About this file
This document is a Class Justification and Approval (CJ&A) that authorizes and approves the award of a sole source contract to Raytheon of Tucson, AZ, for the AIM-9X missile production in FY24 through FY26. The initial contract is anticipated to be a Fixed Price Incentive (Firm Target) (FPIF) contract with a base (Lot 24) and two options (Lots 25-26) to procure AIM-9X missiles, training devices, associated spares and supplies, and Non-recurring Engineering (NRE) for the United States Government (USG) and Foreign Military Sales (FMS) customers. The estimated dollar value is based on an Independent Government Cost Estimate (IGCE). The AIM-9X is the only short-range air-to-air missile in the domestic weapons inventory, and the time required to qualify a new vendor would unduly delay the fulfillment of these critical requirements to the Government. The Contracting Officer has determined the anticipated cost to the Government will be fair and reasonable.

CJ&A 23-0251
CLASS JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Systems Command (NAVAIR) Headquarters
2. Description of the Action Being Approved.
This Class Justification and Approval (CJ&A) authorizes and approves the award of a class of contract actions on a sole source basis to Raytheon of Tucson, AZ, for AIM-9X Production in FY24 through FY26. The initial contract is anticipated to be a Fixed Price Incentive (Firm Target) (FPIF) contract with a base (Lot 24) and two options (Lots 25-26) to procure AIM-9X missiles, training devices, associated spares and supplies, and Non-recurring Engineering (NRE) associated with rate capacity increase for the United States Government (USG) and Foreign Military Sales (FMS) customers. Future modifications may include material for mitigating Diminishing Manufacturing Sources and Material Shortage (DMSMS), Buy-to-Budget missiles, and the use of authorities as specified in the National Defense Authorization Act (NDAA) for FY23, Section 1244 “Temporary Authorizations Related to Ukraine and Other Matters.” Authority to act under this class justification expires on 30 September 2029.
3. Description of Supplies/Services.
Supplies and services to be procured include: up to a AIM-9X missiles (including tactical missiles, Captive Air Training Missiles (CATM), Special Air Training Missiles (NATM), Captive Test Missiles (CTM) and other test and training missiles), containers, obsolescence support and material, spares and associated material parts, tooling, support equipment, maintenance kits, sectionalization kits, Special Test Equipment (STE), rate capacity increase NRE, and related supplies and services for the USG and various FMS customers. The AIM-9X Program is a joint Department of the Navy (DoN) and United States Air Force (USAF) program with the DoN designated as the lead service. The quantities identified herein are estimated and may be adjusted to reflect other such quantities as may be authorized and appropriated by Congress, approved for Buy-to-Budget, or requested by FMS customers.
The FY22 and FY23 funding accounts for current and anticipated additional funding for Buy-to- Budget missiles; FY24-26 represents anticipated Lot 24-26 funding. The funding line for Other Customers Funds (OCF) represents all USAF and United States Army (USA) anticipated

Additionally, based on analysis of similar previous efforts, the time to complete design efforts, set up production, fabricate, qualify, and certify a new missile (48-60 months) would unduly delay the fulfillment of these critical requirements to the Government by at least five. The AIM- 9X is the only short-range air-to-air missile in the domestic weapons inventory. If the program competitively awarded the effort and qualified a new vendor, it would be unable to maintain AIM-9X Operational and Material Availability (Ao/Am) values at the required levels to support the fleet during this period, and the overall inventory would continue to degrade, impacting readiness.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The notice required by DFARS PGI 206.302-1(d) and 206.303-2(b)(i)(A) was waived by the Procurement Group Director for PEO(T) on December 13, 2022. The proposed procurements were synopsized on the SAM.gov website on December 15, 2022. No other potential sources expressed interest in the requirements. The Contracting Officer will address any responses received prior to contract award. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5, for any company other than Raytheon to provide the required supplies and services.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this CJ&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in paragraph 5, NAVAIR has no plans at this time to compete future contracts for the types of supplies and services covered by this document. If another potential source emerges, NAVAIR will assess whether competition for future requirements is feasible.
As this is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(S-70)(i), the prior justification was provided to the approval authority for review. Approval of this J&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(S-70)(ii).
