CJ&A 18-0304

The estimated value and associated funding by fiscal year and type is indicated in the following table for the combined total of all contract actions, to include funding with non-appropriated funds from the P-8A Australian Cooperative Program.

Estimated Dollar Value

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(l), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements."

5. Rationale Justifying Use of Cited Statutory Authority

EDO (Harris) is the Original Equipment Manufacturer (OEM) of BRU-75, BRU-76, Torpedo Kits, Sonobuoy Rotary Launchers (SRLs), Sonobuoy Single Launchers (SSLs), Aft Pneumatic Sources (APS) and other specialized components within these systems. Providing the supplies and performing services for these components require in-depth knowledge, experience, technical expertise, technical data, and specialized equipment. The Government has insufficient technical data for these systems and components to facilitate competitive source selection, EDO (Harris) is the only known source with the requisite knowledge, experience, technical expertise, technical data, and specialized equipment necessary to satisfy P-SA requirements. Award to any other source would result in unacceptable delays in fulfilling requirements. The timeline to compete and qualify another source not only to fabricate components for the aforementioned systems but also to furnish the aforementioned services for those systems is estimated to be 3-7 years.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

In accordance with FAR 5.201, a sources sought notice indicating NAVAIR's intention to establish a BOA v.r:ith EDO (Harris) to procure the aforementioned supplies and services was posted to the Federal Business Opportunities (FBO) website on 23 February 2018. No responses were received. In accordance with FAR 5.201, orders v.r:ill be individually synopsized on the FBO website. The Contracting Officer will evaluate any responses received prior to award of each order. Additionally, parties interested in subcontracting opportunities will be referred to EDO (Harris).
