About this file

This is a Fines and Penalties Chart document issued by the City of New Haven, Connecticut, outlining compliance violation penalties for construction contractors under the Commission on Equal Opportunities oversight. The chart establishes monetary penalties for various contractor violations including failure to hold pre-award conferences ($3,000 or 2% of contract amount), late submission of certified or living wage payroll reports ($1,000 per week or 1% of contract amount per week), missing or incorrectly filled daily employee reports ($750 per violation), and violations of diversity participation goals for minority, female, and resident workers ($2,000 or 1% of contract amount per week). Penalties escalate for repeat violations, such as when three or more subcontractors fail to attend pre-award conferences (charged at $4,000 per violation) or when payroll reports remain past due for eight weeks or longer. The penalties apply to subcontractors, general contractors, and all intermediate hiring tiers involved in construction projects.

This penalty structure serves as the enforcement mechanism for the City of New Haven's construction compliance program and would apply to the On Call PA System Repairs contract recently issued by the City of New Haven Public Schools. Contractors bidding on city projects must be aware that non-compliance with pre-award conference requirements, payroll reporting, daily documentation, and diversity hiring goals will result in assessed fines, with penalties potentially multiplied across multiple tiers of contractors on a single project. The chart was approved as part of the Mayor's proposed and Board of Aldermen-approved Budget Ordinance for Fiscal Year 2024-2025 and reflects the city's commitment to enforcing labor standards and equal opportunity requirements on all municipal construction contracts.
