About this file

This document is a fines and penalties chart approved by the City of New Haven, Connecticut's Board of Aldermen for fiscal year 2024-2025, establishing enforcement mechanisms for compliance violations related to construction contracts and workforce development requirements. The chart outlines specific monetary penalties for various infractions including failure to attend mandatory pre-award conferences ($3,000 or 2% of contract amount), late submission of certified or living wage weekly payroll reports ($1,000 per week or 1% of contract amount, whichever is greater), missing or incorrectly completed daily employee reports ($750 per violation), and violations of minority, female, and resident participation goals ($2,000 or 1% of contract amount per week of violation). The penalties are assessed against subcontractors, hiring contractors at all tiers, and general contractors depending on the nature and severity of the violation, with escalated fines for repeat offenses such as the sixth occurrence of missing daily reports on the same project.

These penalties are referenced under City of New Haven ordinance 17-201(15) and are administered by the Commission on Equal Opportunities to ensure contractor compliance with the city's Living Wage Ordinance, workforce diversity requirements, and reporting standards. The fines and penalties structure is directly applicable to the city's on-call electrical services contract (solicitation 2025-IFB-236) valued at $99,000, which mandates that contractors meet diversity workforce requirements including a minimum 15% apprentice workforce and maintain strict compliance documentation. Contractors bidding on city construction and service contracts must understand these enforcement mechanisms, as non-compliance can result in significant financial penalties and potential contract termination across all tiers of the contracting hierarchy.
