About this file
This file is a city ordinance from the City of Conroe, Texas, establishing regulatory requirements for digital LED signs within municipal jurisdiction. The ordinance sets forth technical specifications and operational standards for digital LED signage, including maximum size limitations of 150 square feet, message display requirements mandating static content for a minimum of eight seconds with changes occurring within two seconds, and illumination standards requiring constant brightness levels that comply with state regulations. For signs exceeding 36 square feet adjacent to thoroughfares with posted speed limits below 55 MPH and within 1,500 feet of traffic signals or driveway entrances, the building official may require traffic safety studies to ensure no negative impacts result from the signage. Sign owners and operators must cooperate with local law enforcement to display amber alerts as requested and provide contact information for a responsible party available for sign operation and programming at any time.
The ordinance includes specific provisions for converting existing lawful static billboard structures to digital LED faces, contingent upon compliance with all subsection (b) requirements, maintenance of original height and copy area dimensions, donation of 40 hours of annual copy space to the city for public messages, and removal of three equivalent or larger traditional billboard structures within city limits prior to permit issuance. A development agreement must be submitted, approved, and executed before the city grants written consent for conversion, with all permit and agreement fees payable according to Appendix A. The ordinance was adopted through Ordinance No. 2739-25 on March 27, 2025, and amended by Ordinance No. 2761-25 on November 13, 2025.

Sec. 90-13. Digital led signs.
(a) No digital LED face shall be permitted to exceed 150 square feet in area except as provided herein. A digital sign face that exceeds 36 square feet in area must comply with subsection (b).
(b) A digital LED sign face that exceeds 36 square feet in area must comply with the following:
(1) The copy/message must stay static for a minimum of eight seconds. When the copy/message is changed, it must change within two seconds. A change of message must occur simultaneously on the entire sign face and the sign must contain a default mechanism that freezes the sign in one position if a malfunction occurs.
(2) The illumination of the sign must remain constant under all lighting conditions and must comply with state regulations. For example: At night, the sign shall not appear any brighter than it appears in the daylight. If the building official finds that an electronic sign causes glare or otherwise impairs the vision of the driver of a motor vehicle or otherwise interferes with the operation of a motor vehicle, the owner of the sign, within 12 hours of a request by the building official, shall reduce the intens ity of the sign to a level acceptable to the building official.
(3) An LED sign that is proposed adjacent to a thoroughfare with a posted speed limit of less than 55 MPH and is proposed within 1,500 feet of a traffic signal or driveway entrance, the building official at his discretion, may require the applicant to perform a traffic safety study, indicating that no negative traffic or safety hazards will result from the LED sign.
(4) The owner and operator of the sign must agree to cooperate with the local law enforcement to voluntarily display amber alerts as requested by the law enforcement agency. The sign owner shall provide to the building official contact information for a person who is available to be contacted at any time and who is responsible for the sign operation and programming.
(c) Off-premises static billboard type signs that are lawfully in existence may convert the static faces to digital LED faces provided all of the following conditions are satisfied:
(1) Must comply with subsection (b).
(2) The height and copy area of the converted digital sign shall not exceed the original height and copy area of the existing static sign.
(3) The owner and operator of the sign must agree to donate 40 hours of copy per year for the city to display special event messages or public awareness messages.
(4) The owner must agree to remove a total of three traditional off-premises billboard structures within the city limits, each having faces of equivalent or larger area of the faces on the sign to be converted.
Such traditional billboards must be lawfully in existence and the removals shall take place prior to receiving a permit to convert the third sign at a separate location to digital. The removal shall not be the result of an eminent domain or condemnation proceeding.
(5) A development agreement must be submitted, approved and executed prior to the city's written consent for the conversion. The development agreement is contingent on billboard removal locations and digital conversion location.
(d) The fee for any permit or agreement under this section shall be paid as provided for in appendix A.
