability of potential comparable sources to provide E-2D HITS products to the fleet.
In accordance with FAR 5.201, the Procuring Contracting Officer (PCO) issued a pre-solicitation notice to Beta.Sam (formerly FedBizOpps) on 20 December 2019. The intent of the notice was to ensure full consideration is given to all potential sources.
The lack of any response to these outreach efforts confirms the assertion that no source other than RCSTS is capable of producing and delivering the HITS-Ill products in a timely manner. However, any additional responses received will be evaluated by the PCO prior to award. No additional market research was conducted because it is not practicable, for the reasons stated in paragraph 5 above, for any source other than RCSTS to provide the required supplies and services.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402(a), the Contracting Officer will ensure that the cost to the Government for the supplies and services covered by this CJ&A will be fair and reasonable. The contractor will submit a formal price proposal with certified cost or pricing data in accordance with FAR 15.403-4 and sufficient information to support the accuracy and reliability of the estimate. Technical analysts and contract specialists will perform analysis of proposals with the assistance of Defense Contract Management Agency analysts and Defense Contract Audit Agency auditors. The Contracting Officer will use cost and price analysis as the basis for negotiating fair and reasonable prices. Finally, E-2D HITS-A, E-2D HITS-M, E-2D HITS-II, and E-2D HITS-Ill historical contract cost data will also be utilized in the establishment of a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition.
Competitive acquisition strategies will be pursued to the greatest possible extent (provided the necessary data are available) should additional E-2D AHE training requirements arise beyond the scope and duration set forth in this document. For the reasons described in paragraph 5, NAVAIR has determined competing this requirement to be impractical and has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVAIR will assess whether competition for future requirements is feasible. Because this effort is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(i), the prior J&As were provided to the approval authority for review. Approval of this CJ&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(ii).
