About this file
This is a Budget Fines and Penalties Chart approved by the Board of Aldermen for the City of New Haven, Connecticut, outlining compliance violations and associated financial penalties for construction contracts in fiscal years 2024-2025. The document establishes enforcement mechanisms administered by the Commission on Equal Opportunities and covers violations related to prevailing wage requirements, minority and female participation goals, resident participation goals, and general administrative compliance. Specific penalties include $3,000 or 2% of the construction contract amount for failing to conduct pre-award conferences, $1,000 per week for late certified or living wage payroll reports, $750 per violation for missing or incorrectly filled daily employee reports, and $2,000 or 1% of the contract amount per week for violations of maximum effort requirements related to minority, female, and resident participation goals. Penalties are assessed against subcontractors and all tiers of hiring contractors up to and including the general contractor, with escalated penalties applied for repeated violations at the same project site or when issues persist for extended periods.
The penalty structure demonstrates the City's commitment to enforcing labor compliance, wage standards, and diversity participation requirements across all construction contracts. Penalties vary based on violation type and severity, with some charges calculated as either a fixed amount or a percentage of the contract value, whichever is greater, ensuring proportional enforcement across projects of varying sizes. The chart applies to all construction contracts regulated under ordinance 17-201(15) and serves as a deterrent against non-compliance by imposing cumulative financial consequences for contractors and subcontractors who fail to meet reporting deadlines, employment documentation requirements, or workforce diversity targets. This penalty framework is particularly relevant to the Street Sweeper Brooms procurement opportunity, as any future construction or installation services associated with street maintenance infrastructure would be subject to these compliance requirements and financial penalties.
