- Authorization Request for a new CI

3 years $300,000

- Compliance with A.R.S. §§ 41-2533, 41-2534, 41-2538, or 41-2578 is impracticable

ADE/ESS is required to implement a state system related to general supervision responsibilities under the Individuals with Disabilities Education Act (IDEA: 20 U.S.C. §§1400 et seq.; 34 C.F.R. Part 300), Arizona statutes, and Arizona State Board of Education rules.

ADE/ESS occasionally requires the use of special compliance monitors to assist public education agencies in the completion of corrective action prescribed in dispute resolution proceedings. The request for a special compliance monitor in this case requires technical assistance and legal services for complex and nuanced, frequently student-specific, matters under the IDEA and its implementing regulations.

Legal compliance with special education federal and state regulations is required by the Office of Special Education Programs, USDOE. Additionally, student-specific matters are addressed in the ADE/ESS IDEA administrative complaint system.

The Special Monitor serves as an extension of the State Education Agency (SEA) in its implementation of General Supervision, articulated in the Individuals with Disabilities Education Act (IDEA). IDEA regulations and implementation guidance provided by the USDOE/Office of Special Education Programs (OSEP), as well as Arizona state statute, require that special education noncompliance in public education agencies (PEAs) be remedied at the individual and systemic levels within one year of the issuance of findings. It is critical that contractors operating as Special Monitors for ESS understand and can act as an extension of ADE/ESS in ensuring noncompliance is rectified in alignment with federal and state regulations.Ms. Bird has served in the SEA as ESS Chief of Dispute Resolution and understands IDEA General Supervision and correction of noncompliance in special education systems. She served in the SEA when the state statute was passed designating ASDB as the District of Residence for students it serves within its campuses and has extensive legal experience. Ms. Bird served as leadership within the SEA to assist ASDB, PEAs, and other special education stakeholders in understanding the new requirements. Further, a critical deadline for correcting noncompliance at ASDB has already begun. The letter of findings evidencing noncompliance was issued in mid-January 2025, meaning that by federal and state regulations, noncompliance at the individual and systemic levels must be completed by mid-January 2026. Ms. Bird is uniquely qualified to serve in this role and ensure that ADE efficiently ensures systemic correction of noncompliance at ASDB.

The price of $200 per hour is fair and reasonable, as this is the same as what she charges the Arizona Department of Child Services for legal services.
