LIMITED SOURCES JUSTIFICATION

ORDER >SAT

FAR PART 8.405-6

ACQUISITION PLAN ACTION ID: 36C244-20-AP-1393

(1) CONTRACTING ACTIVITY: Department of Veterans Affairs, Veterans Integrated Service Network 04

(VISN04), PR #646-21-1-543-0002

(2) DESCRIPTION OF ACTION:

This acquisition is conducted under the authority of the Multiple Award Schedule Program (41 U.S.C.

251 and 40 U.S.C. 501).

This is a sole source request to provide annual licensing, maintenance, and support for the existing DSS Clinical Information System (CIS)-DataBridge currently deployed at seven VISN04 facilities and at Clarksburg, WV (VISN05). The specific facilities included are Altoona VAMC, Erie VAMC, Lebanon VAMC, Philadelphia VAMC, VA Pittsburgh Healthcare System, Wilkes-Barre VAMC, Wilmington VAMC, and Clarksburg VAMC (VISN05). The order will be awarded as a new requirement.

Order against: FSS Contract Number: GS35F0485N

Name of Proposed Contractor: Document Storage Systems, Inc. (DSS, Inc.)

Street Address: 12575 US Hwy 1 Ste 200

City, State, Zip: Juno Beach, FL, 33408-2478

Phone: 561-284-7868

(3) DESCRIPTION OF SUPPLIES OR SERVICES:

The estimated value of the proposed action is $1,603,344.48. The period of performance includes a base year and four (4) one-year option periods. The estimated value of the base year is $290,164.96, and the estimated value of the six-month option to extend services, should it be exercised, is $176,348.64.

The DSS CIS-DataBridge is a bidirectional software interface solution that filters patient data information from Veterans Health Information Systems and Technology Architecture (VistA) and Clinical Patient Record System (CPRS) to a commercial Intensive Care Unit (ICU)/Anesthesia record keeping (ARK) system. This technology also exports patient and milestone data into VistA for viewing, making it possible to achieve interoperability between VistA and external Health Information Technology (HIT) systems. Data is stored within VistA.

(4) IDENTIFY THE AUTHORITY AND SUPPORTING RATIONALE (see 8.405-6(a)(1)(i)(A), (B), and (C) or 8.405-6(b)), AND IF APPLICABLE, A DEMONSTRATION OF THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY OR SERVICE.

36C244-20-AP-1393 - LSJ - VISN04 CIS Databridge

Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

The CIS-Databridge software interface solution is proprietary to DSS, Inc. Market research has not identified any other vendor with current capability to perform the work associated with licensing, maintenance, and support for the CIS-Databridge product.

(5) DESCRIBE WHY YOU BELIEVE THE ORDER REPRESENTS THE BEST VALUE CONSISTENT WITH FAR 8.404(d) TO AID THE CONTRACTING OFFICER IN MAKING THIS BEST VALUE DETERMINATION:

DSS, Inc. is the only contractor with the current capability to perform the required services for proprietary reasons. Price will be evaluated in relation to the contractor’s FSS contract pricing, the IGCE, and historical price information upon receipt of the contractor’s price quote.

(6) DESCRIBE THE MARKET RESEARCH CONDUCTED AMONG SCHEDULE HOLDERS AND THE RESULTS

OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED:

Market research indicates that the CIS-Databridge software interface solution is proprietary to DSS, Inc.

A notice of Intent to Sole Source to DSS, Inc., posted to Contract Opportunities from 04/02/2020 through 04/07/2020, returned one large business response that did not demonstrate capability to meet the requirement. The contract specialist responded to the vendor at 09:46AM on 04/09/2020 to reiterate the requirement and request that the vendor clarify the firm’s capability or interest by 3:00PM on 4/10/2020, and the vendor did not respond.

(7) ANY OTHER FACTS SUPPORTING THE JUSTIFICATION:

The VA Technical Reference Model (v 20.3) indicates four technologies comparable to the DSS CIS- Databridge. The VISN04 ARK/CIS Program Coordinator, however, has clarified to the contract specialist that “there are no other technologies that have undergone testing and are certified for use with the PICIS ARK and CIS for bidirectional communication between VistA and the COTS vendors” at this time.

(8) A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS THAT LED TO THE RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT ACQUISITION

FOR THE SUPPLIES OR SERVICES IS MADE:

The agency may continue to request information from industry and monitor the VA Technical Reference Model database to identify comparable technologies to meet the requirement.

(9) REQUIREMENTS CERTIFICATION: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4. (This signature is the requestor’s supervisor, fund control point official, chief of service or someone with responsibility and accountability.)
