3.0 LOCATION OF WORK

3.1 The South 500,000 Gallon Elevated Water Storage Tank located in Alice, Jim Wells County, Texas.

4.0 GENERAL SEQUENCE OF WORK

4.1 The following Sequence Of Work shall be followed by the OWNER, the ENGINEER and CONTRACTOR for the entire PROJECT:

4.1.1 The ENGINEER will issue the Notice To Proceed and conduct the Pre-Construction Meeting.

4.1.2 Submittal Process: See Shop Drawings in the General Conditions.

4.1.3 CONTRACTOR will complete shop fabrication/purchase of new tank appurtenances.

4.1.4 CONTRACTOR will mobilize tools, equipment and materials.

4.1.5 OWNER will drain the tank after 5 calendar days notice to the OWNER has been given by the

CONTRACTOR.

4.1.6 CONTRACTOR will complete the inspection blasting.

4.1.7 CONTRACTOR will complete the steel repairs, alterations and removal of surplus items.

4.1.8 CONTRACTOR will clean and paint the interior and exterior surfaces.

4.1.9 CONTRACTOR will sample and classify the exterior blast debris.

4.1.12 CONTRACTOR will transport all blast debris for landfill storage and shall be responsible for all disposal fees.

4.1.13 ENGINEER will perform the Final Inspection.

4.2 The intent of this required Sequence of Work is to assure that the work progresses in a timely manner and the tank is placed back into service at the earliest possible time.

4.3 Because of the items of work that must be performed by the OWNER and ENGINEER at designated points, it is critical that close coordination of the work by the CONTRACTOR, the OWNER and

ENGINEER be maintained during the entire course of the PROJECT.

5.0 PROJECT SUPERINTENDENCE, COORDINATION, RECORD KEEPING, ETC.

5.1 During the course of field work, it will be the CONTRACTOR'S responsibility to:

5.1.1 Maintain at the job site a telephone for communications between the CONTRACTOR, OWNER and ENGINEER. Telephone can be either fixed or mobile.

5.1.2 Maintain at the job site a full-time, fully experienced and qualified field superintendent/foreman. This person must be present at all times when work is being performed, including all SUB-CONTRACTOR'S work, and shall be authorized to coordinate and direct all work; to accept all materials/deliveries; and to communicate directly with the OWNER and ENGINEER on scheduling, inspections, status reporting, changes, extra work, etc. This designated superintendent/foreman shall not be removed, substituted or replaced without a minimum of 3 days prior notice to the ENGINEER. All replacements of superintendence shall be fully versed in the PROJECT status, schedules, scope of work, etc.

5.1.3 Fully coordinate the work between the CONTRACTOR, SUB-CONTRACTORS, OWNER and

ENGINEER in such a manner so that the work is executed in a timely manner and in the prescribed general Sequence of Work (Item No. 4.1, above).

5.1.4 Maintain at the job site office copies of the complete Contract Documents, lead test reports, ENGINEER'S Inspection Report, TCEQ notifications, any addenda, change orders, delivery tickets, testing reports, bar schedule, certification of welders, paint batch numbers, written instructions and/or interpretations from the ENGINEER and any other written data pertaining to the PROJECT. The above items shall be available to the OWNER and ENGINEER upon request at all times.

5.1.5 Follow the general Sequence of Work at all times. If, for whatever reason, it becomes necessary to deviate from the specified sequence, then it is CONTRACTOR'S responsibility to notify the ENGINEER.

6.0 OTHER GENERAL DATA

The following items, as briefly described below, are important in the preparation of BIDS, the planning and execution of the work and the timely completion of this PROJECT. Each item is outlined or discussed in more detail in other sections of these CONTRACT DOCUMENTS.

6.1 BID SECURITY

6.1.1 Bid Security for this PROJECT shall be five percent (5%) of the greatest amount bid.

6.1.2 A Statement of Bidder’s Qualification form must also be submitted with the Proposal.

6.2 CONTRACTOR QUALIFICATIONS

6.2.1 The CONTRACTOR must be fully experienced and qualified in the field of structural repairs, blast containment, lead abatement and the cleaning and painting of large steel, elevated storage tanks.

6.3 BAR SCHEDULE

6.3.1 The CONTRACTOR will prepare a PROJECT Bar Schedule.

6.3.2 This schedule shall include the PROJECT start date, each major item of work (as furnished by the ENGINEER), completion dates for major work items and PROJECT completion date.

6.3.3 The Schedule shall be presented to the OWNER and ENGINEER for review prior to the Pre-

Construction Meeting.

6.3.4 A copy of the Schedule shall be maintained at the job site and shall be updated (by

CONTRACTOR) as required to reflect any significant changes in the Sequence Of Work, completion times and/or extra work.

6.4 EXTRA AND UNIT PRICE WORK

6.4.1 It is recognized that the original scope of repair work might have to be revised as a result of conditions not fully apparent or accessible during the ENGINEER'S inspection.

6.4.2 Part T-2, STEEL REPAIRS, list several "suspect" areas which may require repair and/or replacement - dependent on the degree of structural damage caused by corrosion. The

CONTRACTOR’S BASE BID scope of work shall include blast cleaning these areas to allow access for inspection by the ENGINEER.

6.4.3 It is the intent of these CONTRACT DOCUMENTS that any required changes be addressed by all parties in a timely manner and completed quickly so as to not disrupt the PROJECT

Sequence of Work. Compensation for extra and unit price work shall be fair and in the best interest of the OWNER and CONTRACTOR.

6.4.4 Provisions for hourly rates for extra work and unit pricing are outlined in Part T-2, STEEL

REPAIRS, and on the PROPOSAL. The CONTRACTOR'S prices quoted on the PROPOSAL for Miscellaneous Welding and unit price work which, in the opinion of the ENGINEER, is excessively inflated over and above standard industry labor/equipment rates shall be grounds for disqualification of a BID.

6.4.5 The ENGINEER (with approval of the OWNER) shall determine and authorize the scope, the costs, and time extensions (if required) for all unit price and extra work in accordance with the

General Conditions. Extra work performed by the CONTRACTOR which is not authorized in writing by the ENGINEER (and approved by the OWNER) shall not be allowed.

6.5 ENVIRONMENTAL PROTECTION

6.5.1 CONTRACTOR must be aware that the removal of the existing lead, chromium, and cadmium contained exterior paint system by abrasive blasting, the collection of blast debris and the possible on-site waste treatment are "environmentally sensitive" operations and subject to strict

State and Federal environmental regulations.

6.5.2 All applicable environmental agencies shall be notified in advance of this PROJECT (by

ENGINEER). Notification shall include the name of the CONTRACTOR performing paint removal, location of the PROJECT, required removal and waste handling procedures, monitoring, daily hours of operation and duration of the PROJECT.

6.5.3 The requirements for the installation and maintenance of the environmental protection systems and the handling of blast debris are mandatory and shall be enforced by the CONTRACTOR at all times. No deviation from these requirements shall be allowed.

6.5.4 Because of the close proximity of commercial facilities, streets, resident homes, drainage systems, etc., it is imperative that none of the blast debris be allowed to escape onto the surrounding areas or contact the ground at the site.

6.5.5 It is the intent of these CONTRACT DOCUMENTS that the OWNER (the generator) be fully protected and in complete compliance with all applicable environmental regulations at all times.

6.6 INTERIOR BLAST DEBRIS

6.6.1 The existing inside paint system has been determined to be essentially lead-free.

6.6.2 The blast debris generated during the removal of this paint system shall be transported to a

Subtitle D landfill by the CONTRACTOR at the CONTRACTOR’s expense.

6.7 EXTERIOR BLAST DEBRIS

6.7.1 Immediately upon generation, the CONTRACTOR will sample, test and classify the exterior blast debris in accordance with EPA SW846. Until classification, the debris shall be assumed to be

Hazardous Waste and handled accordingly.

6.7.2 If determined to be non-hazardous, then the CONTRACTOR shall collect and transport to a

Subtitle D landfill. This work shall be included in the CONTRACTOR'S BASE BID scope of work.

6.7.3 If the classification indicates a lead content in excess of 5 ppm, then the waste shall be considered as hazardous and treated on-site by a qualified waste treatment SUB-

CONTRACTOR employing the best available technology in accordance with EPA guidelines.

The treated waste shall then be removed and transported to an appropriately licensed waste storage facility. The cost and additional completion time for the treatment and disposal of all hazardous waste, if required, shall be handled as an item of work as provided for on the

PROPOSAL.

6.7.4 The CONTRACTOR shall submit all transport manifests, test reports, chain of custodies, etc. to the OWNER and ENGINEER for all debris removed from the site.

6.8 WORK SCHEDULE AND TIME OF COMPLETION

6.8.1 The job site shall be made available to the CONTRACTOR for his work seven (7) days a week. The CONTRACTOR shall determine his own work schedule.

6.8.2 The work provided for in these CONTRACT DOCUMENTS shall be completed in the calendar day time stated on the PROPOSAL. A "calendar day" shall consist of 24 hours and measured from midnight to the next midnight.

6.8.3 Failure to complete the PROJECT on time shall result in the application of liquidated damages against the CONTRACTOR as defined herein.

6.8.4 CONTRACTOR must take into account their expected down-times due to typical weather conditions at the time the work is performed, equipment breakdowns, labor shortages, scheduling conflicts, material delivery delays, recognized holidays or any other incidents or conditions which can be expected to occur on a project of this size and magnitude. The

CONTRACTOR'S failure to properly staff the job, failure to manage the work or failure to allow for usual weather delays shall not entitle the CONTRACTOR to additional time.

6.8.5 No extensions of contract time due to weather delays shall be considered by the OWNER unless the OWNER is satisfied that the weather was significantly severe and unusual for long periods of time in which the work is performed and that the overall PROJECT completion time was, in fact, truly impacted by the severe and unusual weather. The burden to prove "severe" and "unusual" weather is upon the CONTRACTOR.

6.8.6 Time for completing this project is 120 calendar days. The tank shall be placed back into service by the OWNER.

6.9 OCCUPANCY OF SITE

6.9.1 Occupancy of the job site by the CONTRACTOR'S workmen for residential purposes during the

PROJECT shall not be allowed.

6.10 EXTERIOR WASHING

6.10.1 CONTRACTOR'S attention is directed to the exterior, between-coat washing requirements as outlined in Part T-4, PAINTING.

6.11 SEQUENCING OF REPAIR WORK

6.11.1 Item No. 4.1, above, outlines the required general sequence of the major items of work (steel repairs, painting, disinfection, etc.).

6.11.2 Part T-2, STEEL REPAIRS, lists numerous items of repair/replacement work on certain tank members which can be considered safety appurtenances (safety climb devices, handrails, ladders, access openings, etc.).

6.11.3 The sequence of installation and provisions for any temporary safety appurtenances during the repair/replacement work on these safety related tank appurtenances will be the sole responsibility of the CONTRACTOR.

6.12 INSPECTION

6.12.1 CONTRACTOR must be aware that the OWNER or the ENGINEER may not provide full-time construction monitoring/inspection services on this PROJECT.

6.12.2 As described in other sections of these TECHNICAL SPECIFICATIONS, monitoring, witnessing and/or inspection of the CONTRACTOR'S quality control by the ENGINEER is required at designated points in the PROJECT before the work can proceed.

6.12.3 It is the CONTRACTOR'S sole responsibility to ensure that each item of work is completed in accordance with the CONTRACTOR'S Quality Control Program, to notify the ENGINEER well in advance as to the schedule of required inspections, and to inform the ENGINEER in advance of any condition which may affect the ENGINEER'S schedule of inspection (weather, equipment breakdowns, labor/material shortages, etc.).

6.13 CONTRACTOR SAFETY

6.13.1 CONTRACTOR shall be fully responsible for safety on his job site.

6.13.2 CONTRACTOR shall follow OSHA’s Confined Space Entry Program Requirements.
